Summarize the overall project, including work in areas both in and outside of waters or wetlands. The proposed project will replace an existing recreational pier, ramp, and floating dock located along the Yaquina River in Toledo, Oregon (see Attachment A: Figures). The existing pier and dock structures (constructed of wood and concrete) are in a deteriorated condition, and require replacement in order to maintain operability and longevity. Sections of the dock have recently broken and sank to the bottom. The replacement structures will be smaller in size, therefore reducing the existing overwater area by approximately 340 square feet. In addition, the new pier, ramp, and floating dock will be grated for increased light penetration. Furthermore, the 19 existing timber (steel-sleeved) support pilings (each 12 inches in diameter) will be replaced with up to 11, 16 to 18-inch diameter steel pilings, therefore also reducing the number of existing pilings. B. Describe work within waters and wetlands Work within waters will include replacement of the existing pier, ramp, dock sections, and associated support pilings. A summary of proposed waters impacts below the highest measured tide (HMT) of the Yaquina River is provided below (Table 1). The proposed project will not impact wetlands. Table 1. Describe how the removal and/or fill activities will be accomplished to minimize impacts to waters and wetlands. All work conducted below the HMT will occur between November 1 and February 15 of the Oregon Department of Fish and Wildlife (ODFW)-preferred in-water work window (IWWW) for the Yaquina River estuary, a period when Endangered Species Act (ESA)-listed species are least likely to be present within the vicinity of the project area. The proposed project will require approximately four to eight weeks of in-water/overwater work. Construction crews and equipment will access the project site via the existing pier and from a floating barge. The existing pier (450 square feet), ramp (100 square feet), dock sections (432 square feet), and 19 pilings will be removed with a crane and/or excavator operating from a floating barge. Removal of any sections of sunken dock will occur at low tide so workers can locate and remove the debris without causing turbidity. The 19 existing pilings will be dislodged with a vibratory hammer and slowly lifted from the sediment and placed into a contained area for appropriate upland disposal. No dredging or excavation will be required. The replacement pier (160 square feet), ramp (50 square feet), and dock sections (320 square feet) will be constructed of aluminum or fiberglass grating for increased light penetration. The replacement dock sections will include plastic (HDPE) floats for buoyancy. The pier and dock sections will be stabilized by 11, 16 to 18- inch diameter steel replacement pilings (see Attachment A: Plan Sheets).The steel replacement pilings will be installed using a vibratory hammer to their desired depth of approximately 30 feet into the substrate. It is anticipated that each pile will require approximately 15 to 30 minutes of vibratory hammer use. The contractor will implement appropriate sound attenuation methods (i.e., “soft-start” procedures and use of a bubble curtain) as outlined below in the Measures to Minimize Impacts. Measures to Minimize Impacts: The following conservation measures have been incorporated into the proposed project design and construction methods to minimize and avoid potential adverse effects to ESA- listed fish species, their designated Critical Habitat elements, and Essential Fish Habitat: All work conducted below the HMT will occur during the ODFW-preferred IWWW for the Yaquina River estuary (November 1 – February 15), a period when ESA-listed species are less likely to be present within the vicinity of the project area. All heavy equipment (i.e., crane) will access the project site via existing piers and/or floating barges. All pilings will be removed with a vibratory hammer. During piling removal, the following criteria will be implemented to minimize creosote release, sediment disturbance and sediment resuspension: o Install a floating surface boom to capture floating surface debris. o Consider the best tidal condition for piling removal, try to remove in-the-dry. o Keep all equipment (e.g., bucket, cable, vibratory hammer) out of the water, grip piles above the waterline, and complete work during low water and low current conditions. o Dislodge piling with a vibratory hammer, when possible; never intentionally break a pile. o “Wake” the piling by vibrating to break the friction bond between the piling and sediment. o Slowly lift the pile from the sediment and through the water column. o Place the pile in a containment basin on a barge deck, pier, or shoreline without attempting to clean or remove any adhering sediment. o Fill the holes left by each piling with clean, native sediments immediately upon removal. o Dispose of all removed piles, floating surface debris, any sediment spilled on work surfaces, and all containment supplies at a permitted upland disposal site. When a pile breaks or is intractable during removal, removal will continue as follows: o Every attempt short of excavation will be made to remove each piling, if a pile in uncontaminated sediment is intractable, breaks above the surface, or breaks below the surface, cut the pile or stump off at least 3 feet below the surface of the sediment. The following conditions will apply when removing preservative-treated wood: 3 January, 29 2018 o To the extent possible, ensure no wood debris falls into the water.
