49 Minutes of the Council Meeting held on Wednesday 21 January 2015 at 7pm in the Reading Room Hayton Present: Councillors: Tinnion (Chairman), G Clubbs, J Clarke, D Billington, C Bowman and M Longstaff. Nine members of the public and two County Council Officers were also in attendance (see Attendance Book) 1023 Apologies: Councillors: W Graham, D Jackson, C Forster, H Cain and R Watson 1024 Minutes of the Previous Meeting Resolved – to approve the minutes of the previous meeting as a correct record. Proposed – Cllr. Bowman Seconded – Cllr. Billington 1025 Declarations of Interest There were two Declarations of Interest: 1. Councillor Bowman declared a non-pecuniary interest in planning matters as he is a members of the Carlisle City Council Planning Committee 2. Councillor Tinnion declared a non-pecuniary interest being a Local Authority Governor at Hayton School 1026 Requests for Dispensation - None 1027 Matters arising from the Previous Minutes 1. Policy Documents – these have been signed by the Chairman and uploaded on to the website. 2. Parking Charges – Talkin Tarn – No further response from Brampton PC 3. Better Highways – U1288 Potholes, Hanson’s Quarry – Work undertaken, file closed. Resolved – to contact Better Highways regarding the outstanding work to the sides of the highway where there are major faults 4. Allotments – no response from Land Agent. The Lease expires on 31 December 2015. Resolved – to contact the Land Agent again to move matters forward. 5. Bus Shelter A69 – Cllr. Parsons has responded to the Council’s email stating that the bus stop was on the original planning application and that Hayton councillors were invited to attend site meetings. She states that she asked the developer for a bus shelter but the request was refused. Resolved – to agenda the item for the meeting in February and to obtain copies of the Green Plan Statement The meeting was suspended at 7.15pm for 1028 Public Participation Most of the residents present had attended to discuss the matter of the temporary TPO application at Hayton Townhead (Agenda Item 1030 on the Council agenda). The residents requested the Council support their efforts to have the temporary order made permanent and handed the Council a petition document with 113 signatures upon it. The Council confirmed that the land is registered as Common Land (CL196 – Sandpit, Townhead Hayton) and that they had written to the City Council in 2009 stating that fact. 50 The residents have contacted the TPO Officer at Carlisle City Council, the Open Spaces Society and Rory Stewart MP. They informed the Council that the developer had contacted the authorities to have the land deregistered. The residents asked the Council to support them in keeping the registration designating the land as Common. The Council meeting resumed at 7.25pm 1029 Hayton School – Parking Issues The Head Teacher, Sue Lingard and two Cumbria County Council Officers attended for this issue. The Head Teacher gave a comprehensive overview of the problems facing the school and village twice per day. She also gave a detailed overview of the actions taken to try to alleviate the problems. The CCC Officers confirmed that the speed of vehicles at school start and finish times is averaged at 15/16mph. At other times it is averaged at 16-19mph. There have been three events/accidents recorded by the Police over the past three years. Two were damage only and one was a slight injury. A consultation has been undertaken which the school is using to assist in writing a School Travel Plan. This is an important document which could lead to developer contributions should there be any development in the area. It was offered that a parish councillor could attend the Travel Plan committee meetings as it is important that the wider community is informed and can contribute to the issues. There are three recommendations to be investigated in more detail: 1. Flashing lights (to be erected before the summer by CCC) 2. Widening the path at Walnut Field 3. Cones, designed by the children to test whether more permanent road restrictions will work Resolved – the matter to be kept on future agendas to review the situation and the CCC to liaise with the Council. The Council to also look at its finances to see if there is any funding that they may be able to contribute. 1030 TPO Temporary Order – Woodland Hayton Townhead A letter has been received from residents of Hayton Townhead requesting the Council support the Order being made permanent. Resolved – to write to Carlisle City Council supporting the Order being made permanent and again bringing to their attention that the land is registered Common Land which the Council support being retained. Proposed – Cllr. Tinnion Seconded – Cllr. Longstaff 1031 Broadband for Talkin Village The Clerk had received a telephone call from Openreach regarding the placing of a new Fibre Broadband box in Talkin village. The box should go next to the existing box on the village green but for aesthetic reasons it is being suggested that the box goes adjacent to the telephone box. This will require the parish noticeboard and the post box to be relocated. This would be at the expense of the parish council and Royal Mail. 51 Photographs have been taken and it is suggested that the box should be placed around the corner from the telephone box adjacent to the grit bin. Resolved – As there has been no official notice from Openreach to leave the matter until then. 1032 Noticeboard in Heads Nook Wetheral Parish Council has requested permission to erect a noticeboard for Wetheral residents in Heads Nook. A response has been sent stating that the PC has no objections to a noticeboard being erected adjacent to the existing one but that it will require planning permission. Permission will also need to be sought from the Heads Nook Village Hall Committee on whose land the noticeboard will be erected. Resolved – to contact the Wetheral Parish Clerk. 1033 Hadrian’s Wall Draft Management Plan CALC has forwarded a Draft Management Plan which was emailed to all Members on 5 January 2015 – http://www.visithadrianswall.co.uk/world-heritage-management/hadrians- wall-management-plan-committee There was also an update report from Cllr. Bowman. Resolved – to write to the Hadrian’s Wall Management Committee to ask if they have an Utilisation Plan for the electric bikes that were purchased by the previous committee and when they will be available for use. Proposed Cllr. Tinnion Seconded – Cllr. Clubbs 1034 Carlisle City Council Local Plan An update report has been issued to all parish councillors. There is to be a Special Executive meeting on 26 January 2015 to agree another round of consultations. 1035 Police Matters and Reports The two newsletters have been issued to Members. 1036 Planning Applications 14/1062 – Land adjacent to Holly Bank, Faugh Brampton CA8 9EA. Erection of 1 dwelling (Outline). Resolved - Objection – Visibility at the junction of this unclassified road, U1294 leading from Stonebridge Lees is seriously substandard. An unauthorised mirror has been erected to assist drivers exiting the junction This application should not be approved unless the Highways Authority issue a notice under Section 79 of the 1980 Highways Act on the present owner of the land to: 1. Alter his hedge line 2. Not to erect any building on his land to affect the visibility at the junction and so enable a safe visibility distance to be achieved Under no circumstances should any development take place which would prevent any future highway improvements being made at this junction 15/0016 – 23 Little Corby Road, Little Corby CA4 8QN. Proposed rear and side extension to provide; Sunroom, Breakfast Room, Mezzanine Study and Utility. Resolved – No objection 15/0029 – Tow Top, How Mill Brampton. Replacement dwelling. The application has not been uploaded onto the Planning website therefore no decision could be taken at this meeting. 52 1037 Withdrawn Applications – None 1038 Deferred Applications – None 1039 Planning Decisions 14/0006/COU – Barns to the south of U1199, to the west of Hayton, Brampton Cumbria. Change of use of Agricultural Buildings to 2 dwellings including associated building operations. Decision - REFUSED. Appeal Received by Carlisle City Council beginning 12 January 2015 Resolved - Further Comment – The barns in question were only erected approximately 10 to 15 years ago so have no historic value. Also the land on which they are erected was, for many years a municipal refuse tip. 14/0029/TPO – Castle Hill Hayton. T4 Sycamore – Fell due to the level of decay in the base of the trunk, which could cause the tree to fail and damage the house. Replant with a sycamore. T5 Yew – Crown raise to create a clearance of 1m from ground level to allow for grass cutting and routine garden maintenance. T8 Cedar – Reduce crown extension over the neighbouring building to create a 2m clearance to prevent damage to the roof. Remove the larger diameter (>75mm) vertical growth on the branch growing towards the neighbouring outbuilding to reduce the branch weight and reduce the likelihood of a ‘hazard-beam’ failure. Remove dead and broken branches close to the drive and overhanging the neighbouring building >50mm to prevent damage to property. – No Comment Decision – GRANT PERMISSION 14/0767 – Barn Eden Little Corby Road, Little Corby Carlisle. Erection of two storey rear extension to provide Family Room on ground floor with 1 bedroom above and Canopy to rear. GRANT PERMISSION 14/0846 – 106 Hurley Road, Little Corby Carlisle.
