Srinivas filed a complaint which was received by this Commission on 11-09- 2018 for not getting the information sought by him from the Public Information Officer/ the Prohibition & Excise Officer, Komaram Bheem District. The brief facts of the case as per the Complaint and other records received along with it are that the complainant herein filed an application dated 07-06-2018 before the Public Information Officer/District Revenue Officer, Komaram Bheem District requesting to furnish the information under Sec.6(1) of the RTI Act, 2005. The Public Information Officer/ District Revenue Officer, Komaram Bheem District through Lr. No. A2/364/2018 dated 18-06-2018 transferred the application dated. 07-06-2018 to the Public Information Officer/ Prohibition & Excise Officer, Asifabad to furnish the sought information to the complainant. Stated that the complainant did not get any response from the Public Information Officer, he preferred this complaint before the Commission requesting to arrange to furnish the information sought by him u/s 18(1) of the RTI Act, 2005. Basing on the material papers available on record, the complaint is taken on file and notices were sent to the parties concerned directing them to appear before this Commission for hearing on 04-09-2019 at Hyderabad. The case is called on 04-09-2019. The complainant is present. The Public Information TSICOfficer / O/o the Prohibition & Excise Officer, Kumuram Bheem District HQ at Asifabad is absent. Heard the complainant and perused the records. The complainant through affidavit submitted that he did not get any information from the Public Information Officer / O/o the Prohibition & Excise Officer, Kumuram Bheem District HQ at Asifabad as sought in the 6 (1) application. On perusal of the material papers available in the case file, it is seen that the complainant filed 6(1) application under RTI Act, 2005 on 07-06-2018. There is no record of any information furnish by the Public Information Officer / O/o the Prohibition & Excise Officer, Kumuram Bheem District HQ at Asifabad. Thus, the action of the then/present Public Information Officer is not in accordance with RTI Act. Hence, the then/present Public Information Officer is hereby warned not to repeat such lapses in future in attending the applications filed under RTI Act, failing which, action will be initiated under section 20 of RTI Act.
