It is further notified that all the Advocates / Parties-in-Person are required to join the Court proceedings through the hyperlink provided in the respective cause list. Microphones and Video to be kept off in their device at the time of argument by other side Advocate to prevent disturbance during the video conferencing and un- mute the microphone only when their turn comes (at the time of their argument). All participants are required to have their case number and name shown when logged in (e.g. Item No.1 – Adv- Mr. ABC). This applies also to parties in person and litigants / representatives attending the VC. // By Order of The Hon’ble The Chief Justice// HIGH COURT, MADRAS : C.KUMARAPPAN DATED : 12.08.2020 : REGISTRAR GENERAL **************** 1 VIDEO CONFERENCING ETIQUETTE AND PROTOCOL (PRACTICE DIRECTIONS VC 2) a) This Protocol is in addition to “The Madras High Court Video- Conferencing in Court Rules, 2020 (‘VC Rules’ for brevity). If there is any doubt or perceived contradiction with these guidelines and aforementioned VC Rules, the latter will prevail; b) All the protocols, which are observed in the physical court shall be observed in virtual hearings also albeit with adaptations that technology demands; c) All lawyer participants shall be in their prescribed attire, but it is always open to the Hon’ble Judge/s concerned to exempt a participant from this, owing to Covid-19 situation; A lawyer so exempt shall be in presentable formal attire. d) Litigant participants shall also always be in presentable formal attire; e) Non-lawyer participants i.e., litigants shall unmute their video when the matter is called and the lawyer concerned shall identify the litigant whom she/he representing; f) When designated Senior Advocates participate in virtual courts, it is imperative that the counsel on record also joins the meeting, unmute the video and be present throughout the hearing. This will apply to other counsel who are arguing on behalf of counsel on record also. However, when a counsel is not arguing the case, but merely representing the counsel on record for an adjournment or any other like purpose, this requirement will not operate. 2 g) All the participants shall ensure that the backdrop is sober and such that it preserves the solemnity and sanctus ambience of physical court hearings. h) No participant shall do screen sharing or send a chat message without the permission of the Hon’ble Judge/s concerned. i) All participants should bear in mind at all points of time that there is always possible lag in virtual courts and therefore, wait for the other participant to finish before commencing his or her submissions or even before saying something so that one does not speak over the other. j) Participants should avoid conversation amongst themselves in the video-conferencing platform even when the Judge/s are not visible on the screen. This is to ensure that the video-conferencing platform for a virtual hearing is not used as a medium of communication between the participants. k) The participants should ensure that there are no other disturbances, more particularly audio disturbances around them ; l) Any participant, who has logged-in, should identify himself or herself, if called upon to do so, at all times when the virtual hearing is in session. m) A participant, who does not identify himself/herself by coming on the video, when called upon to do so any time during the virtual hearing, will be expelled / moved to the waiting room at the discretion of Hon’ble Judge/s concerned. 3 n) Participants should ideally leave the meeting as soon as their case is over and when the next matter is taken up; o) No participant should record the hearings unless prior special permission is granted by the Hon’ble Judge/s concerned; p) No participants shall take screen shots of the hearing without prior permission of the Hon’ble Judge/s concerned; q) Participants should not share sensitive information about the hearing witnessed while waiting for their turn. r) All instructions given by Hon’ble Judge/s concerned shall be strictly adhered to by all participants. // By Order of The Hon’ble The Chief Justice// HIGH COURT, MADRAS : C.KUMARAPPAN DATED : 12.08.2020 : REGISTRAR GENERAL ******** 4 NOTIFICATION NO. 169 / 2020 I.
