Environment Agency Reference: DP201802114 Please quote the reference number in all correspondence Drought Permit – Modify existing abstraction Section 79A Water Resources Act 1991 as amended by the Environment Act 1995 The Environment Agency grants this Drought Permit to: Southern Water Services Limited (“the Water Company”) Southern House Yeoman Road Worthing West Sussex BN13 3NX Company registration number 02366670 This Drought Permit authorises the Water Company to abstract water pursuant to Licence No. 02/114 but with provisions of that Licence suspended and/or modified as set out in the Schedule to this Drought Permit. This Drought Permit commences from the effective date shown below and shall remain in force until the date of expiry shown below. All other provisions of the said Licence remain in full force and effect. CESSATION OF ABSTRACTION 1.1 Upon the Water Company confirming in writing to the Environment Agency its intention to operate to this Drought Permit and the Environment Agency confirming in writing receipt of such notice; Further Condition 9.4 in Schedule of Conditions 1 (Smallbridge), Further Conditions 9.3 and 9.4 in Schedule of Conditions 2 (Yalding) and Further Condition 9.1 in Schedule of Conditions 3 (Spingfield) of Licence number, 02/114 shall be modified by the following: Subject to Conditions 2.2 (i), 2.6 (i), and 2.7 (i) below, (i) the Minimum Residual Flow Profile (MRF) for January shall read 150 Ml/day, and (ii) the Minimum Residual Flow Profile (MRF) for February shall read 150 Ml/day, and (iii) the Minimum Residual Flow Profile (MRF) for March shall read 150 Ml/day. 1.2 Condition 1.1 of this Drought Permit shall end on 31 March 2018 and Further Condition 9.4 in Schedule of Conditions 1 (Smallbridge) of Licence number, 02/114 shall resume on the following day. 2. WATER QUALITY MONITORING 2.1 Condition 1.6 in Schedule of Conditions 6 (Water Quality Monitoring) of Licence number, 02/114 shall have the words ‘at seven initial sites’ in the condition revised to ‘at twelve initial sites’ and shall have the following water quality monitoring sites, parameters, measurement frequencies and conditions added to the table: (i) Monitoring Monitoring Site Parameter Frequency of Site Description (third column) measurement Number (second column) (fourth column) (first column) 8 River Medway Optical Dissolved Automated Estuary at Aylesford Oxygen measurement and Bridge Ammonium recording at 15 minute NGR TQ 72941 Turbidity intervals. 58916 Chlorophyll Conductivity Temperature pH 9 River Medway Optical Dissolved Automated Estuary at Snodland Oxygen measurement and at NGR TQ 70844 Ammonium recording at 15 minute 61782 Turbidity intervals. Chlorophyll Conductivity Temperature pH Ammoniacal nitrogen as N 12 Aylesford WwTW Optical Dissolved Spot sampling at weekly (final effluent Oxygen intervals. sampling point) at Ammonium NGR TQ 71684 Turbidity 59351 Chlorophyll Conductivity Temperature pH Ammoniacal nitrogen as N (ii) The water quality measuring devices at all monitoring sites (except sites 6 and 12) in Condition 1.6 in Schedule of Conditions 6 (Water Quality Monitoring) of Licence number, 02/114 shall have the facility to provide a signal at least every 15 minutes to a telemetry logger, to measure dissolved oxygen concentration. (iii) The Water Company shall be responsible for installing, maintaining and operating the telemetry logger(s) specified in Condition 2.1 (ii) above and for making and maintaining the connection between the water quality measuring devices and the telemetry logger(s). (iv) The Water Company shall install and operate a telephone line between its control centre and the telemetry logger(s) specified in Condition 2.1 (iii) above. 2.2 Condition 1.10 (ii) in Schedule of Conditions 6 (Water Quality Monitoring) of Licence number, 02/114 shall be substituted with the following: (i) The Water Company shall immediately notify the Environment Agency on 0800 80 70 60 and in writing if more than 10 dissolved oxygen measurements (15 minute samples) in any single day at any of the monitoring sites 1, 2, 3, 4, 5 and 7 are less than 60% saturation. If this occurs the MRF specified in Condition 9.1 of Schedule 1, Condition 9.3 and 9.4 of Schedule 2 and Condition 9.1 of Schedule 3 of this permit shall be 150 Ml/day and the release factor specified in Condition 9.1 of Schedule 3 shall be 1.1. 2.3 Condition 1.10 (iv) in Schedule of Conditions 6 (Water Quality Monitoring) of Licence number, 02/114 shall be suspended. 2.4 Schedule of Conditions 6 (Water Quality Monitoring) of Licence number, 02/114 shall have the following Conditions added: Page 3 of 25 Environment Agency Reference: DP201802114 If more than 10 dissolved oxygen measurements (15 minute samples) in any single day at any of the monitoring sites 1, 2, 3, 4, 5 and 7 are less than 60% saturation, as specified in Condition 2.2 (i) above, then starting from the time of notification to the Environment Agency, as specified in Condition 2.2 (i) above, the Water Company: (i) shall undertake daily fish distress monitoring and take such appropriate action in line with the FR22 Risk Assessment / Method Statement ‘Twyford Bridge Fish Rescue & Fish Stocking, River Medway’ methodology dated 12/12/2017 (in Appendix 2 of the ‘Bewl Winter Refill Drought Permit Application Environmental Monitoring & Mitigation Plan’ Version 1.0 dated January 2018) until such time as dissolved oxygen saturation levels have recovered so that no more than 10 dissolved oxygen measurements (15 minute samples) at any of the monitoring sites 1, 2, 3, 4, 5 and 7 are less than 60% saturation in a single day; and (ii) shall cease abstraction for a period of at least 24 hours at Smallbridge until such time as dissolved oxygen saturation levels have recovered so that no more than 10 dissolved oxygen measurements (15 minute samples) at any of the monitoring sites 1, 2, 3, 4, 5 and 7 are less than 60% saturation in a single day; and (iii) shall cease abstraction for a period of at least 24 hours at Yalding until such time as dissolved oxygen saturation levels have recovered so that no more than 10 dissolved oxygen measurements (15 minute samples) at any of the monitoring sites 1, 2, 3, 4, 5 and 7 are less than 60% saturation in a single day; and (iv) shall cease abstraction for a period of at least 24 hours at Springfield, up to a maximum of 48 hours should the Environment Agency so require in writing (by notification made within 24 hours of the notification given by the Water Company to the Environment Agency under Condition 2.2 (i) above.) Note: a single day means the period of 24 consecutive hours from 6am through to 6am. 2.5 Schedule of Conditions 6 (Water Quality Monitoring) of Licence number, 02/114 shall have the following Condition added: (i) If more than 10 dissolved oxygen measurements (15 minute samples) in any single day at any of the monitoring sites 1, 2, 3, 4, 5 and 7 are less than 60% saturation, as specified in Condition 2.2 (i) above, then starting from the time of notification to the Environment Agency, as specified in Condition 2.2 (i) above, if so required by the Environment Agency, the Water Company shall temporarily increase the compensation release as specified in Schedule of Conditions 4 (Bewl Reservoir) – Further Condition 9.1 up to a maximum of 10 Ml per day until such time as dissolved oxygen saturation levels have recovered so that no more than 10 dissolved oxygen measurements (15 minute samples) at any of the monitoring sites 1, 2, 3, 4, 5 and 7 are less than 60% saturation in a single day. Note: a single day means the period of 24 consecutive hours from 6am through to 6am. 2.6 Schedule of Conditions 6 (Water Quality Monitoring) of Licence number, 02/114 shall have the following Condition added: (i) Following the cessation of abstraction at Springfield, as specified in Condition 2.4 (iv) above, if upon recommencement of abstraction, more than 10 of the dissolved oxygen measurements (15 minute samples) for the preceding day at any of the monitoring sites 1, 2, 3, 4, 5 and 7 are less than 60% saturation then the modifications to Further Condition 9.4 in Schedule of Conditions 1 (Smallbridge) of Licence number 02/114, as Page 4 of 25 Environment Agency Reference: DP201802114 specified in Condition 1.1 (i), (ii) and (iii) above, shall not apply until such time as dissolved oxygen saturation levels have recovered so that no more than 10 dissolved oxygen measurements (15 minute samples) at any of the monitoring sites 1, 2, 3, 4, 5 and 7 are less than 60% saturation in a single day.
