Planning Sub Committee of Corporate Services Committee 17 January 2005 IRVINE, 17 January 2005 - At a Meeting of the Planning Sub Committee of the Corporate Services Committee of North Ayrshire Council at 2.00 p.m. Present David Munn, Tom Barr, Elizabeth McLardy and Robert Rae. Also Present Margie Currie (Items 1.1, 1.2, 1.3, 1.4, 1.5, 1.6 and 1.7). In Attendance A. Fraser, Manager Legal Services, J. Miller, Chief Development Control Officer, W. Stewart and M. Lee, Senior Development Control Officers (Legal and Protective); and A. Wattie, Communications Officer and M. Anderson, Corporate and Democratic Support Officer (Chief Executive's). Chair Councillor Munn in the Chair. Apologies for Absence Jack Carson, Gordon Clarkson, Drew Duncan, Elisabethe Marshall, David O'Neill and Richard Wilkinson. 1. Arran Local Plan Area 1.1 N/04/00918/PP: Whiting Bay: The Pantry Ross McKay, Cameronia Hotel, Shore Road, Whiting Bay, Isle of Arran, has applied for planning permission for alterations and erection of a 2 storey extension to the side and rear of the manager's flat and restaurant and part change of use of the restaurant to form a hot food carry out at The Pantry, Whiting Bay, Isle of Arran. An objection has been received from Ian Hotchkiss, 'Kirkalister', 10 Shore Road, Whiting Bay, Isle of Arran. The Sub Committee, having considered the terms of the objection, agreed to grant the application subject to the following conditions:- 1. That the hours of operation of the takeaway (when open to the public) shall be limited to the following: Mondays - Sundays: 1100 - 2300 hours 2. That, prior to the commencement of the takeaway use hereby approved, an external litter bin for use by customers at a position to be agreed in writing with North Ayrshire Council as Planning Authority shall be provided and thereafter maintained in a satisfactory condition. That details of the ventilation system for the kitchen, including any external ducting or flue shall be submitted for the written approval of North Ayrshire Council as Planning Authority prior to the commencement of the development hereby approved. Thereafter, the development shall be implemented in accordance with the details as approved. 4. That, prior to the commencement of the use of the takeaway, the additional parking spaces hereby approved shall be provided to the satisfaction of North Ayrshire Council as Planning Authority. In addition, a pedestrian pathway shall be formed from the additional car parking spaces, within the front garden area, to the takeaway to the satisfaction of North Ayrshire Council as Planning Authority. 1.2 N/04/00929/PP: Brodick: Strathwhillan Road: Site to the East of Brandon Lodge Neil Collie, Honey Hill Farm, Quarry Berry Lane, Chilcote, has applied for planning permission for the erection of a detached dwellinghouse on a site to the east of Brandon Lodge, Strathwhillan Road, Brodick, Isle of Arran. Objections have been received from C.J.G. Fforde, Arran Estates Office, Douglas Park and from the owners/occupiers of Barnhill, Strathwhillan Road, both Brodick, Isle of Arran. The Sub Committee, having considered the terms of the objections, agreed to refuse the application on the following grounds:- 1. That the proposed development would be contrary to Policy HOU5 of the Adopted Isle of Arran Local Plan and Policy ENV1 of the Finalised Isle of Arran Local Plan in that the development would be located in the designated countryside area where the policy seeks to restrict residential development to situations where a genuine operational need for a worker to live on the site has been demonstrated and where occupancy would be restricted to persons employed in agriculture, forestry or a similar rural activity or in the business to which the dwellinghouse would be related. 2. That the design of the proposed house is contrary to the aims and objectives of the Council's approved Rural Design Guidance for Arran by reason of its scale and design. 3. That the proposed house, by reason of its location, scale and design would detract from the character and appearance of both Brandon Lodge and the wider area. 1.3 N/04/01110/PP: Lamlash: Site to the North West of Blairbeg House Mr. and Mrs. Campbell, Blairbeg House, Lamlash, Isle of Arran, have applied for planning permission for the erection of a garage and workshop on a site to the north west of that address. An objection has been received from A.G. Balls, Blairbeg Lodge, Lamlash, Isle of Arran. Page 2 The Sub Committee, having considered the terms of the objection, agreed to grant the application subject to the following condition:- 1. That the development hereby approved shall be used only for purposes incidental to the enjoyment of the associated dwellinghouse, Blairbeg House. The development shall not be used for habitation or business purposes nor shall it be sold or let separately from Blairbeg House. 1.4 N/04/00957/PP: Lamlash: Shore Road: Old Pier Cafe Mr. and Mrs. R. Marr, 'Tiree', Brodick Road, Lamlash, Isle of Arran, have applied for planning permission for the erection of a second storey to the existing cafe and change of use of the retail unit to form residential accommodation at the Old Pier Cafe, Shore Road, Lamlash, Isle of Arran. An objection has been received from John Thomson Construction Ltd., Lamlash, Isle of Arran. The Sub Committee, having considered the terms of the objection, agreed to grant the application subject to the following condition:- 1. That, prior to the commencement of the development, the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority details of the proposed external finishes. 1.5 N/04/00681/PP: Lamlash: Cordon: Sycamore Cottage Harold Kyte, Sycamore Cottage, Cordon, Lamlash, Isle of Arran, has applied for planning permission for the sub-division of the existing detached dwellinghouse to form a house and studio cottage at that address. The Sub Committee agreed to refuse the application on the following grounds:- 1. That the proposed development would not afford a satisfactory degree of residential amenity to enable the formation of a separate dwellinghouse. Furthermore, the proposed dwellinghouse would be detrimental to the amenity of both the existing dwellinghouse and the area in general. 2. That the proposed development would be contrary to the Development Control Statement in the Finalised Isle of Arran Local Plan by reason of the restricted curtilage size and the increased density of dwellings in this predominantly low density residential area. 3. That the proposed development would set an undesirable precedent for further proposals of a similar nature, to the detriment of the residential amenity and character of the area. Page 3 1.6 N/04/00983/PP: Lamlash Pier: Former Weigh-House John Ferris, 30 Hamilton Terrace, Lamlash, Isle of Arran, has applied for planning permission for a change of use from Weigh-House to storage of diving equipment and base for diving activities at the former Weigh-House, Lamlash Pier, Isle of Arran. An objection has been received from D. Johnston, Johnston's Marine Stores, Old Pier, Lamlash, Isle of Arran. The Sub Committee, having considered the terms of the objection, agreed to grant the application. 1.7 N/04/00804/PP: Lamlash: Site to the North East of Llewellyn Mr. and Mrs. J. Thomson, Homestyles, Brodick, Isle of Arran, have applied for planning permission for the erection of a detached dwellinghouse on a site to the north east of Llewellyn, Lamlash, Isle of Arran. An objection has been received from Miller Crawford, Elderslea, Lamlash, Isle of Arran. The Sub Committee, having considered the terms of the objection, agreed to grant the application subject to the following conditions:- 1. That, during construction of the house, there shall be no direct vehicular or pedestrian access to the site from the A841. 2. That, prior to the commencement of the development, the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority samples of the proposed external finishes. 3. That details of the finished floor levels shall be submitted to, and agreed in writing with, North Ayrshire Council as Planning Authority, prior to any work commencing on site. 4. That development shall not begin on the house hereby approved until details of the drainage/sewage disposal scheme for the proposal have been submitted to, and approved in writing with, North Ayrshire Council as Planning Authority. 5. That the house hereby approved shall not be occupied until the approved drainage/sewage disposal scheme is operational in accordance with the details approved in writing under Condition 4. 6. That, notwithstanding the plans hereby approved, the access, parking and turning facilities shown on drawing No. 04/03/02-02 are not approved and, prior to any work commencing on site, revised parking, access and turning details shall be submitted to, and agreed in writing with, North Ayrshire Council as Planning Authority. The approved details shall be implemented prior to the house being occupied and, thereafter, maintained in accordance with the approved details. Page 4 2. Ardrossan/Saltcoats/Stevenston Local Plan Area 2.1 N/04/00947/PP: Ardrossan: Harbour Industrial Estate: Montgomerie Street: Unit 3A G.E. Greig, 12 Kilgraston Road, Bridge of Weir, has applied for retrospective planning permission for the change of use of business/industrial premises to car sales at Unit 3A Montgomerie Street, Harbour Industrial Estate, Ardrossan. Objections have been received from P. Monaghan, no. 39 and Mr and Mrs. H. Robinson, no. 43, both Montgomerie Street, Ardrossan. The Sub Committee, having considered the terms of the objections, agreed to grant the application subject to the following conditions:- 1.
