Pike Blvd. The School District has selected M Garcia Engineering, LLC – 400 Nolana, Ste. H2, McAllen, Texas 78504, (Phone (956) 687-9421 – Fax (956) 687-3211) to advertise, commencing on November 16, 2020. All prospective bidders will be required to deposit a certified or cashier’s check payable to the M Garcia Engineering, LLC in the amount of $150.00, as a guarantee of the safe return of the construction documents made part of the request for proposals. The district shall receive, publicly open, and read aloud the names of the Proposers and, if any are required to be stated, all prices stated in each proposal. Forfeit of Deposit: When the Documents are not returned under the conditions specified, none of the deposit will be returned. However, the Documents shall remain the property of the Owner and must be returned. The Owner reserves the right to reject any and all proposals and to waive any informality in the proposal process. No proposal shall be withdrawn within forty-five (45) days after the proposal opening without the specific consent of the Owner. CSP#21-01-19 Paving Project at Lackey Stadium Visitor Parking 5 GENERAL TERMS AND CONDITIONS 1.0 RESPONSIBLE PROPOSERS 1.1 Proposals will be accepted from responsible Proposers only for the entire scope of work described in the Contact Documents. As prerequisite to a Proposer’s qualifying for the award of contract on this work, the Proposer must complete each item of the Weslaco ISD Contractor’s Information Statement Form. The Statement and other requested information must be submitted with the proposal, no later that the proposal opening time and date. Facsimile transmittals are not acceptable. All Proposers submitting a proposal are encouraged to attend the proposal opening. 1.2 The primary purposes of the evaluation process will be to: 1.2.1 Gather information for the Owner’s evaluation procedure. 1.2.2 Enable the Owner and/or Engineer to evaluate the Proposals. 1.3 In arriving at his/her opinion concerning the Proposer’s qualifications, the Engineer will use the same criteria that the Owner will use in determination of the selection of the Proposers. 1.4 In the event the Proposers fail to submit the Weslaco ISD Contractor’s Information Statement no later than the proposal opening time and date, it will result in disqualification of proposal. 2.0 PROPOSER’S PRESENTATION: The Proposer, by signing and executing this proposal, certifies and represents to the District that: 2.1 Proposer has read and understands the Proposal Documents and his proposal is made in accordance therewith. 2.2 Proposer has visited the site, has familiarized himself with the local conditions under which the work is to be performed and has correlated his observations with the requirements of the proposed Contract Documents. 2.3 Proposer agrees to comply with use of the Davis Bacon wages rates for Hidalgo and Cameron County. The prevailing rates of wages are the minimums that must be paid in conformance with all applicable laws of the State of Texas and the Weslaco ISD. These rates are attached to the contract documents and labeled as Attachment “A”. 2.4 Proposer agrees to comply with the requirements outlined in Section 2.5. These requirements are absolute, and any Proposer who subsequently does not agree to comply with these requirements will automatically disqualify himself from receiving award of the contract. 2.5 Proposer agrees that: 2.5.1 Each Proposer by making his proposal represents that his proposal includes only material and equipment specified in the Proposal Documents and supplemented, if necessary, for a complete and operating system. 2.5.2 Each Proposer (and Sub-Proposer or supplier submitting a proposal to a Proposer) shall submit an affidavit stating that no asbestos, PCBs or lead building materials shall be used. 2.5.3 Where subcontract work is involved and where Acceptable Subcontractors are designated for particular sections of phases of the Work, each Proposer by making his proposal represents that his proposal includes only firms designated as Acceptable Subcontractors. 2.5.4 The Proposer will furnish and pay for a bid bond in the form of a bid bond, postal money order, certified
