In the Matter of Amendment of Section 73.202(b) Table of FM Allotments Canyon City, Oregon TO: The Chief, Allocations Branch The Chief, Mass Media Bureau PETITION FOR RULEMAKING Comes now, Blue Mountain Broadcasting, through its Consultant, and respectfully requests that the Commission institute rulemaking proceedings for the amendment of Section 73.202(b) of the Commission's Rules to amend allocations in the FM Table of Allotments as follows: EXISTING PROPOSED Canyon City, Oregon NONE 233 A In support whereof, the following is shown: 1. Blue Mountain Broadcasting, licensee of radio station KJDY (AM), John Day, Oregon seeks to have the Commission add FM Channel 233 A to the incorporated Town of Canyon City, as that community's first radio service of any kind and the first FM radio service of any kind to Grant County, Oregon, Radio Station KJDY 1 (AM), in John Day, a Fulltime Class 4 AM station, is the only 2 radio service in Grant County Ore~on at the present time. There 3 are no FM or Television allocations to any community in Grant 4 County at present. 5 2. If allotted, Blue Mountain Broadcasting, through this 6 petition request, confirms its intention and willingness to apply 7 to the Commission for a Construction Permit to build an FM 8 Broadcast Station at Canyon City, Oregon. 9 3. BOX S11 • SEAHURST, WA BsaeR ENGINEERING STATEMENT AND FREQUENCY STUDY REPORT INTRODUCTION This Engineering Statement and Frequency Study Report has been prepared for Mister Phil Gray & Blue Mountain Broadcasting, licensee of radio station KJDY AM , John Day, Oregon, in support of a request for rulemaking to amend the FM Table of Allotments to add FM channel 233 A to the community of Canyon City, Oregon. Canyon City is an incorporated city, located in Grant County, Oregon and just south of and contiguous to John Day, Oregon. The United States Department of Commerce, Bureau of the Census, lists the incorporated city of Canyon City on all of its~ lists and is encluded as an Exhibit. The Census Bureau has counted a population of 725 persons as of 1990, residing in the city. The local Chamber of Commerce estimates a population of 775 persons for the city of Canyon City. Canyon City is the County Seat for Grant County and has a modest business district as well as being the hub for" the county government. Over 8,500 persons reside and work in Grant County, Oregon. The instant rulemaking request would provide the county with its~ FIRST LOCAL FM SERVICE and the FIRST RADIO SERVICE to the city of Canyon City. Canyon City is located in the center of the county. A radio service as proposed would cover the complete population center of the county. As shown on the U.S.G.S. 7~ Minute map (E-2) , four radio sites or towers are present near the city of Canyon City. Anyone of these sites or a number of other sites near the area would enable Mr. Gray to provide complete coverage of the 'city of license as required by the Commission. SUMMARY The FM Channel Study, attached as Exhibit E-1, revealed that the proposed assignment of FM channel 233 A to eanyon City, Oregon, could be ~ade with no need for a site restriction of any kind. Relevant allocation data is presented in this engineering exhibit in support of this fact. The reference point coordinates used in the FM Channel Study were that of CanyodcCifj. -These"eoordinates meet the requirements of Section 73.208. As outlined in the intrduction, several possible transmitter site locations exist in and around the city area of Canyon City and we find no problem in meeting the requirements of Section 73.315. In conclusion, the proposed assignment of PM channel 233 A to the incorporated city of Canyon City~ Grant County, Oregon, complies with all applicable engineering standards of the Commtssion and the prClposed allotment conforms to present or other proposed allocations.
