Page 12-14 March 1, 2020 LHF Architectural, Maintenance, and Appearance Guidelines Page 2 of 14 Lake Hogan Farms is a community that has a Homeowners’ Association (HOA) Board of Directors and an Architectural Review Board (ARB). The ARB serves under the direction of the HOA Board of Directors; and its responsibility is to enforce the Architectural, Maintenance, and Appearance Guidelines and all Covenants, as explained in the Legal Documents. When you close on your home, your real estate agent, or closing attorney, should provide a copy of the Declaration, Bylaws and Articles of Incorporation. If you decide to rent your home, it is the owner’s responsibility to ensure the renter receives of copy of all documents; as owner, you will be held accountable for the actions, or lack of, of any renters. This document applies to owners with a permit to occupy their home. Recreational areas are not obligated to the guidelines in this document. The purpose of these guidelines is to maintain a specific appearance in your community; allowing you to make minor alterations to your home in order to adapt your home to the needs of your family and your landscaping ideas. While each home will have its own personality, the control will ensure that property values in the Community will not be affected by any nontraditional, nonconforming, unusual, or distasteful alterations or improvements. This document sets guidelines. The ARB and the HOA Board of Directors may feel that the guidelines should not apply in a particular situation: in these situations, the ARB with consult with and defer to the Board. In all cases, the HOA Board can supplement or override existing guidelines. In all cases the HOA Board shall exercise their own judgment in making decisions. The HOA Board of Directors may amend these guidelines at any time. Any property alterations approved by the ARB will survive subsequent modifications to these guidelines as approved. For alterations made without ARB approval, for which the then-current ARB Guidelines required approval, you must submit an application for approval. While neighbor approval is not a prerequisite for ARB approval, it is important to communicate with adjoining property owners prior to undertaking a project. If the ARB Guidelines state you must receive ARB approval, you are required to submit the attached Application for Architectural/Landscaping Review form before altering the exterior of your home or landscape. (Please always check the LHF website for the latest ARB Guidelines and Application.) This form asks for detailed information about the project, diagrams, drawings, photos, rooflines, dimensions, colors, plat plans, types of plantings, and signatures of your neighbors. The application form has space for site line/adjoining neighbors to sign, indicate approval or disapproval and space to list any concerns; this is a requirement. The ARB will review applications and take neighbor feedback into consideration when making a decision on an application. If neighbors refuse to sign the form, or if you desire ARB assistance in approaching your neighbors/making them aware of your plans, please contact CAS. The approval of your request does not ensure that your project meets any City, County or State codes, rules, or guidelines. Please contact these agencies to learn what is required; and to obtain all necessary permits. Please be a good neighbor (& for your own safety), and call an underground line locating service to map out all utility lines if you are going to dig on your property. There's no charge for the service, and the call is toll-free: N.C. One Call Center, 1-800-632-4949 (they require up to 48 hours for the service). After receipt of your request, the ARB will review and respond to you, in writing. The ARB will time date each application with an email notice of receipt sent to CAS and the application. The ARB will issue an approval or disapproval within 30 days of receipt of the complete request; any official communication between the ARB, HOA or CAS regarding the application resets the 30 day window. If the application is determined to be incomplete and additional information is requested the application is considered rejected. The complete/revised application starts a new 30 day period. Any request for which there is no response within 30 days following the time date email receipt by the applicant it is approved as requested. Approvals remain valid on non-started projects for 6 months from date of approval. If the project is not commenced during this 6-month period, the approval will be rescinded and a new request will need to be submitted to the ARB for approval. If you disagree with any comments or requests made by the ARB you may contact your HOA Board and ask for an opportunity to present written appeal of your concerns with them at the next regularly scheduled meeting. At this time, they will hear and take into consideration your point of view. They will not be required to make a decision without reviewing any legal documents and discussing the matter with the ARB. You will be informed of the appeal decision as quickly as possible. Any appeal request for which there is no Board response within 30 days of the hearing before the Board is approved as requested.
