THE CORPORATION OF THE COUNTY OF PRINCE EDWARD BY-LAW No. 4473-2019 BEING A BY-LAW REGULATING THE RATE OF SPEED ALONG ROADS THAT ARE UNDER THE JURISDICT?ON OF THE COUNTY OF PRINCE EDWARD WHEREAS Section 128 of the Highway Traffic Act, R.S.0. 1990, c.H8, as amended, provides that a municipality may, for motor vehicles driven on a highway or portion thereof under its jurisdiction, by by-law prescribe certain rates of speed; AND WHEREAS the Council for The Corporation of the County of Prince Edward considers it necessary and advisable to enact such a By-law to regulate the rate of speed along roads that are under the jurisdiction of the County of Prince Edward and to consolidate various by-Iaws previously enacted to regulate speed as set out in the attached Schedules that form part of the by-law; NOW THEREFORE the Council of The Corporation of the County of Prince Edward hereby enacts as follows: 1. DEFINIT?ONS AND INTERPRETATION (1) In this By-Iaw, (a) "Act"meanstheHighwayTrafficAct,R.S.0.1990,c.H8,asamendedfrom time to time; and (b) "Corporation" means The Corporation of the County of Prince Edward. (2) Any word or term that is defined in the Act shall have the same meaning where such word or term is used in this By-law. (3) The use of sections and headings in this By-law is for convenience of reference only, and shall not modify or affect the interpretation or construction of any provision of this By-law. 2. RATE OF SPEED THAT the prescribed rates of speed along roads under The Corporation of the County of Prince Edward's jurisdiction be as set out in Schedules 'A', 'B', 'C', 'D' and 'E' attached hereto and forming part of the by-law. 1 3. PENALTIES AND SUSPENSION Every person who contravenes this By-Iaw is guilty of an offence and on conviction is Iiable to the fines and/or suspension of driver's licence provided for in the Act. 4. EFFECTIVE DATE This By-law shall take effect and come into force on the day this By-law is signed in accordance with the Act and the regulations pursuant thereto. s.
