Box No. 103 Fenelon Falls, Ontario K0M 1N0 Site Location: Victoria Road Quarry Part of Lots 7 & 8, Block B, North Portage Road Concession 1563 Kawartha Lakes Road 48, formerly in the Township of Bexley now in the City of Kawartha Lakes You have applied in accordance with Section 53 of the Ontario Water Resources Act for approval of: Proposed Works - addition of the collection sump to the effluent monitoring sample location (Table 1); all in accordance with the following submitted supporting documents: 1. Application for Approval of Industrial Sewage Works submitted by James R. Webster, of Five W Farms Inc., dated August 12, 2010, including all supporting documentation and correspondence. Previous Works “Previous Works” approved under Certificate of Approval No. 2173-653R27 dated September 23, 2004 as follows: the establishment of sewage works for the collection, transmission, treatment and disposal of up to 145 litres per second of groundwater and stormwater accumulating within the quarry, consisting of the following: - one (1) collection sump, located in the southwestern corner of the quarry floor and relocated as extraction operations progress, with a minimum effective volume of 3,750 cubic metres, equipped with a submersible pump operating at 145 litres per second, discharging to the sedimentation pond via a 250 millimetre diameter forcemain; - one (1) sedimentation pond, located northwest of the existing quarry, consisting of a impoundment created by a sand and gravel berm with a crest elevation of 260.5 metres above sea level, having a total effective storage volume of 18,500 cubic metres at the high water level of 260.5 metres above sea level, including a 10 metre wide rip rap lined overflow weir with an elevation of 260.5 metres above sea level, discharging to Grass Creek via a the marsh area west of the pond; and - all other controls, electrical equipment, instrumentation, piping, pumps, valves and appurtenances essential for the proper operation of the aforementioned sewage works; all in accordance with the following submitted supporting documents: 1. Application for Approval of Industrial Sewage Works submitted by James Webster of Five W Farms Inc. dated December 30, 2003; 2. Report on Hydrogeological Monitoring Review and Support Documentation for Section 34 Permit to Take Water and Section 53 Permit to Discharge Water, Victoria Road Quarry, prepared by Golder Associates, dated December 2003; and CONTENT COPY OF ORIGINAL 3. Letter and attachments dated April 6, 2004 from Rob Blair of Golder Associates to Randy Chin of the Ministry of the Environment. For the purpose of this Certificate of Approval and the terms and conditions specified below, the following definitions apply: (1) "Certificate" means this entire Certificate of Approval document, issued in accordance with Section 53 of the Ontario Water Resources Act, and includes any schedules; (2) "Director" means any Ministry employee appointed by the Minister pursuant to section 5 of the Ontario Water Resources Act; (3) "District Manager" means the District Manager of the Peterborough District Office of the Ministry; (4) "Ministry" means the Ontario Ministry of the Environment; (5) "Owner" means Five W Farms Inc., and includes its successors and assignees; (6) "Previous Works" means those portions of the sewage works previously constructed and approved under a certificate of approval; (7) "Proposed Works" means the sewage works described in the Owner's application, this Certificate and in the supporting documentation referred to herein, to the extent approved by this Certificate; and (8) "Works" means the sewage works described in the Owner's application, this Certificate and in the supporting documentation referred to herein, to the extent approved by this Certificate and includes both Previous Works and Proposed Works. You are hereby notified that this approval is issued to you subject to the terms and conditions outlined below: TERMS AND CONDITIONS 1. GENERAL CONDITIONS 1.1 The Ownershall ensure that any person authorized to carry out work on or operate any aspect of the Worksis notified of this Certificateand the conditions herein and shall take all reasonable measures to ensure any such person complies with the same. 1.2 Except as otherwise provided by these Conditions, the Ownershall design, build, install, operate and maintain the Worksin accordance with the description given in this Certificate, the application for approval of the Works and the submitted supporting documents and plans and specifications as listed in this Certificate. 1.3 Where there is a conflict between a provision of any submitted document referred to in this Certificateand the Conditions of this Certificate, the Conditions in this Certificateshall take precedence, and where there is a conflict between the listed submitted documents, the document bearing the most recent date shall prevail. 1.4 Where there is a conflict between the listed submitted documents, and the application, the application shall take precedence unless it is clear that the purpose of the document was to amend the application. 1.5 The requirements of this Certificateare severable. If any requirement of this Certificate, or the application of any requirement of this Certificateto any circumstance, is held invalid or unenforceable, the application of such requirement to other circumstances and the remainder of this Certificateshall not be affected thereby. 2. EXPIRY OF APPROVAL 2.1 The approval issued by this Certificatewill cease to apply to those parts of the Workswhich have not been constructed within five (5) years of the date of this Certificate. CHANGE OF OWNER 3.1 The Ownershall notify the District Managerand the Director,in writing, of any of the following changes within thirty (30) days of the change occurring: (a) change of Owner; (b) change of address of the Owner; (c) change of partners where the Owneris or at any time becomes a partnership, and a copy of the most recent declaration filed under the Business Names Act, R.S.O. 1990, c.B17 shall be included in the notification to the District Manager; (d) change of name of the corporation where the Owneris or at any time becomes a corporation, and a copy of the most current information filed under the Corporations Informations Act, R.S.O. 1990, c. C39 shall be included in the notification to the District Manager; 3.2 In the event of any change in ownership of the Works, other than a change to a successor municipality, the Owner shall notify in writing the succeeding owner(s) of the existence of this Certificate, and a copy of such notice shall be forwarded to the District Managerand the Director. 4. OPERATIONS MANUAL 4.1 The Ownershall prepare an operations manual prior to the commencement of operation of the sewage Works, that includes, but not necessarily limited to, the following information: (a) operating procedures for routine operation of the Works; (b) inspection programs, including frequency of inspection, for the Worksand the methods or tests employed to detect when maintenance is necessary; (c) repair and maintenance programs, including the frequency of repair and maintenance for the Works; (d) contingency plans and procedures for dealing with potential spill, bypasses and any other abnormal situations and for notifying the District Manager; and (e) complaint procedures for receiving and responding to public complaints. 4.2 The Ownershall maintain the operations manual up to date through revisions undertaken from time to time and retain a copy at the location of the sewage Works. Upon request, the Ownershall make the manual available for inspection and copying by Ministrypersonnel. 5. EFFLUENT LIMITS 5.1 The Ownershall design, construct and operate the Works such that the concentration of Total Suspended Solids does not exceed 25 milligrams per litre in the effluent being discharged from the sedimentation pond to the adjacent marsh. 5.2 For the purposes of determining compliance with and enforcing subsection (5.1), non-compliance with respect to the Total Suspended Solids concentration limit is deemed to have occurred when any single sample analyzed for Total Suspended Solids is greater than the corresponding maximum concentration set out in subsection (5.1). 6. EFFLUENT - VISUAL OBSERVATIONS 6.1 Notwithstanding any other condition in this Certificate, the Ownershall ensure that the effluent from the Works is essentially free of floating and settleable solids and does not contain oil or any other substance in amounts sufficient to create a visible film, sheen or foam on the receiving waters. EFFLUENT MONITORING AND RECORDING The Ownershall, upon commencement of operation of the sewage Works, carry out the following monitoring program: 7.1 All samples and measurements taken for the purposes of this Certificateare to be taken at a time and in a location characteristic of the quality and quantity of the effluent stream over the time period being monitored. 7.2 Samples shall be collected and analyzed at the following sampling point(s), at the sampling frequencies and using the sample type specified for each parameter listed: Table 1 - Effluent Monitoring Sample Locations 1.
