Available through December 31, 2015, this promotion offers your customers a free MP6000 unit and accessories for use as part of a pilot program. To further help you generate and close MP6000 sales, we’re also offering a 75% discount on MP6000sales to customers following their pilot program.

By upgrading to the MP6000 from Zebra Technologies (“Zebra”), your customers can redefine throughput and the customer experience in even the busiest POS lanes. Thanks to high performance bar code capture, your customers’ POS is ready for any 1D or 2D bar code, whether it is printed on paper, a plastic loyalty card or displayed on the screen of a mobile phone. PROMOTION OVERVIEW

PROMOTION PERIOD / January 5 – December 31, 2015
ELIGIBILITY / All PartnerEmpower resellers participating in the Mobile Computing technology segment in North America that are authorized to sell the MP6000 (“Resellers”). See participation criteria below.
OFFER / Participating Resellers can offer qualifying customers or prospects (“End-User Company”) one free unit of the MP6000, to be used as part of a pilot program. No purchase is required to receive the free unit. Installation of the free unit will be provided by the Reseller in collaboration with Zebra, at no charge to the End- User Company.
In addition to the free units, End-User Companies also receive:
  • Free qualified accessories, required for an MP6000 system as defined in Solution Builder
  • Standard product warranty against defects in workmanship and materials for a period of 1 (one) year from the date of shipment on the device; serialized accessories carry a warranty of 90 days and non-serialized accessories carry a warranty of 30 days unless otherwise noted
Following the pilot program, participating Resellers can take advantage of an upfront discount off list price of 75% from Distributors on qualified sales of the MP6000, when additional units are sold to the participating End-User Company. (All discounts from Distributors to Participants represent recommended discounts only. Distributors are always free to sell at the prices they choose.)
Services are not eligible for the discount. In addition, please note that Advanced Services during the pilot program (other than the installation of the free unit) must be negotiated separately from the promotional offer.
RESELLER ROLE AND PARTICIPATION CRITERIA / Eligible Resellers must complete the Promotion Application Form for Resellers (following in this document) and must be approved as meeting the Promotion criteria by Zebra.
Resellers must offer the following to enable the End-User Company’s pilot program:
  • Delivery of the unit to the End-User Company site and installation of the unit (in collaboration with Zebra), at no charge to the End-User Company
  • Free support to the End-User Company for the duration of the pilot
  • Three- and six-month checkpoints, during which questionnaires on performance of the solution and overall satisfaction are completed by the End User Company
  • Reseller must be a member in good standing in the PartnerEmpower Program, participating in the Mobile Computing technology segment.
  • Reseller must demonstrate prior experience with bioptic retail scanners with at least two of its current retail customers using bioptic scanners from any manufacturer.
  • Reseller must qualify all End-User Companies and submit End-User Company Nomination Form and signed End-User Company Evaluation Agreement to .
  • Reseller must provide a monthly status report for any End-User Companies participating in the pilot, and coordinate the submission by each End User Company of the completed three and six-month follow-up questionnaires following installation, to .

RESELLER CERTIFICATION REQUIREMENTS / To order the free MP6000 unit, the Reseller must have completed the appropriate product access certification via My Learning Dashboard, depending on the model being sold:
  • MP6000 (Product Access Classification 4): NMVTC0002
  • MP6000 with scale (Product Access Classification 5): NMVTC0003

END-USER COMPANY Participation
CRITERIA / Resellers must complete an End-User-Company Nomination Form for each company interested in running a pilot program. End-user Companies will be approved for participation by Zebra based on the following criteria:
  • End-User Company must be a valid North American business with a minimum of 50 checkout lanes total in one or more stores
  • End-user Company must have a plan in place for a bioptic imager project in the first six (6) months of 2015 in the U.S. or Canada
  • Resellers will provide End-User Company with an Evaluation Agreement, which they must agree to sign
  • End-User Company must agree to serve as a reference following installation
Please note: End-User Company is responsible for any WAN connectivity activation and charges. End-User Company may be responsible for third parties’ software license and support fees.
Combination with Other PROMOTIONS / The Promotion (i.e., the recommended 75% discount off list) cannot be combined with the discount available to the Reseller through the Deal Registration Program, Price Exceptions or any other product or solution promotion covering the Products.
However, Resellers are encouraged to register the post-pilot End User Company’s opportunity to take advantage of the non-financial benefits of the Deal Registration Program.
PRODUCT SOURCING / Products must be obtained by the Reseller from Value-Added Distributors to be eligible for the Promotion.

  • Reseller completes Promotion Application Form for Resellers within this document and sends to . Zebra reviews the application, and if Reseller is approved as meeting the Promotion criteria, notifies Reseller.

PARTICIPANT TERMS

Promotion Period: January 5 – December 31, 2015

  1. Eligibility to participate in the Promotion (by Reseller and each End User Company) must be determined and communicated to Participants in writing by Zebra Technologies (referred to throughout this document as “Zebra”) prior to offering prospective customers free devices and product discount at all times during the Promotion period.
  2. Zebra will maintain a list of the channel partner program membership numbers of all Resellers approved for participation in this Promotion (“Participants”).
  3. Upon Zebra’s approval of participation for an End-User Company, Participant will be provided with a Promotion code unique to that End-User Company. Participant must notify the Distributor, at the time of order, of Promotion eligibility by providing the specific Promotion code for a particular transaction, in order to receive the free units from the Distributor or the product discount at the close of the pilot program.
  4. Participants must provide end-user name, country, and zip code information as well as any other sale-out information at the time of order with the Value-Added Distributor to be eligible to receive the free unit or promotional pricing.
  5. Participant must provide Zebra with status report on each opportunity being pursued as part of the Promotion on a monthly basis.
  6. The free units can only be provided to customers planning pilot bioptic scanner projects as described in the criteria above.
  7. Any post-pilot opportunity resulting from this Promotion cannot be combined with Price Exceptions, product promotions, solution promotions or any other promotions for the same device. The Participant’s overall opportunity can be registered with the Deal Registration Program to receive the non-financial benefits of the program only.
  8. The post-pilot product discount from Distributors to Participants represents recommended discounts only. Distributors are always free to sell at the prices they choose.
  9. The post-pilot discount cannot be applied to accessories or services sold in conjunction with the MP6000.
  10. Zebra reserves the right to audit all End-User Companies’ usage of Zebra devices as part of the pilot program to ensure that the Terms and Conditions of the Promotion (including the Zebra Evaluation Agreement) have been met, and to request additional information regarding the Promotion.
  11. The Promotion is available for orders placed January 5 – December 31, 2015, and shipped no later than 30 days after the conclusion of the Promotion period. Product supply during the Promotion Period is subject to availability.
  12. Zebra and its agents have the right to audit, validate, or verify any purchases/sales claimed and serial numbers submitted.
  13. Zebra reserves the right to modify, withdraw, or cancel the Promotion (in whole or in part) at any time and/or in any geography for any reason or for no reason, without prior notice.
  14. Any requests that do not comply with the terms of the Promotion will be rejected. The Promotion is subject to all local laws and regulations.
  15. Zebra and its affiliates and agents are not responsible for any Application Partner’s or solution provider’s software solution or for the operation and functionality thereof, whether on a stand-alone basis or in conjunction with the Zebra products provided under the Promotion, nor are Zebra and its affiliates responsible for the operation of any end user’s hardware, software, or system, or the failures, thereof, or for the loss of data and unavailability of systems, which may result from a participation in the Promotion and complying with its rules.
  16. The submission of false, incorrect, misleading or fraudulent information and/or documentation may result in disqualification from the Promotion and from future Zebra programs and promotions. The submission of false, misleading or fraudulent information may also result in the Reseller being subject to civil or criminal liability.
  17. Based on a report that is validated by the Participant and Zebra, if a Participant violates the conditions of the Promotion, Zebra and the Value-Added Distributor have the right to bill Participant for the free unit(s). Additionally, Zebra may terminate Participant from this Promotion and/or from the PartnerEmpower Program.

DISPUTES

THIS PROMOTION IS GOVERNED BY THE LAWS OF THE STATE OF ILLINOIS, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES.

As a condition of participating in the Promotion, Participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with the Promotion, shall be resolved individually and Participant hereby irrevocably submits for itself and its property in any legal proceedings relating to the Promotion and enforcement of any judgments with respect and in connection thereto, to the exclusive general jurisdiction of the courts of competent jurisdiction located in Lake County, Illinois, U.S., and to the respective appellate courts thereof in connection with any appeal therefrom. Further, in any such dispute, under no circumstances will Participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, consequential or other damages, including attorneys’ fees, other than the fair market value of the units purchased by Participant, and Participant further waives all rights to have damages multiplied or increased and to trial by jury. Under no circumstance will Zebra be liable for any Participant’s incidental, consequential, special, punitive, or exemplary damages of any kind, including lost profits, loss of business, or other economic damage arising out of or resulting from Zebra’s offering, conducting and/or terminating the Promotion or for any amount in excess of the market value of the Zebra product(s) purchased by the applicable Participant hereunder.
