SUSSEX. COUNTY COUNCIL-GEORGETOWN,DELAWARE-JULY 25, 1972 Call to The regular meeting of the Sussex County Council was held Order on Tuesday, July 25, 1972, at 10:00 a.m., with the fol­ lowing members present: Richard L. Timmons, President William B. Chandler, Jr., Vice President John L. Briggs, Councilman The meeting was opened with the Pledge of Allegiance and the repeating of the Lord ' s Prayer. M 251 72 Motion by :Mr. Chandler, seconded by Mr. Timmons, unanimously carried the minutes of the previous meeting were approved as submitted. Correspon­ The following correspondence was read: dence Office of the Governor, Fletcher E. Campbell, Jr. Re: Legislative Advisory No. 27 Milford School District, Charles A. McLaughlin, Superintendent Re: Delinquent taxes to Milford School District Lana and Wayne Bowden Re: Card of thanks for sympathy bouquet Department of Community Affairs and Environmental Development Re: Correction to the Delaware Tax Study as prepared by J. K. Lasser and Company :Mr. Muir, County Administrator, was appointed to the An­ cillary Manpower Planning Board by :Mr. Timmons. The next meeting will be held on August 10, 1972. Fran~f ord Members of the Frankford Town Council appeared before the Town Sussex County Gouncil to discuss the possibility of the Council Gouncil extending the water lines and leasing them to the Town of Frankford. Mr. Henry will study this matter and make a recommendation to the Council. Chester R. !'1r. Chester R. Morris was sworn in as Constable by :Mr. Morris Timmons. Mr. Morris will enforce the Solid Waste Ordinance and any other business assigned to him by the County Council. Penn Central Mr. Muir read a letter he received from the Penn Central R.R. Transportaton Company concerning the track layout for the industrial airpark at the Sussex County Airport. (101) July 25, 1972 Page 2 M 252 72 Motion by Mr. Chandler, seconded by Mr. Timmons, unanimously carried to adopt the following Resolution. R 014tf72 WHEREAS the eligible voters of the proposed South Bethany S. Bethany Water District approved the creation of the water district by a vote of 369 to 81 in an elction held July 22, 1972; and WHEREAS Title 9, Delaware Code, Section 6507 requires the County Council to issue a determination of the water district within 30 days of its approval by the eligible voters; NOW THEREFORE, BE IT RESOLVED, that the County Council of Sussex County, Delaware hereby determines that the eligilbe voters of the South Bethany Water District have approved the creation of such district; that the description of the South Bethany Water District is as follows: York Beach, Bay View, South Bethany, Middlesex Beach and all other lands between the aforementioned and the south­ erly limits of the Town of Bethany Beach between the Assa­ woman Canal and the Atlantic Ocean; be and that the said district is hereby declared to/validly constituted under the provisions of Title 9, Chapter 65 of the Delaware Code. The Clerk is directed to file a certified copy of this Resolution with the Clerk of the Peace. M 255 72 Motion by Mr. Chandler, seconded by Mr. Timmons, unanimously Tax Exp. carried to authorize Mr. Sidwell to carry out a program of advertising to inform people over 65 of the Tax Ex­ emption Program. M 256 72 Motion by Mr. Chandler, seconded by Mr. Briggs, unanimously carried to recess until 1:15 p.m. (102) July 25, 1972 Page 3 The Council reconvened at 1:15 p.m. for the purpose of holding the following public hearings: C/Z # 86 Application of Joseph Smith, Jr . for an RPG District in an :MR District located in Baltimore Hundred. The above case was recommended by the Planning and Zon­ ing Commission to be continued, therefore, the Council reserved their decision. C/Z #87 Application to amend the zoning map by changing from :MR to HR in Baltimo:reHundred b e ing lands of North­ towne, Inc. M 257 72 Motion by Mr. Chandler, seconded by Mr. Briggs, unanimously carried to concur with the recommendation of the Planning and Zoning Commission and grant this application. Vote by roll call: Mr. Briggs, Yea; Mr. Chandler, Yea; Mr. Timmons, Yea. C/Z #88 Application to amend the zoning map by changing from AR to :MR in Broadkill Hundred being lands of M. & O. Holding Co. M 258 72 (, ,1 Motion by :Mr. Briggs, seconded by :Mr. Chandler, unanimously ,)i· carried to concur with the recommendation of the Planning and Zoning Commission and grant this application. Vote by roll call: Mr. Briggs, Yea; Mr. Chandler, Yea; :Mr. Timmons, Yea. C/Z # 89 Application to amend the zoning niap by changing from AR to C-1 in Indian River Hundred being lands of Cozy Cove, Inc. M 259 72 Motion by Mr. Briggs, seconded by Mr. Chandler, unanimously carried to concur with the recommendation of the Planning and Zoning Commission and grant this application. Vote by roll call: Mr. Briggs, Yea; Mr. Chandler, Yea; Mr. Timmons Yea. C/Z #90 Application to amend the zoning map by changing from AR to GR in Dagsboro Hundred being lands of Parker Enterprises, Inc. The above case was recommended by the Planning and Zoning Commission to be continued, therefore, the Council re­ served t h eir decision. (103) July 25, 1972 Page 4 C/Z #91 Application to amend the zoning map by changing from AR to MR in Cedar Creek Hundred being lands of Del­ aware Pulpwood Co. The above case was recommended by the Planning and Zoning Commission to be continued, therefore, the Council re­ served their decision. C/Z #92 Application to amend the zoning map by changing from AR to MR in Dagsboro Hundred being lands of Robert B. ATkins. The above ease was recommended by the Planning and Zoning Commission to be continued, therefore, the Council re­ served their decision. C/U #66 Application by Robert H. Robinson for a conditional use or land in an AR District in Indian River Hundred. M 260 72 Notion by Mr. Briggs, seconded by Mr. Chandler, unanimously carried to concur with the recommendation of the Planning and Zoning Commission and grant this application. Vote by roll call: Mr. Briggs, Yea; Mr. Chandler, Yea; Mr. Timmons, Yea. C/U #67 Application by Richard C. Besche for a camper park in an AR District in Georgetown Hundred. The above application was denied by the Planning and Zoning Commission and the Council reserved their decision until a later date. C/U # 68 Application by Marie T. Lawson for an alcoholic beverage package store in a GR District in Boradkill Hundred. M 261 72 Motion by Mr. Chandler, seconded by Mr. Timmons, to concur with the recommendation of the Planning and Zoning Com­ mission and grant this application. Vote by roll call: Mr. Briggs, not voting; Mr. Chandler, Yea; Mr. Timmons, Yea. C/Z # 31 Application to amend zoning map by changing from AR to GR in Dagsboro Hundred being lands of Ernest A. Timmons Mobile Homes, Inc. M 262 72 Motion by Mr. Chandler, seconded by Mr. Briggs, unanimously carried to concur with the application of the Planning and Zoning Commission and grat this application. Vote by roll call: Mr. Briggs, Yea; Mr. Chandler, Yea; Mr. Timmons,Yea. (104) July 25, 1972 Page 5 C/Z #85 From AR to C-1 in Seaford Hundred being lands of John A. Moore, Jr., Seaford Construction Co., Inc. and Cecil B. Tull. M 263 72 Motion by :Mr. Briggs, seconded by :Mr. Chandler, unanimously carried to concur with the recommendation of the Planning and Zoning Commission and grant this application. Vote by roll call: Mr. Briggs, Yea; Mr. Chandler, Yea; Mr. Timmons, Yea. M 264 72 Motion by Mr. Chandler, seconded by Mr. Briggs, unanimously carried that the curb be removed between the Family Court Builaing and the U. S. Post Office so that this area can be used as a driveway for official use by the Post Office, with the understanding that the Post Office will provide a chain for closing this area. John M. John M. Mervine appeared before the Council to discuss Mervine his violation of the Sussex County Comprehensive Zoning Ordinance. The Council stated Mr. Mervine has not com­ plied with this ordinance and therefore no action was taken by the Council ofor a Conditional Use of land in an AR District located in Nanticoke Hundred.
