Saida has filed second appeal dated 10-05-2019 which was received by this Commission on 13-05-2019 for not getting the information sought by him from the Public Information Officer/ the Mandal Educational Officer, Kodad Mandal, Suryapet District and the First Appellate Authority/ the District Educational Officer, Suryapet District. The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application dated 01-03-2019 before the Public Information Officer requesting to furnish the information under Sec. 6(1) of the RTI Act,TSIC 2005 on the following points mentioned: Stating that the appellant did not get any response from the Public Information Officer, he filed 1st appeal dated 05-04-2019 before the First Appellate Authority requesting him to furnish the information sought by him u/s 19(1) of the RTI Act, 2005. The First Appellate Authority through Lr.No. 1042/C2/2019 dated 12-04- 2019 directed the Public Information Officer to furnish the sought information to the appellant under intimation to their office. Stating that the appellant was not satisfied with the reply of the First Appellate Authority, he preferred this 2nd appeal before this Commission requesting to arrange to furnish the information sought by him u/s 19(3) of the RTI Act, 2005. In view of the Covid-19 pandemic, with a request to both the parties to attend for telephonic hearing on 07-10-2020 at 11.30 AM. The appellant responded and stated the PIO has not furnished any information till date. The PIO Mohd Saleem Sharif, Mandal Educational Officer, Kodad Mandal, Suryapet District responded and through letter No.066/MRCK/2020 dated.06-10- 2020 submitted that he has taken charge as PIO on 01-01-2020 and as the appellant is seeking information relating to Ashwini Educational Society it took some time to gather the information from the institution and to furnish the same to the appellant. The PIO further submitted a copy of the information along with the postal acknowledgement. Heard both the parties and perused the material papers available on record. The Commission observed that the PIO has furnished the gathered information to the appellant but did not provide the records available in their office. Hence the Commission directs the PIO to furnish the information available in their office to the appellant within a week through registered post with acknowledgement due and to report compliance to this Commission. With the above direction, the appeal is closed.
