Expansion of Residential Complex at Holding No RGM,AS/534/04, Mouza Teghoria, and Holding 1 No RGM-582/AS/01/04, Mouza Kaikhali, VIP Road, PO-Airport, Ward No. 10 & 11 of Bidhan Nagar Municipal Corporation, Dist-24 PGS (North), West Bengal Conceptual Plan 1.0 INTRODUCTION Army Welfare Housing Organisation (AWHO) was formed in December 1978 under the Societies Registration Act XXI of 1860. Army Welfare Housing Organisation’s main aim and objective is to construct houses for serving and retired Army personnel and their widows in selected stations throughout India. The Adjutant-General of the Indian Army is the ex-officio Chairman of Army Welfare Housing Organisation. The Board of Governors of AWHO is entirely constituted of senior army officers. The headquarters of Army Welfare Housing Organisation is based in New Delhi, India. AWHO has planned expansion of its existing residential complex located at Holding No RGM- AS/534/04, Mouza Teghoria, and Holding No RGM-582/AS/01/04, Mouza Kaikhali, VIP Road, PO- Airport, P.S.-Rajarhat, Ward No. 10 & 11 of Bidhannagar Municipal Corporation, Dist-24 PGS (North), West Bengal in 2011 with the view of welfare of the serving and retired army officers and other ranks. The project site was earlier under the Rajarhat Gopalpur Municipality and now has been shifted to Bidhannagr Municipal Corporation. Approvals were taken from Rajarhat Gopalpur Municipal Corporation (RGMC) for expansion of the project. Project is spread on area of 47,500.435 sq m (11.73 acres) and the land is in possession of AWHO. Land documents are attached as Annexure I. Built-up area of the existing colony as per sanction was 26606.02 sq m. Construction of existing colony started in 1994 and got completed in 2011. Completion certificate is attached as Annexure II. However the construction of more than 50% was done till 2006 thus environmental clearance was not applicable on the existing phase of the project. As per approval it was proposed to develop 16 residential towers, security office and site office. Total 234 flats were to be developed as per Phase I sanction plan but only 222 flats were developed as required that time. In 2011, AWHO planned expansion of the project and project involves development of 4 blocks comprising of 10 towers and 1 club. In expansion phase total flats proposed to be built were 180. However remaining flats of phase I (12 nos.) were also constructed during the expansion phase of the project. Built-up area of the project after expansion became 56,882.87 sq m. As per EIA Notification, 2006 as amended projects having built-up area more than 20,000 sq m and less than 1,50,000 sq m are listed under Activity 8 (a) of schedule 1 of EIA Notification, 2006 and thus it was required to obtain prior environmental clearance for all the projects listed in schedule I. Accordingly, AWHO has submitted an application to SEIAA, West Bengal in year 2011 for obtaining the environmental clearance. The environmental clearance process took substantial amount of time. Project file was also closed by SEIAA/SEAC in 2013 without prior intimation to AWHO (as AWHO was unable to submit the information as required by SEIAA, i.e. permission from CGWB for the bore wells which Army Welfare Health Organization Expansion of Residential Complex at Holding No RGM,AS/534/04, Mouza Teghoria, and Holding 2 No RGM-582/AS/01/04, Mouza Kaikhali, VIP Road, PO-Airport, Ward No. 10 & 11 of Bidhan Nagar Municipal Corporation, Dist-24 PGS (North), West Bengal Conceptual Plan itself takes substantial time). Thereafter SEIAA/SEAC, West Bengal was dissolved due to completion of the tenure. New SEIAA formed has suggested AWHO to file fresh application in 2014. Accordingly AWHO has filed fresh application for obtaining the environmental clearance in 2014. In the mean time AWHO started the construction in anticipation of grant of environmental clearance on the basis of all the necessary approvals already obtained from the other concerned authorities and environmental management measures considered in the project design. SEIAA, West Bengal directed SEAC to carry out the site visit to examine status of the project and after the visit SEAC declared the project as violation of the EIA Notification, 2006 as construction works for expansion phase were taken up at the site. SEIAA then initiated the credible action against AWHO on basis of SEAC findings and asked AWHO to submit the resolution of board as per requirement of MoEF&CC OM dated 12.12.2012 in 2015. AWHO has submitted the resolution of board as required committing for not repeating the violation again. No action was taken on the project thereafter by SEIAA, West Bengal. The project was then delisted by SEIAA, West Bengal after issue of the MoEF&CC Notification SO 804 (E) dated 14.03.2017 and has directed AWHO to submit the fresh application to MoEF&CC for obtaining the environment clearance. We have now applied to MoEF&CC for grant of the environmental clearance for the project. Project construction has been completed barring some remaining finishing works. AWHO commits not to repeat such violation again in future. 2.0 APPLICABLE ENVIRONMENTAL LEGISLATIONS As per the EIA Notification, 2006, it is required for the project listed in the Schedule I to obtain prior environment clearance from concerned authority. Building and Construction projects having built-up area more than 20,000 sq m and less than 1,50,000 sq m falls under activity 8 (a) & Category B2 of schedule I of the EIA Notification, 2006 as amended. Thus, it is required to obtain prior environmental clearance from SEIAA, West Bengal for this project. But since the project involves violation of EIA Notification, 2006 the project will be appraised as per the MoEF&CC Notification S804 (E) dated 14.03.2017 under Category A. Bye Laws of the Local Body 3.0 LOCATION AND LAND USE OF PROJECT SITE Proposed project site is located at Holding No RGM,AS/534/04, Mouza Teghoria, and Holding No RGM- 582/AS/01/04, Mouza Kaikhali, VIP Road, Ward No. 10 & 11 of Bidhannagr Municipal Corporation, Dist-24 PGS (North), West Bengal. Location map of the project site is given below in Figure 1. Geographical co-ordinates of the center of the project site (phase II) are 22°37'34.80"N & 88°26'12.06"E. Geographical coordinates of all the corners of the project site (phase I & II) are given in Table 1 & Figure 2. Land use of the project is residential and site lies in residential area of Bidhannagar Municipal Corporation. Initially land use was agricultural and the conversion has been obtained for development of the residential project.
