Subject to the provisions of this Order, the acquiring authority is under Sections 239, 240,246,249 and 250 of the Highways Act 1980 hereby authorised to purchase compulsorily the land described in paragraph 2. 2. The land authorised to be purchased compulsorily under this Order (i) is for the purposes of: - a) the improvement of the A27 Trunk Road; b) the construction of highways and improvement of existing highways in pursuance of the Highways England (A27 East of Lewes Improvement Scheme) (Shared Use Path) (Side Roads) Order 2019 c) the provision of new means of access to premises in pursuance of the Highways England (A27 East of Lewes Improvement Scheme) (Shared Use Path) (Side Roads) Order 2019 d) use by Highways England in connection with the construction and improvement of highways and the provision of private means of access to premises as aforesaid; and e) mitigating the adverse effect which the existence or use of the highways proposed to be constructed or improved will have on the surroundings thereof. the land described in the Schedule 1 and which is delineated and shown pink on the map prepared in duplicate, sealed with the common seal of the acquiring authority and marked “Map referred to in The Highways England (A27 Trunk Road East of Lewes Improvement Scheme) (Shared Use Path) Compulsory Purchase Order”. (ii) for the purpose of giving in exchange for the land which is to be compulsorily purchased which is common land the land described in Schedule 2 and delineated and shown green on the said map 3. In this paragraph “the order land” means the land numbered 12-01, 12-02, 12-06, 12-09 described in Schedule 1 and “the exchange land” means the land numbered 12-10a described in Schedule 2. i. As from the latest of the dates mentioned in sub-paragraph (ii) of this paragraph, the exchange land shall vest in the persons in whom the order land was vested immediately before it was vested in the acquiring authority, subject to the like rights, trusts and incidents as attached to the order land; and the order land shall thereupon be discharged from all rights, trusts and incidents to which it was previously subject. ii. The dates referred to in sub-paragraph (i) of this paragraph are- a) the date on which this order becomes operative; b) the date on which the plot of the order land is vested in the acquiring authority; c) the date on which the corresponding plot of the exchange land is vested in the acquiring authority. 4. Parts II and III of Schedule 2 to the Acquisition of Land Act 1981 are hereby incorporated with this Order subject to the modification that references in the said Parts of the said Schedule to the undertaking shall be construed as references to any building or work constructed or to be constructed on that part of the land authorised to be purchased on the said Map or, as the case may be, on the land over which new rights are authorised to be acquired.
