Proceedings of the 10 th meeting of Karnataka State Coastal Zone Management Authority (KSCZMA) held on 11 th August, 2015 at Deputy Commissioner Office, Udupi under the Chairmanship of Additional Chief Secretary to Government, Department of Forest, Ecology and Environment . Members present: As per the list enclosed. The Chairman welcomed the members present. All the files were placed before the Authority for perusal and the subjects were deliberated as per the Agenda. 10 .1: Confirmation of the proceedings of the previous KSCZMA meeting held on 28.05.2015. The proceedings of the previous KSCZMA meeting held on 28.05.2015 were read out. The proceedings were confirmed as there were no comments or amendments received from the members. 10.2: Action Taken Report on the proceedings of the previous KSCZMA meetings held on 28.05.2015. (Annexure-1). Action Taken Report at Annexure – I was perused and the Authority noted the Action Taken. 10.3 Ratification of provisional NOC issued by the Regional Directors (ENV) with the approval of the DCZMCs. The KSCZMA during the meeting held on 11.06.2014 had taken a decision to authorize the Regional Directors (Env) of the coastal districts to issue provisional NOC for construction/re-construction/repair of dwelling units in CRZ II and CRZ-III (200m – 500 m) and outside the CRZ limits with the approval of the concerned DCZMCs and then to submit proposal for ratification of the action taken. A detail procedure in this regard have been issued vide the Government letter No. FEE 236 CRZ 2013, dated 18.08.2014. Accordingly, the Regional Directors (Env) of the coastal districts have submitted proposals for ratification of the provisional NOC issued. The details of proposals on which provisional NOC have been issued by the Regional Directors (Env), Udupi and Uttara Kaannda districts subject to ratification are enclosed as Annexure – II, and Annexure – III respectively. The Authority reviewed the provisional NOCs issued by the Regional Directors, Udupi and Uttara Kannada Districts and after discussion the Authority decided to accord ratification for the action taken by concerned RDs. Further, the Authority decided to issue Proper CRZ NOC for the proposals listed in Annexure – II, and Annexure – III Draft Proceedings for the 10 th KSCZMA meeting 10.4: CRZ Clearance for construction/re-construction of residential & non residential buildings in CRZ – I, II & III Area. – Udupi District 10.4.1 Request for issue of NOC to Sri. Narayana Shriyan S/o Giriya Marakala for re- construction of residential house at Sy. No. 249/9A2A1 of Kodavoor Village, Udupi District (FEE 177 CRZ 2015). Sri. Narayana Shriyan S/o Giriya Marakala has requested NOC for re- construction of residential house at Sy. No. 249/9A2A1 of Kodavoor Village, Udupi District. The Regional Director (Environment) has inspected the proposed site and reported that the project site is at a distance of 60 m from HTL of River. It is classified as CRZ-I. As per approved CZMP 1996 area between HTL of River to 150 m or width of creek whichever is less is classified as CRZ I. The Regional Director (Environment) has submitted application in the prescribed format, survey sketch of site, draft digitised CRZ map showing the area of proposed re-construction, photos of old house, 1989-1990 year tax assessment extract, RTC, approved CZMP sheet and proceeding of DCZMC meeting held on 22.04.2015. The building is said to be around 291 sqm plinth area. The DCZMC recommended the proposal for issue of NOC in the meeting held on 22.04.2015. As per the provisions under the para 3(i)(e) reconstruction, repair works of dwelling units of local communities especially fisher folk is allowed in accordance with local town and country planning regulations. The Authority after discussion and deliberations decided to issue NOC for Reconstruction, as per the recommendation of the DCZMC. 10.4.2 Request for issue of NOC to Smt. Marli Poojarthy W/o Narayana Poojary for re- construction of residential house at Sy. No. 21/1AP1 of Paduvari Village, Udupi District (FEE 175 CRZ 2015). Smt. Marli Poojarthy W/o Narayana Poojary has requested NOC for re- construction of residential house at Sy. No. 21/1AP1 of Paduvari Village, Udupi District. The Regional Director (Environment) has inspected the proposed site and reported that the project site is at a distance of 60 m from HTL of Sea and 30 m from River HTL and is classified as CRZ III. As per approved CZMP 1996 area between HTL of sea to 500 m & 150 m from River is classified as CRZ-III. The Regional Director (Environment) has submitted application in the prescribed format, survey sketch of site, draft digitised CRZ map showing the area of proposed re-construction, photos of old house, 1989-1990 year tax assessment extract, RTC, approved CZMP sheet, certificate from Paduvari Grama Panchayath for change of door no. dated 17.07.2014 and proceeding of DCZMC meeting held on 22.04.2015. The building is said to be around 1054 sqm plinth area. The DCZMC recommended the proposal for issue of NOC in the meeting held on 22.04.2015. Page 2 of 49 Draft Proceedings for the 10 th KSCZMA meeting As per the provisions under the para 8(i)III CRZ IIIA of the CRZ Notification 2011 no construction shall be permitted within NDZ except for repairs or reconstruction of existing authorized structure not exceeding existing FSI, existing plinth area and existing density and for permissible activities under the notification including facilities essential for activities. The Authority after discussion and deliberations decided to issue NOC for Reconstruction as per the recommendation of the DCZMC. 10.4.3 Request for issue of NOC to Sri. Narayana Kharvi S/o Govinda Kharvi for re- construction of residential house at Sy. No. 119/6BP2 of Uppunda Village, Udupi District (FEE 181 CRZ 2015). Sri. Narayana Kharvi S/o Govinda Kharvi has requested NOC for re- construction of residential house at Sy. No. 119/6BP2 of Uppunda Village, Udupi District. The Regional Director (Environment) has inspected the proposed site and reported that the project site is at a distance of 49 m from Sea and 50 m from HTL of River & is classified as CRZ III. As per approved CZMP 1996 area between HTL of sea to 500 m & 150 m from River is classified as CRZ-III. The Regional Director (Environment) has submitted application in the prescribed format, survey sketch of site, draft digitised CRZ map showing the area of proposed re-construction, photos of old house, 1984-1985 year tax assessment extract, RTC, approved CZMP sheet and proceeding of DCZMC meeting held on 22.04.2015. The building is said to be around 24X18 sqm plinth area. The DCZMC recommended the proposal for issue of NOC in the meeting held on 22.04.2015. As per the provisions under the para 8(i)III CRZ IIIA of the CRZ Notification 2011 no construction shall be permitted within NDZ except for repairs or reconstruction of existing authorized structure not exceeding existing FSI, existing plinth area and existing density and for permissible activities under the notification including facilities essential for activities. The Authority after discussion and deliberations decided to issue NOC for Reconstruction as per the recommendation of the DCZMC. 10.4.4 Request for issue of NOC to Smt. Kamala W/o Macha kharvi for re-construction of residential house at Sy. No. 119/6BP3 of Uppunda Village, Udupi District (FEE 183 CRZ 2015). Smt. Kamala W/o Macha kharvi has requested NOC for re-construction of residential house at Sy. No. 119/6BP3 of Uppunda Village, Udupi District. The Regional Director (Environment) has inspected the proposed site and reported that the project site is at a distance 64 m from HTL of Sea and 34 m from HTL of River. As per approved CZMP 1996 area between HTL of sea to 500 m & 150 m from River is classified as CRZ-III. Eeramma D/o Dyavamma has requested NOC for re-construction of residential house at Sy. No. 2/1P1 of Uppunda Village, Udupi District. The Regional Director (Environment) has inspected the proposed site and reported that the project site is at a distance of 170 m from HTL of Sea and 45 m from HTL of River. Width of the Creek is 35m & is classified as CRZ III. As per approved CZMP 1996 area between HTL of sea to 500 m & 150 m from River is classified as CRZ-III.
