ROYAL BOROUGH OF KENSINGTON AND CHELSEA EXPERIMENTAL INTRODUCTION OF BOROUGH-WIDE 20 M.P.H. SPEED LIMITS The Kensington and Chelsea (20 m.p.h. Speed Limit) (No. 1) Experimental Traffic Order 2020 1. NOTICE IS HEREBY GIVEN that the Council of the Royal Borough of Kensington and Chelsea (hereinafter referred to as “the Council”), pursuant to arrangements made under section 19 of the Local Government Act 2000 and in accordance with Part 3 of the Local Authorities (Arrangements for the Discharge of Functions) (England) Regulations 2012 with Westminster City Council, on 5th November 2020 made the above-mentioned Order under sections 9, 10 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984, as amended. 2. The general effect of the Order will be, by way of an experiment, to impose a speed limit of 20 miles per hour (mph) in the roads or lengths of roads listed in the Schedule to this Notice (excluding any length that is GLA side road). This includes all publicly maintained roads within the borough and certain lengths of boundary roads that are shared in part with the City of Westminster, excluding any lengths of roads that are part of the Transport for London (TfL) Road Network, which are subject to speed limits set by TfL and any lengths of road that currently operate a 20mph speed limit (either on an experimental or permanent basis). The Order will have effect from 13th November 2020, as and when signs are erected indicating the 20 mph speed limit. 3. The Order provides that in pursuance of section 10(2) of the Road Traffic Regulation Act 1984, the Director for Transport and Highways at the Council of The Royal Borough of Kensington and Chelsea, or some person authorised by him, may, if it appears to him or that person essential in the interests of the expeditious, convenient and safe movement of traffic or for preserving or improving the amenities of the area through which any road affected by the Order extends, modify or suspend the Order or any provision thereof. 4. A copy of the Order and other documents giving more detailed particulars of the Order can be inspected at Council Offices, 37 Pembroke Road, London W8 6PW during normal office hours on Mondays to Fridays inclusive or may be obtained via email by contacting [email protected] 6. The Council will be considering in due course whether the provisions of the Order should be continued indefinitely by means of an Order made under sections 84 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984. Any person may object to the making of this Order for the purpose of such indefinite continuation within a period of six months beginning with the day on which the Order comes into operation, or, if the Order is varied by another Order or modified pursuant to section 10(2) of the 1984 Act, beginning with the day on which the variation or modification or the latest variation or modification came into operation. Any such objection must be in writing and must state the grounds on which it is made and be sent to Traffic Orders, Room 308, Council Offices, The Royal Borough of Kensington and Chelsea, 37 Pembroke Road, London, W8 6PW or emailed to [email protected], quoting reference RBKC/TMO/Borough-Wide 20mph Speed Limit ETO by 1st October 2021. 7. Under the Local Government (Access to Information) Act 1985, any letter you write in response to this Notice may be made available to the press and to the public, who would be entitled to take copies of it if they so wished. 8. Anyone wishing to question the validity of the Order or of any of its provisions on the grounds that it is not within the powers conferred by the Road Traffic Regulation Act 1984, or that any requirement of that Act or of any instrument made under that Act has not been complied with, that person may, within 6 weeks from the date on which the Order was made, apply for the purpose to the High Court.
