CITY CLERK Clause embodied in Report No. 6 of the Economic Development and Parks Committee, as adopted by the Council of the City of Toronto at its meeting held on June 18, 19 and 20, 2002. 15 Appointments to Fourteen Business Improvement Areas Boards of Management (Various Wards) (City Council on June 18, 19 and 20, 2002, adopted this Clause, without amendment.) The Economic Development and Parks Committee recommends the adoption of the following report (May 7, 2002) from the Commissioner of Economic Development, Culture and Tourism: Purpose: To appoint nominees to the Bloor Annex, Bloordale Village, Bloor West Village, Downtown Yonge Street, Eglinton Hill, Greektown on the Danforth, Kingsway, Lakeshore Village, Liberty Village, Mimico Village, Mimico by the Lake, Queen Broadview Village, Roncesvalles Village and St. Clair West Business Improvement Areas Boards of Management and to amend the City of Toronto Municipal Code, Chapter 19, “Business Improvement Areas” as necessary. Financial Implications and Impact Statement: There are no financial implications resulting from the adoption of this report. Recommendations: It is recommended that: (1) Council appoint the Business Improvement Area Board of Management nominees for fourteen BIAs, as listed in Attachment No. 1, for the balance of the 2001-2003 term; (2) amendments be made to the City of Toronto Municipal Code, Chapter 19, “Business Improvement Areas”, as outlined in Attachment No. 2, which identifies the number of board members that make up the board and the number of members required for quorum; and (3) the appropriate City officials be authorized and directed to take the necessary action to give effect thereto. Toronto City Council2 Economic Development and Parks Committee June 18, 19 and 20, 2002 Report No. 6, Clause No. 15 Background: Section 220 of the Municipal Act requires that Council appoint members of the Business Improvement Area Board of Management for a term expiring at the end of the term of the Council making the appointments. Accordingly, as long as the members continue to qualify, the nominees listed in Attachment No.1 shall expire on November 30, 2003, or as soon thereafter as successors are appointed. Each of the nominees named meets the requirements for membership set out in Section 220 of the Municipal Act. Comments: Attachment No. 1 to this report contains a list of nominated members for the Bloor Annex, Bloordale Village, Bloor West Village, Downtown Yonge Street, Eglinton Hill, Greektown on the Danforth, Kingsway, Lakeshore Village, Liberty Village, Mimico Village, Mimico by the Lake, Queen Broadview Village, Roncesvalles Village and St. Clair West Business Improvement Areas. These nominations were made at Board of Management meetings held by each of the above following the adoption of their 2001-2003 Boards. Upon submission of these nominees to the BIA Office and, when a sufficient number of BIAs warrant, a Board of Management report is submitted to Council for its consideration. Attachment No. 2 identifies the existing forty-two BIAs, their designating By-laws, number of Board of Management members and quorum. As noted in Attachment No. 2, the Greektown on the Danforth BIA has increased its Board from sixteen to seventeen members, the Roncesvalles Village BIA from nine to ten and the Village of Islington BIA has reduced its Board from eight to seven members. The Liberty Village BIA increased its Board from sixteen to seventeen with quorum increasing to nine. The City of Toronto Municipal Code Chapter 19, Business Improvement Areas, was adopted by Council at its December 4, 5 and 6, 2001, meeting and came into force on January 1, 2002. This Code represents the best practices of the former municipalities and also includes a comprehensive schedule, Attachment No. 2, compiling the lists of Boards of Management from the former municipalities. In compiling this list, the number of members and quorum for two BIAs were incorrectly identified. These include the Mount Dennis BIA, which should read as five Board members and three for quorum and the Upper Village (York) BIA which should read seven Board members and four for quorum. At the time of Council’s approval of the Yonge Lawrence Village BIA’s Board eight members were identified before Council members were appointed. Since that time two members of Council have been appointed to the Board. As a result the number of Board members should be increased to ten. Chapter 19 of the Municipal Code states that a majority of the members of the Board constitutes a quorum, unless Council approves an alternate quorum figure. Corso Italia BIA, as noted in Attachment No. 2, has a Board of seventeen members and, at the direction of its general membership, moved that five members constitute quorum. This quorum figure was adopted by Council at its January 30 and 31, February 1, 2001 meeting for the BIA’s 2001-2003 Board. The Board of Management members, identified in Attachment No. 1 of this report, represent replacement or new members within the 2001-2003 term. It is recommended that Council approve the Business Improvement Area Board of Management nominees for fourteen BIAs, as set out in Attachment No. 1 to this report and that the City of Toronto Municipal Code Chapter 19 “Business Improvement Areas” be amended, as necessary, as set out in Attachment No. 2 of this report.
