January 20,2017 Honorable Alan Doane Chairman, House judiciary Committee Capital Building Helena MT RE: HB 230 Thank you for the great hearing on HB 230 {requiring costs paid to detention centers be based on actual costs) on Thursday, January 19. I wish to provide the committee with a little information to clarify some of the answers that were given by me and the sheriffs during the hearing. The actualcosts of running a detention facility vary between counties. Due to varying levels of operational costs, some county facilities incur daily costs below the 569 cap whiie others exceed the cap. I have attached a chart that displays the cost each county incurs per inmate per day. To illustrate the actualimpact of the $69 cap, referto column G which was the most recent contract year before the cap was implemented in 2015. in calculatingthe coststo local propertytax payers, we used the same projected bed numbers provided in column G. A large majority of inmates awaiting beds in State facilities are housed in the urban counties. This information is acquired frorn severaldata sources. The actual price information comes from 2015 contract rates. Columns B and C are from the Department of co rrections. A committee member asked how the state can be assured costs will not become excessive. While it is true that we are asking for actual costs with no cap, any question about the propriety of the costs claimedbythecountiesisaddressedbyauditlanguageonpage3ofthebill, linesTand8. Theseclauses refer to current statute providing for auditing of localgovernment and political subdivisions. Of the 4L county facilities in Montana capable of holding inmates on a long term basis, 24 have signed a Department of Corrections ( DoC)contract, 15 have not signed the contract,and2 do not take DoC inmates. A county will often consider several factors when deciding whether or not to accept inmates. This includes, available staff, transportation requirements of the inmate, medical needs of the inmate, and family considerations of the inmate. Another committee member raised a question regarding revenue from inmate phone calls. Phone charges are paid either with prepaid phone cards or by the recipient of the call. Any revenue brought in through phone services is placed in an account for the benefit of the inmates and pays for things like television, recreation equipment, etc. Again, thanl< you for yourtime and a good hearing. lf you have other questions please feelfree to contact me at 406.461,.1314.
