Shirley McClellan, Acting Chair. 1405 THE ALBERTA GAZETTE, PART I, JULY 15, 2002 AMENDING AGREEMENT (Medicine Hat Gas Agreement) THIS AGREEMENT made effective as of January 1, 1994. BETWEEN: HER MAJESTY THE QUEEN in right of Alberta, hereinafter called “Her Majesty” represented herein by the Minister of Energy of the Province of Alberta (hereinafter called the “Minister”) AND CITY OF MEDICINE HAT, a Municipal Corporation (hereinafter called the “Corporation”) WHEREAS: (1) The parties entered into an agreement made effective as of January 1, 1988 (which is referred to therein as the “Medicine Hat Gas Agreement”) whereby, subject to the terms and conditions contained in that agreement, the Minister granted to the Corporation for a period of 21 years computed from the 1st day of January, 1988, the exclusive right to drill for, win, work and recover Natural Gas, the property of Her Majesty the Queen in right of Alberta, within and under the Provincial Lands described and defined in that agreement; (2) The Medicine Hat Gas Agreement was amended by the Amendment Agreement made effective as of January 1, 1994 to provide a new basis for calculating the Royalty Compensation payable to Her Majesty in respect of the Crown’s royalty share of Natural Gas produced from the Provincial Lands; (3) Her Majesty has agreed to: (a) the Corporation assigning, transferring and subletting interests in the Provincial Lands to affiliated entities, and (b) the Corporation and those entities affiliated with the Corporation involving both public and private companies in such exploration and development
