23rd October 1849 Removal Order Camborne to Crowan (Phillippa Eustice & children) CORNWALL To the Churchwardens and Overseers of the Poor of the Parish of Camborne TO WIT in the County of Cornwall and to the Churchwardens and Overseers of the Poor of the Parish of Crowan in the County of Cornwall and to each and every of them WHEREAS Complaint hath been made unto us Uriah Tonkin Clerk and William Cornish Esquire whose names are hereunto set, and Seals affixed, being two of Her Majesty’s Justices of the Peace, acting in and for the said County of Cornwall, (one whereof is of the Quorum,) at Camborne in the said County of Cornwall, on the twenty third day of October One Thousand Eight Hundred and forty nine by the Churchwardens and Overseers of the Poor of the Parish of Camborne in the said County of Cornwall, That Phillippa Eustice the Widow of Thomas Eustice Miner who dec’d more than twelve Calendar Months since and their three children viz Margaret aged about twenty five years, Phillippa aged about twenty years and Peter aged about seventeen years have lately come to inhabit and are now inhabiting in the said Parish of Camborne not having gained a Legal Settlement therein, nor produced any certificate acknowledging them to be settled elsewhere, and that the said Phillippa Eustice and her said three children Margaret, Phillippa and Peter are now actually chargeable to, and are now receiving relief from the said Parish of Camborne the said Phillippa Eustice not having become chargeable in respect of Relief made necessary by Sickness or Accident, and that the said Phillippa Eustice has not resided in the said Parish of Camborne for Five Years next preceding the Application now made for this Order or Warrant without receiving parochial relief. WE the said Justices, upon due proof made thereof, as well upon the Examination of Witnesses, to wit, of the said Phillippa Eustice, Samuel Hill Muse, Matthew Rodda and William Eva upon oath, as otherwise, and upon due consideration had of the Premises, do adjudge the same to be true, and we do likewise adjudge that the lawful Settlement of the said Phillippa Eustice and her said three Children viz Margaret, Phillippa and Peter is in the said Parish of Crowan THESE are therefore to require you, the said Churchwardens and Overseers of the Poor of the said Parish of Camborne or some or one of you, to convey the said Phillippa Eustice and her said three children viz Margaret, Phillippa and Peter from and out of your said Parish of Camborne to the said Parish of Crowan and them to deliver to the Churchwardens and Overseers of the Poor there, or to some or one of them, together with this our Order or Warrant, or a true Copy thereof, at the same time shewing to them the original; and We do hereby require you, the said Churchwardens and Overseers of the Poor of the said Parish of Crowan to receive and provide for them as Inhabitants of your said Parish of Crowan according to the Statutes in that case made and provided. Words in bold italics inserted into printed document Source: LDS Film 1596549 image 984; original document CRO Ref: P42/13/3/19/2 9th November 1849 Notice of Chargeability to Camborne & Grounds of Removal (Phillippa Eustice & children) Parish of Camborne in the County of Cornwall As to the Removal of Phillippa Eustice the Widow of Thomas Eustice Miner who died more than twelve calendar months since and their three children viz Margaret aged about twenty five years Phillippa aged about twenty years and Peter aged about seventeen years To the Churchwardens and Overseers of the Poor of the Parish of Crowan in the County of Cornwall TAKE NOTICE that the abovenamed Phillippa Eustice the widow of Thomas Eustice Miner who died more than twelve Calendar months since and their three children viz Margaret aged about twenty five years Phillippa aged about twenty years and Peter aged about seventeen years are now residing in chargeable to and in receipt of relief from our said Parish of Camborne and that an Order of Justices has been obtained for their removal to your said Parish of Crowan as their last place of legal settlement (a duplicate of which order is herewith sent). AND TAKE NOTICE that the following are the Grounds of the said Removal including the particulars of the Settlement relied upon by us in support thereof For that the said Phillippa Eustice and her said three children viz Margaret Phillippa and Peter are now residing in chargeable to and in receipt of relief from our said Parish of Camborne and that the said Phillippa Eustice and her said three children have not resided in our said Parish of Camborne for five years next before the date of the said Order of Removal without receiving parochial relief nor has the said Phillippa Eustice become chargeable to our said Parish of Camborne in respect of relief made necessary by the sickness of or any accident to the said Phillippa Eustice That Complaint was made by us the Churchwardens and Overseers of the Poor of the said Parish of Camborne of the above named facts to two of Her Majesty’s Justices of the Peace of in and for the said County of Cornwall previous to their making the said Order for the Removal of the said Phillippa Eustice and her said three children from our said Parish of Camborne to your said Parish of Crowan That the said Phillippa Eustice and her said three children are legally settled in your said Parish of Crowan That the said Phillippa Eustice is the Widow of Thomas Eustice Miner who died in your said Parish of Crowan about four or five years since. That they were married in your said Parish of Crowan about forty years since and the said Margaret Eustice Phillippa Eustice and Peter Eustice are the lawful issue of the said Marriage and children of the said Thomas and Phillippa Eustice That the said Thomas Eustice is the legitimate son of George and Mary Eustice both of whom died in your said Parish of Crowan some years since and at the time of the emancipation of the said Thomas Eustice the said George Eustice his Father was legally settled in your said Parish of Crowan That the said Thomas Eustice was born at Clowance Wood within Clowance Wall in your said Parish of Crowan in or about the year one thousand seven hundred and eighty five That in or about the year One thousand eight hundred and forty five the said Phillippa Eustice was relieved by your said Parish of Crowan whilst she was residing with her said three children in our said Parish of Camborne and the said Phillippa Eustice and her said three children were on several occasions within the last four or five years relieved by your said Parish of Crowan whilst they were residing in our said Parish of Camborne That the said Thomas Eustice never did any Act to acquire a settlement in his own right Nor has the said Phillippa Eustice done any Act to acquire a Settlement in her own right since the death of the said Thomas Eustice And that neither of their said three Children has done any act to acquire a Settlement in his or her own right AND TAKE NOTICE that unless Notice of Appeal against the said Order be received by us within twenty one days from the sending hereof (or in case of your application for a Copy of the Depositions on which such order has been made to Messieurs John Rodd and Darke, Solicitors, Penzance the Clerks to the said Justices within a further period of fourteen days after the sending of such copy) the said paupers will be removed to your said Parish of Crowan in pursuance of the said Order And no appeal against such Order can afterwards be allowed Given under our hands this ninth day of November in the Year of Our Lord One thousand eight hundred and forty nine (signed) James Paull Churchwardens and ? ?
