Summary of the 60th session Skopje, 22.11.2013 – The Broadcasting Council (BC) at today’s session decided to issue the following Certificates forregistered program packages: -to Association of telecommunication engineering, software, trade and services BLIZOO MEDIA END BROADBAND DOOEL Skopje, for city of Veles, Certificate No.23 and for city of Tetovo, Certificate No.23, which supplements the registered program package with the television programming service: Balkanika; -to Association of telecommunication engineering, software, trade and services BLIZOO MEDIA END BROADBAND DOOEL Skopje, for city of Skopje Certificate No. 25, for city of Stip Certificate No. 20, for city of Kumanovo, Certificate No. 22 and for city of Prilep Certificate No.24, which supplement the registered program package with the television programming service: DM SAT and Balkanika; -to TRD operator on public cable network ROBI DOOEL Stip, branch Telekabel – digital package for Skopje, Veles, Stip, Bitola, Sv.Nikole, Strumica, Kocani, Negotino, Radovis and Kavadarci, Certificate No.20, which supplements the registered program package with the television programming services: Kanal 5 TV and Atlas TV; – to Association for communication, trade and services KAM NET DOOEL M.Kamenica, Certificate No.2, which supplements the registered program package with the television programming services: TV Star (regional), TV IRIS (regional), TV D1 (regional), Sport Klub, Sport Klub +, Fishing & Hunting, Golf Klub, Cinemania, Planeta and Balkanika; -to Association for telecommunication PET NET DOO, Certificate No.6, which supplements the registered program package with the television programming services: Russia 24 and RTR Planeta; -to Association for manufacturing, trade and services SPEJS TEL NET DOOEL s.Kadino Skopje, Certificate No.5 which supplements the registered program package with the television programming services: Alfa TV and Nasa TV. Summary of the 59th session Skopje, 20.11.2013 – The Broadcasting Council (BC) at today’s session adopted the Information for TRD Radio Fokus DOOEL Tetovo, after initiated procedure for revocation of its broadcasting license. BC concluded to stop the initiated procedure for license revocation, since after initiated procedure and before the final decision of the Council, the broadcaster has made the required fee payment. BC adopted the Information on Request for approval for changing the ownership structure of TRD SPORTSKO RADIO KANAL 4 DOOEL Skopje. Concerning that there are no legal obstacles, i.e. there is no illegal media concentration, the Council issued approval for changing the ownership structure of mentioned broadcaster. BC adopted Information on lack of valid agreements for retransmission of television program services from Discovery Networks platform(Discovery Channel, Animal Planet and TCL). Referring to information received from Discovery Communications Europe Ltd, the Council adopted conclusion to the operator of public communication network GIV DOO Gostivar to sent a written document, that it is not eligible for retransmission of program services Discovery Channel, Animal Planet and TCL, and to issue order for shutdown of mentioned program services. Hence, BC will issue a new Certificate of registration program package to GIV DOO Gostivar, which won’t contain programming services of Discovery Network. BC adopted Information for non accomplishment of change in the ownership structure, which approval was requested by TRD RADIO AKTUEL Bitola DOOEL. BC adopted Information regarding request from TRD TV Cegrane Media, v.Cegrane, Gostivar, for retransmission of its program service in program package of cable operator AS SAT DOO – Gostivar and IPTV operator Macedonian Telecom AD – Skopje. The Council concluded to send letter to the cable operator AS SAT DOO – Gostivar and IPTV operator Macedonian Telecom AD Skopje, with recommendation to retransmit television program service of the regional broadcaster TRD TV Cegrane Media, v.Cegrane, Gostivar. Summary of the 58th session Skopje, 18.11.2013 – The Broadcasting Council (BC) at today’s session discussed the Reports from monitoring of program services Radio Club FM Skopje, broadcasted on October 30, 2013, TV Menada – Tetovo broadcasted on August 27, 2013, TV Uskana Kicevo broadcasted on September 26, 2013, Tv Sitel Skopje broadcasted on October 21, 2013 and Nasa TV Skopje broadcasted on November 3, 2013. The Broadcasting Council decided to act in the following manner: -to Radio Club FM Skopje issued 2 (two) measures temporary prohibition to broadcast advertising for a period of one day – one measure is issued for violation of the provision of the Law on Broadcasting Activity to broadcast at least 30% vocal- instrumenatl music compositions in the Macedonian language while the second measure is issued for not labeling and separating the advertisements from the other parts of the programme by acoustic means and issued written warning for violating the obligation to clearly identify the sponsor of the programme service in an appropriate manner, i.e. to be clearly emphasized that the programmme is sponsored. Programme of this broadcaster will be subject of control monitoring, and in meanwhile, radio representatives will be invited at meeting whose purpose is violations not to be repeated; -to TV Uskana Kicevo issued written warning for exceeding the limit for advertisement for one clock hour; -to TV Sitel Skopje issued written warning for violation of Rules for protection of minors, i.e. for not labeling promotional announcements for featured programme with visual warning for category of the announced programme; -to Nasa TV Skopje issued written warning for violation of the obligation advertising in television programme to be inserted in a way that will not jeopardize the integrity and value of the program, and the rights of authors and others rights holders. During monitoring of TV programme of Menada-Tetovo no violations of the Law on Broadcasting Activity or by-laws were identified. However, also TV Menada programme will be subject to control monitoring and recordings of the programme will be provided by Broadcasting Council’s own resources. BC adopted the Information for illicited media concentration of TRD MUSIC RADIO KMR Ljubisha and BOBAN DOO Kumanovo and decided to order to the broadcaster within not more than 3 months since the day the illicit media concentration was ascertained, to align its operation with the provisions of Law on Broadcasting Activity. Summary of the 56th session Skopje 08.11.2013 – The Broadcasting Council (BC) at today’s session, adopted the Information upon Request of TRD Alsat – M Skopje and concluded to issue orderto all operators of public communication networks that were not mentioned in previous request from Alsat – M to blackout specific program service and to notify the operators about the order in writing and by e-mail. The operators of public communication networks, immediately after receipt of the order should blackout the foreign television program service of TV 21 Kosovo, TV Hayat and Vizion Plus, during premiere and reruns of broadcasting/retransmitting of the TV serial “Karadaj” in the following time slots: – On the program of TV Hayat plus, during the premiere of the serial “Karadaj” from 22:00 to 23:00 and during its reruns from 10:00 to 11:00am, broadcasted in working days; -On the program of TV Vizion Plus, the serial will be broadcasted only on Tuesdays and Wednesdays from 21:00 to 22:00, without reruns; and -On the program of TV RTV 21 reruns are broadcasted every day staring from 12:30 till 13:00 and the premiere is broadcasted only in certain days from of 21:30 to 23:00. If the serial is broadcast in time slots, other than the above mentioned, operators of public communication networks are obligated to blackout the screen every time when serial “Karadj” is broadcasted. BC will conduct control monitoring to check whether they comply with the order for blackout.
