Woods Ordinance previously introduced by: Presenter(s): Kent Moorman, Regional Transportation Engineer SYNOPSIS: This Intergovernmental Agreement (IGA) provides the non-Federal obligations for the State Highway 7 Preliminary & Environmental Engineering Project that the City and County of Broomfield, on behalf of the State Highway 7 Coalition, successfully applied for and received a Denver Regional Council of Governments Transportation Improvement Plan grant. The City and County of Broomfield is the lead agency and will have a separate IGA with the Colorado Department of Transportation (CDOT) regarding the entire project. This project does not construct State Highway 7, but does develop vertical and horizontal profiles, identifies right-of-way (ROW) needs and further develops environmental mitigations for the State Highway 7 corridor between Brighton and Boulder. By knowing this information, the City can better reserve ROWs; assure that any roadway, sidewalk, or trail construction is in the correct location; and have a better understanding on environmental issues and estimates on construction costs. RECOMMENDATION: Staff recommends Alternative 1, approve the resolution. BUDGET/STAFF IMPLICATIONS: The City approved $125,000 for this $10 million project in the 2020 Budget. ALTERNATIVES: 1. Approve the resolution. 2. Do not approve the resolution, which will leave the City without input or standing in the development of the State Highway 7 plans through the City and reduce the ability to receive State and Federal grants for State Highway 7. BACKGROUND (ANALYSIS/NEXT STEPS/HISTORY): (includes previous City Council action) The City is part of the State Highway 7 Coalition consisting of Adams County; Boulder County; the City and County of Broomfield; the cities of Boulder, Brighton, Lafayette, and Thornton; and the Town of Erie. COUNCIL COMMUNICATION PAGE 2 The State Highway 7 Coalition has successfully applied for and completed studies for a State Highway 7 Bus Rapid Transit (BRT) Feasibility and BRT Station Location and Design. The City has participated in both these studies. CDOT has completed the Planning, Environmental, and Linkage (PEL) study for State Highway 7, this project is the next step. The PEL study provided information on the needed number of lanes and made recommendations regarding trails, shared use paths, and transit. This project refines those recommendations. Approximately 25 percent of State Highway 7 between Brighton and Boulder is in the City. R E S O L U T I O N A RESOLUTION APPROVING THE INTERGOVERNMENTAL AGREEMENT AMONG ADAMS COUNTY; BOULDER COUNTY; THE CITY AND COUNTY OF BROOMFIELD; THE CITIES OF BOULDER, BRIGHTON, LAFAYETTE, AND THORNTON; AND THE TOWN OF ERIE FOR THE STATE HIGHWAY 7 PRELIMINARY & ENVIRONMENTAL ENGINEERING PROJECT. WHEREAS, Section 18(2)(a) of Article XIV of the Colorado Constitution and Sections 291-201, et seq., and 29-20-105 of the Colorado Revised Statutes authorize and encourage governments to cooperate by contracting with one another for their mutual benefit; and WHEREAS, Adams County; Boulder County; the City and County of Broomfield; the cities of Boulder, Brighton, Lafayette, and Thornton; and the Town of Erie (Parties) desire to set forth their understanding relating to the Colorado State Highway 7 Preliminary & Environmental Engineering Project (Project) which physically relates to proposed improvements to State Highway 7 from Brighton to Boulder; and WHEREAS, the City and County of Broomfield was the applicant for Federal Transportation Improvement Program funds through the Denver Regional Council of Governments and the Colorado Department of Transportation (CDOT) will be the lead for the Project and, as such, Broomfield and CDOT have entered, or will enter, into an Intergovernmental Agreement (IGA) regarding the Project; and WHEREAS, each of the Parties, has committed non-Federal funds which this IGA hereby is meant to memorialize in addition to outlining any other necessary obligations and responsibilities among the Parties; and WHEREAS, the Parties desire to enter into this IGA to share costs for the Project and provide for funding for same in accordance with the terms and conditions hereof. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THORNTON, COLORADO, AS FOLLOWS: 1. The IGA among the Parties is hereby approved in the form attached hereto and incorporated herein by this reference. 2. The City Manager is hereby authorized to execute, and the City Clerk to attest, the IGA in substantially the same form as attached hereto, on behalf of the City.
