ORDER Sri N. Kedareshwar has filed 2nd appeal dated 18-04-2017 which was received by this Commission on 28-04-2017 for not getting the information sought by him from the Public Information Officer/ Deputy Tahsildar, Bheemgal Mandal, Bheemgal, Nizamabad District and 1st Appellate Authority / Revenue Divisional Officer, Armoor Division, Armoor, Nizamabad District. The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application dated 20-01-2017 before the PIO requesting to furnish the information under Sec.6(1) of the RTI Act, 2005, on the following points mentioned in his application: Since the appellant did not receive the information from the Public Information Officer, he filed 1st appeal dated 21-02-2017 before the 1st Appellate Authority requesting him to furnish the information sought by him u/s 19(1) of the RTI Act, 2005. Stating that he did not received any information, he filed 2nd appeal before this Commission requesting to take action against the Public Information Officer and First Appellate Authority for not furnishing information sought by him and also to arrange to furnish the information sought by him. (P.T.O) -2- Basing on the material papers available on record, the appeal is taken on file and notices were sent to the parties concerned directing them to appear before this Commission for hearing on 26-02-2019 at Hyderabad. The case is called on 26-02-2019. The appellant is present. Sri G. Vinod Kumar/ the Naib Tahsildar, Bheemgal Mandal is present and submitted a letter for coming late for hearing. Sri T. Neelakantam, Divisional Administrative Officer, O/o the Revenue Divisional Officer, Armoor Division, Nizamabad is present. Heard both the parties and perused the records. The Public Information Officer submitted his affidavit stating that rejected the application under section 8(1)(J) of RTI Act, 2005 through Lr.No. B/250/2017 dated 18- 02-2017. The Public Information Officer also submitted that the correction were made in the online pahani and 1B register to the Revenue Divisional Officer, Armoor through Lr.No. B/250/2017 dated 27-04-2017. The Public Information Officer also promised before the Commission during the date of hearing that the sought information will be furnished within one week. The Commission directs the Public Information Officer to furnish the sought information within one week to the complainant and submit compliance report to this Commission.
