First Appellate Authority (U/RTI Act, 2005) the Revenue Divisional Officer, Kodad Division, Suryapet District. Order Sri M.Pradeep has filed second appeal which was received by this Commission on 19-03-2019 for not getting the information sought by him from the Public Information Officer/ the Deputy Tahsildar, Kodad Mandal, Suryapet District and the First Appellate Authority/ the Revenue Divisional Officer, Kodad Division, Suryapet District. The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application dated 18-12-2018 before the Public Information Officer/O/o the CCLA., Hyderabad requesting to furnish the information under Sec. 6(1) of the RTI Act, 2005 on the following points mentioned: TSIC The Public Information Officer/ O/o the CCLA., Hyderabad through CCLA’s Ref No.RTI-II(2)/1715/2018 dated 22-12-2018 transferred the application under section 6(3) of RTI Act, 2005 to the Public Information Officer/ O/o the Collectorate, Suryapet District to furnish the sought information to the appellant. The Public Information Officer/ District Revenue Officer, Suryapet through Lr.No. A5/175/2019 dated 19-01-2019 transferred the application under section 6(3) of RTI Act, 2005 to the Public Information Officer/ The Tahsildar, Kodad and to the Revenue Divisional Officer, Kodad to furnish the sought information to the appellant. Stating that the appellant was not satisfied with the reply of the Public Information Officer, he filed 1st appeal dated 24-01-2019 before the First Appellate Authority requesting him to furnish the information sought by him u/s 19(1) of the RTI Act, 2005. The District Revenue Officer, Suryapet District through A5/175/2019 dated 28-01-2019 transferred the application dated 24-01-2019 under section 6(3) of RTI Act, 2005 to the Public Information Officer/ Tahsildar, Kodad Mandal to furnish the sought information to the appellant directly under intimation to the First Appellate Authority and to their office. The Revenue Divisional Officer, Kodad through Notice No. / 179/2019 dated 12-02-2019 directed the Public Information Officer and the appellant to appear for hearing on 19-02-2019 at 11.00 AM along with related records/ documents. Stating that the appellant was not satisfied with the reply of the First Appellate Authority, he preferred this 2nd appeal before this Commission requesting to arrange to furnish the information sought by him u/s 19(3) of the RTI Act, 2005. In view of the Covid-19 pandemic, with a request to both the parties to attend for telephonic hearing on 01-07-2020 at 11.30 AM. The appellant responded and stated that the PIO has not furnished any information. The PIO / Sri.Suraiah, Deputy Tahsildar, Kodad Mandal, Suryapet District responded and stated that after formation of Suryapet District, Gondraiala village is allotted to Anantagiri Mandal and so he transferred the application of Sri.M.Pradeep to Tahsildar, Anandthagiri Mandal under section 6(3) of the RTI Act. The PIO Sri. Vajid, Deputy Tahsildar, Ananthagiri Mandal, Suryapet District responded and stated that the applicant is seeking the action taken report on the Revenue Officer. The PIO further stated that the information is with the Chief Commissioner of Land Administration and requested the Commission to allow him 20 days time to furnish the information. Heard both the parties and perused the material papers available on records. The Commission observed that when the First Appel filed by the appellant before the First Appellate Authority/RDO, Kodada on non receipt of information from the PIO. The TSICFirst Appellate Authority issued a hearing notice No.B/279/2019 dated.12-02-2019 to the concerned parties, but there is no evidence of any orders passed. The Commission directs the concerned PIO O/o the Tahsildar, Ananthagiri Mandal, Suryapet District to furnish the information as sought by the appellant within 2 weeks through registered post acknowledgement due from the date of receipt of this order and report compliance to the commission or otherwise further action as per section 20 of the Act will be initiated against all concerned. With the above direction, the appeal is closed.
