Statutory Document No 358 /54 Road Races Act 1382 THE MAU INTERNATIONAL RALLY ORDER 1994 Coming into Operation: 13th September 1994 In exercise of the powers conferred on the Department of Highways, Ports and Properties by sections 1 and 2 of the Road Races Act 1982 (a), and of all other enabling powers, on the application of Manx International Rally Limited, the following Order is hereby made:- Citation and Commencement 1.This Order may be cited as the Manx International Rally Order 1994 and shall come into operation of the 13th September 1994. Interpretation 2. In this Order:- "the Clerk of the Course" means the official so designated by the Promoters in the official programme of the Manx International Rally and includes (in the absence of the Clerk to the Course) any Deputy Clerk of the Course so designated. "the Course" means the roads and portions of roads set out and described in Parts I, II, III, IV and V of Schedule 1, and includes parts of the Course. "the Department" means the Department of Highways, Ports and Properties; " marshal" means a marshal appointed by the Chief Constable under section 3 of the Road Races Act 1982; "promoters" means Manx International Rally Limited; "race days" means the days specified in Article 5; "race periods" means the periods of time specified in Article 5 when the Course (subject to Article 3) is closed to traffic in order to permit racing and purposes incidental thereto; "Pit Road area" means the portion of road set out and described in Schedule 2; (a) 1985 C.20 Price: £1.60 "Castletown Grandstand area" means the portion of road set out and described in Schedule 3; "Test Day and Test Period" means the day and period of time specified in Article 4; "Test section" means the roads set out and described in Part 1 of Schedule 1. Closure of Roads to Traffic and Suspension of Right of Way 3. During Test periods on the Test day and race periods on the race days, the Test section and the Course shall, subject to sub-paragraphs (a) to (f) be closed to, and the right of way thereover suspended for, all traffic other than:- (a) persons appointed as officials for the testing and races and vehicles approved for their conveyances by the Clerk of the Course; (b) constables, special constables and marshals, and vehicles approved for their conveyance by the Chief Constable and by the Clerk of the Course; (c) motor cars, drivers and navigators thereof engaged in the testing and races and their attendants; (d) press representatives, photographers and observers approved by the promoters, who are wearing the appropriate official armlet or permit issued by or on behalf of the promoters; (e) such other persons as the Department or Chief Constable may autho- rise in writing; and (f) such other vehicles as are approved by the Clerk of the Course. Use of Test Section 4. The Test section may be used for motor car testing on the 13th September 1994 and during the hours specified in relation to that section or until the testing is officially notified as completed in accordance with Article 7, whichever shall be the earlier. Use of Course for Motor Car Races 5. The Course may be used for motor car races on the 14th, 15th and 16th September 1994 and during the hours specified in relation to the respective section or until that part of the races on each particular section of the Course shall be officially notified as completed in accordance with Article 7, whichever shall be the earlier. Warning Indications n. It shall be the duty of the promoters to arrange such warning indica- tions as the Department on the recommendation of the Chief Constable may require at the junctions of all roads which lead into the Test section and the Course. Any such warning indications must be placed in position on the Test day and race days as soon as possible after the commencement of the Test period and race periods but before the Course is used for testing and races. Duty of Clerk of the Course to Notify Completion of Racing 7. On completion of testing in the Test period and racing in each race period it shall be the duty of the Clerk of the Course (or the senior police officer present in consultation with the Clerk of the Course) to ensure that an official motor vehicle displaying in a prominent position a notice with the words 'Roads Open' thereon shall follow the last permitted test run and last permitted competitor in the races, and the passing of any portion of Test section and the Course by such motor vehicle shall be official notification of the completion of the testing and the races for that particular race period as regards such portion so passed which will thereupon be open again for traffic, Areas Prohibited to the Public 8. Sections 15,20,30 Greenwood Cottage, Curragh Road and adjacent land, Ballaugh Curraghs. Sections 2,6,7,11,16,26,29 The triangular area of land surrounding Brandywell Cottage, abutting on the Druidale Road; the area on the inside of the junctions of the Brandywell and Druidale Roads, opposite Brandywell Cottage. Sections 5, 10, and 31 The garden of Ballakilley House, St Johns together with the boundary walls and small garden area immediately adjoining the front wall of this property which is situated on the C16 Tynwald Hill Road. Sections'4,25 and 32 The forecourt of Eairy Filling Station together with its boundary walls and adjoining land. Sections 3 and 8 The area of land at the Foxdale side of the junctions of the Shoulder and Glen Rushen Roads. Supplementary Road Closures 9. (a) Pit Road Area The Pit Road area may be used in connection with the Rally during the period from 7.00 a.m. on Monday 12th September 1994 until 5.00 p.m. on Sunday 18th September 1994 and will be closed to all unauthorised traffic. (b) Castletown Grandstand Area The Castletown Grandstand area may be used in connection with the :icily from the hour of 2.00 p.m. on Thursday 15th September 1994 until noon on Friday 16th September 1994 and will be closed to all unauthorised traffic. Erection of Stands 10. The promoters may cause to be erected on the Grandstand area on the day and times in accordance with Article 9 (b) stands or other appara- tus for the accommodation of spectators, such stands to be erected and dismantled and removed within the specified Castletown Grandstand area closure period. Charge for use of Stands 11. The promoters may make charges for use by spectators of stands and other similar facilities which may be provided. Promoters to secure Insurances and Indemnities 12. The promoters shall secure adequate insurances and indemnities against injury or damage to persons or property arising out of the conduct of the testing and races, and shall indemnify the Department against any claim or liability arising therefrom and shall take out adequate insurances to support or cover such indemnity. Restriction on breaking up the Course for Road Works 13. Paragraph 9 (1) of Schedule 4 (the Road Works Code) to the Highways Act 1986 shall apply to the Test section and Course from the 16th August 1994 to the 16th September 1994 Notice of the Making of the Order 14. Public notice of this Order shall be given by advertisement in two or more Isle of Man newspapers. SCHEDULE 1 PART 1 Tuesday 13th September 1994 DRUIDALE AND BRANDYWELL 10.00 a. m. - 2.00 p. m. The C37 Druidale Road from its junction with the Ballaugh Glen Road to its junction with the B10 Brandywell Road. The Brandywell Road from its junction with the Druidale Road to, but not including its junction with the D19 Little London Road. The B22 West Baldwin Link Road from both junctions with the Brandywell Road. PART II DAY 1 - WEDNESDAY 14TH SEPTEMBER 1994 1.DOUGLAS 9.35 a. m. - 12.45 p. m. The A2 Glencrutchery Road from Mountain View including the T.T. Grandstand to its junction with the A18 Bemahague Road including the 'Triangle' at the bottom of Greenfield Road and the 'Dip' at Governors Bridge. The Bemahague Road from its junction with the Glencrutchery Road to a point just east of its junction with A21 Watterson Lane at Cronk-ny-Mona. 2.BRANDYWELL, DRUIDALE 10.05 a. m. - 1.50 p. m. The Brandywell Road from a point 2.2 km east of its junction with the C37 Druidale Road to its junction with the Druidale Road. The Druidale Road from its junction with the Brandywell Road to it's junction with the Ballaugh Glen Road 3. SLIEU WHALLIAN,RUSHEN MINES, GLEN MAYE 10.40 a.m. - 2.25 p.m The whole of the C17 Gleneedle Road from St Johns. The D47 Garey Road from its junction with the Gleneedle Road to its junction with A27 Dalby Road in Glen Maye. The Dalby Road from its junction with the Garey Road to a point just south of the hairpin bend in Glen Maye. 4.PHILDRAW, ST MARKS, BRAAID, ELLERSLIE 11.10 a. m. 2.55 p. m. The A34 Phildraw Road from its junction with the A3 Castletown to Foxdale Road to its junction with the B29 Ballacharry Road at Ballanank. The Ballacharry Road from its junction with the Phildraw Road to its junction with the B30 Ballamodha Road at The Gate. The Ballamodha Road from its junction with the Ballacharry Road to its junction with the A26 Glen Vine to Ballasalla Road including the link road north of St Marks Church.
