Pulipati Prakash resident of Khammam District has filed an appeal dated 21-03-2018 which was received by this Commission on 21-03-2018 for not getting the information sought by him from the PIO / O/o the Commissioner, Bhongiri Municipality, Yadadri-Bhuvanagiri District and the First Appellate Authority / O/o the Commissioner, Bhongiri Municipality, Yadadri-Bhuvanagiri District. The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application u/s 6(1) of the RTI Act, 2005 dated 27-09-2017 before the PIO requesting to furnish the below information: As the appellant did not receive the required information from the PIO, he filed 1st appeal dated 09-11-2017 before the First Appellate Authority u/s 19(1) of RTI Act 2005 requesting to take steps for furnishing the information sought by him. The First Appellate Authority also did not take any action on his first appeal. Hence he preferred this 2nd appeal before this Commission requesting to direct the PIO to furnish the information sought by him u/s 19(3) of the RTI Act, 2005. The 2nd appeal was taken on file and notices were issued to both the parties for hearing on 24-01-2019. The case is called on 24-01-2019. The appellant Sri.P.Prakash is present. The PIO Smt. Nirmala, Manager(Inchange) Revenue, Yadadri Bhongir Municipality is present. Heard both parties. The PIO submitted that the subject matter of 6(1) application related to HMDA hence they transferred the 6(1) application to the HMDA Hyderabad on 11-12-2017 but the PIO O/o HMDA vide his letter dt.23-12-2017 informed the PIO O/o the Bhongir Municipality that they have not received copy of the 6(1) application and requested to send the same. Hence the PIO O/o Bhongir Municipality is directed to forward the copy of the 6(1) application to the PIO O/o HMDA Hyderabad to enable them to furnish the information. The PIO O/o the HMDA Hyderabad is directed to furnish the required information within 15 days from the date of receipt of this order. With the above direction, the appeal is closed.
