NAME OF APPLICANT: HARDY COUNTY PUBLIC SERVICE DISTRICT Application of the Hardy County Public Service District for a Certificate of Convenience and Necessity to construct potable water distribution systems in Hardy County, West Virginia, in the Marvin Chapel area near Wardensville, and in Baker and surrounding areas. NOTICE OF FILING WHEREAS, on January ,2010 the Hardy County Public Service District filed an application, duly verified, for a Certificate to construct certain potable water distribution systems in Hardy County, West Virginia. The application is on file with and available for public inspection at the Public Service Commission, 201 Brooks Street, in Charleston, West Virginia. WHEREAS, the Hardy County Public Service District estimates that construction will cost approximately $9,954,250.00. It is proposed that the construction will be financed as follows: West Virginia Infrastructure and Jobs Development Council loan in the amount of $1,641,250.00 (0% interest, 40 year term); United States Department of Agriculture, Rural Development Services, grant in the amount of $4,565,000.00; and a United States Economic Development Administration grant in the amount of $3,748,000.00. WHEREAS, the utility anticipates charging the following post project water rates for its customers: APPLICABILITY Applicable within the entire territory served AVAILABILITY Available for general domestic, commercial and industrial water service. RATES (customers with metered water supply) First 3,000 gallons used per month $13.25 per M gallons Next 7,000 gallons used per month $9.60 per M gallons Next 40,000 gallons used per month $3.97 per M gallons All over 50,000 gallons used per month $3.70 per M gallons MINIMUM CHARGE No minimum bill will be rendered for less than the following: 518 inch meter $39.75 per month 314 inch meter $59.65 per month 1 inch meter $99.40 per month 1 114 inch meter $145.10 per month 1 112 inch meter $198.75 per month 2 inch meter $3 18.00 per month 3 inch meter $596.25 per month 4 inch meter $993.75 per month 6 inch meter $1,987.50 per month 8 inch meter $3,180.00 per month 10 inch meter $4,571.25 per month RETURNED CHECK CHARGE A service charge of $25.00 will be imposed upon any customer whose check for payment of charges is returned by the bank for any reason. MUNICIPAL EXCISE TAX SURCHARGE The municipalities listed below, having imposed public utility tax computed on the basis of two percent of the revenues from water sales by Hardy County Public Service District water within the corporate limits of such municipalities, shall be billed a "surcharge" to the customers receiving service within said corporate limits. The water utility is required to collect the utility tax pursuant to West Virginia Code $8-13- 5a. Customers receiving water service within the corporate limits of the specified municipality shall pay a surcharge based on the following surcharge rates: Town of Moorefield Utility Excise Tax Rate 2% Surcharge Rate 2% DELAYED PAYMENT PENALTY The above schedule is net. On all accounts not paid in full when due, ten percent will be added to the net current amount unpaid. This delayed payment penalty is not interest and is to be collected only once for each bill where it is appropriate. WATER DISCONNECT-RECONNECT-ADMINISTRATIVEFEES Whenever water service has been disconnected for any reason, a disconnection fee of $25.00 shall be charged; or in the event the delinquent water bill is collected in the field, an administrative fee of $25.00 shall be charged. Whenever water service which has been previously disconnected for any reason is reconnected, a reconnection fee of $25.00 shall be charged. TAP FEE The following charges are to be made whenever the utility installs a new tap to serve an applicant. A tap fee of $150.00 will be charged to customers applying for service before construction is completed adjacent to the customers premises in connection with a certificate proceeding before the Commission. This pre-construction tap fee will be invalid after the completion of construction adjacent to an applicant's premises that is associated with a certificate proceeding. A tap fee of $400.00 will be charged to all customers who apply for service outside of a certificate proceeding before the Commission for each new tap to the service. LEAK ADJUSTMENT An amount not to exceed $4.00 per 1,000 gallons is to be used when a bill reflects unusual consumption which can be attributed to eligible leakage on the customer's side of the meter. This rate shall be applied to all such consumption above the customer's historical usage. The District shall establish a nondiscriminatory policy regarding this provision for leak adjustments. SECURITY DEPOSIT In accordance with West Virginia Law and Public Service Commission Rules and Regulations. EFT. CREDIT CARD. ACH AND DROP BOX PAYMENTS A service charge will be imposed on EFT, Credit Card, ACH or Drop Box payments. The amount shall be equal to the actual charges to the utility from the financial institution for processing payment. PRIVATE FIRE PROTECTION SERVlCE! * Where connections, hydrants, sprinklers, etc., on private property arc maintained by customer: 2 inch service line with hydrants, sprinklers, and/or connections $85.77 annually 3 inch service line with hydrants, sprinklers, and/or connections $195.02 annually 4 inch service line with hydrants, sprinklers, and/or connections $342.39 annually 6 inch service line with hydrants, sprinklers, and/or connections $867.89 annually 8 inch service line with hydrants, sprinklers, and/or connections $1,423.24 annually 10 inch service line with hydrants, sprinklers, and/or connections $2,524.99 annually 12 inch service line with hydrants, sprinklers, and/or connections $3,538.19 annually * Same as WVAWC These rates represent a project-related increase of 28.5% in billed revenues. A minimum bill based on 3,000 gallons of water usage per month would be $39.75. A monthly bill based on 4,000 gallons of water usage per month would be $49.35. The proposed increased rates and charges will produce approximately $3 16,025.00 annually in additional revenue, an increase of 34%. The Hardy County Public Service District does not have any resale customers. The increases shown are based on averages of all customers in the indicated class. Individual customers may receive increases that are greater or less than average. Furthermore, the requested rates and charges are only a proposal and are subject to change (increases or decreases) by the Public Service Commission in its review of this filing. Pursuant to $24-2- 1 1, West Virginia Code, IT IS ORDERED that the Hardy County Public Service District give notice of the filing of said application, by publishing a copy of this order once in a newspaper duly qualified by the Secretary of State, published and of general circulation in Hardy County, making due return to this Commission of proper certification of publication immediately after publication. Anyone desiring to protest or intervene should file a written protest or notice of intervention within 30 days following the date of this publication unless otherwise modified by Commission order. Failure to timely protest or intervene can affect your right to protest aspects of this certificate case, including any associated rate increases, or to participate in future proceedings. All protests or requests to intervene should briefly state the reason for the protest or intervention. Requests to intervene must comply with the Commission's rules on intervention set forth in the Commission's Rules of Practice and Procedure.
