ACTION ITEM #7 WSU Pullman, Tobacco and Nicotine Free Campus (Olivia Yang/Dwight Hagihara) TO ALL MEMBERS OF THE BOARD OF REGENTS SUBJECT: WSU Pullman, Tobacco and Nicotine Free Campus PROPOSED: That the Board of Regents adopt WAC chapter 504-38. SUBMITTED BY: Olivia Yang, Interim Vice President for Finance and Administration SUPPORTING INFORMATION: During the 2014 spring semester, the WSU Pullman undergraduate students held a public forum and passed a referendum supporting a WSU Pullman tobacco free campus. Currently, RCW 70.160 prohibits smoking in public places and workplaces and requires that smoking occur 25 feet from entrances, exits, windows, and air intakes. After the referendum passed, President Floyd formed a WSU Pullman Tobacco Free Advisory Task Force (TFATF) that included representatives from the undergraduate students, graduate and professional students, faculty, Administrative Professional Advisory Council (APAC), Health and Wellness Services, Environmental Health and Safety, International Programs, Athletics, Student Affairs, Attorney General’s Office, WSU News, Real Estate and Local Relations, Public Safety, Human Resource Services, Facilities Services, and Procedures Records and Forms. The TFATF was asked to research how many universities are tobacco/nicotine free and to build on the feedback collected by the undergraduates by gathering additional feedback from graduate/professional students and employees. From its research, the TFATF determined there are 1,514 smoke free campuses, with approximately 67% (1,014) of these campuses tobacco free (Attachment A). The TFATF also determined that five of the PAC-12 universities are tobacco free (Attachment B). During the 2014-15 academic year, WSU Pullman employees and graduate/professional students were surveyed. The results of the surveys, along with the data collected as part of the undergraduate Finance and Audit Committee F-12 October 29-30, 2015 Page 1 of 3 students’ referendum were assembled into an overall summary (Attachment C). A public forum was held January 22, 2015 to update the WSU Pullman students, faculty and staff on the work of the TFATF, as well as potential revisions to the Safety Policy and Procedures Manual 6.10 and the creation of a new Washington Administrative Code (WAC) section to establish a WSU Pullman tobacco free campus. The WSU Pullman TFATF contacted other universities to gain an understanding of the various implementation issues associated with a designation as a Tobacco and Nicotine Free Campus. The TFATF and the administration believes the WSU Pullman campus can address the communication, facilities and related implementation issues; and therefore recommends the Board of Regents adopt WAC chapter 504-38 (Attachment D), with an implementation date of Fall 2016. A notice of opportunity to make public comment on this proposal, either verbally or in writing, was published in the Washington State Register on August 19, 2015, and in each edition of the Daily Evergreen September 8-11, 2015. Notice was also published on the WSU rule-making website, accessible by a direct link from the WSU home page. A public hearing was held on September 22, 2015. Five written comments were received – four from WSU employees, and one from a student; one oral comment was made by a graduate student at the public hearing. Most of the comments were not supportive of WSU-Pullman becoming a tobacco and nicotine free campus, with the following general concerns: • This appears to be discrimination and an infringement on personal freedoms. • The Pullman campus is too large compared to other campuses that are smoke-free; many employees must park far away from their work site, and thus would not have time to go to their personal automobile during a 15-minute break time. • Designated smoking areas should be allowed, moving them further away from buildings if necessary. • Illogical to ban nicotine as it comes in various forms; nicotine inhaler locations should be available, as staff will use nicotine patches and lozenges, so why not inhalers? • Department managers and supervisors should not have to discipline non-compliant employees. Finance and Audit Committee F-12 October 29-30, 2015 Page 2 of 3 • Smokers will congregate on the median strip of city streets that run through campus. • Advertising in the Daily Evergreen is not sufficient to inform the public about public forums and public hearings. • The graduate student survey did not take every graduate student vote into account. One comment was made in support of the rule, indicating hope that progress was being made on making Pullman a smoke-free campus like Spokane (from a student who takes classes on both campuses). All of these comments were shared with, and given consideration by the TFATF, and no changes are proposed. As background information, WSU Spokane became tobacco free campus in May 2012, and WSU Vancouver became a tobacco free campus in December 2013. WSU Tri-Cities is not presently a tobacco free campus, but is in discussion with its student, faculty and staff about becoming one.
