Krishna Reddy, Nalgonda District-508 001 has filed 2nd appeal dated 12-02-2018 which was received by this Commission on 02-03-2018 for not getting the information sought by him from the PIO / The Superintendent, O/o the Mandal Praja Parishad, Rajapeta, Thurkapally, Yadgirigutta, Choutuppal, Mothkur, Narayanpuram and Ramannapeta Mandal and the Dy. Executive Engineer, RWS&S, Bhongiri, Choutuppal, Alair Division and DPRE, PIU Division, Yadadri Bhongitri District and 1st Appellate Authority / O/o the Mandal Praja Parishad, Rajapeta,Thurkapally, Yadgirigutta, Choutuppal, Mothkur, Narayanpuram and Ramannapeta Mandal and the Executive Engineer, RWS&S, Bhongiri, Choutuppal, Alair Division and DPRE, PIU Division, Yadadri Bhongitri District. The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application dated 08-09-2017 before the PIO under Sec.6(1) of the RTI Act, 2005, requesting to furnish the information on the following points mentioned in his application: TSIC The Public Information Officers/O/o. The Zilla Parishad Office, Nalgonda District has transferred the application U/s. 6(3)(2) of the RTI Act, 2005 vide Lr.No:D5/3618/3950/2017/ZPP dated 21-11-2017 to all the PIOs/Mandal Parishad Development Officers and Dy.EE, RWS &S of Yadadri Bhuvanagiri District. Since the appellant did not receive the information from the Public Information Officers, he filed 1st appeal dated 27-12-2017 before the 1st Appellate Authority u/s 19(1) of the RTI Act, 2005 requesting him to furnish the information sought by him. The 1st Appellate Authority has not furnished the information to the Appellant. As the appellant did not get the information from the Public Information Officers / 1st Appellate Authority even after 30 days of filing his 1st appeal, he preferred this 2nd appeal before this Commission u/s 19(3) of the RTI Act, 2005 requesting to take action against the PIOs and 1st Appellate Authority for not furnishing information sought by him and also to arrange to furnish the information sought by him. The Appeals was taken on file and the cases are posted for hearing over phone on 02-09-2020. On overview spread of COVID-19, the cases are heard over phone on 02-09-2020. C.No.3644, 3645, 3646,3647, 3648, 3666, 3667, 3668, 3669, 3674, 3675 3754, 3757, 3758, 3763, 3766, 3770, 3783, 3787, 3778, 3788, 3791, 3794 /SIC- KSR/2018 is one and the same, the Commission propose to dispose of all the twenty three appeals through this common order. The Appellant submitted that he did not receive the sought information from the Public Information Officers. A perusal of the 6(1) application goes to show that the appellant filed the 6(1) application before the Public Information Officer, O/o the ZPP, Nalgonda seeking information on twelve points. The information sought at Point Nos.11 and 12 relates to multiple Public Authorities/ Public Information Officers spread over seven years. The Public Information Officer O/o the ZPP, Nalgonda vide letter No. D5/3618/3950/2017/ZPP dated 21-11-2017 transferred the application U/s. 6(3) of the RTI Act, 2005 to all the concerned PIOs in the District. As the appellant did not receive the sought information from the Public Information Officer, he preferred the 1st appeal before the 1st Appellate Authority. The Appellant herein sought information related to 59 Mandals which have independent PIOs by making a single application to the Public Information Officer of Zilla Parishad, Nalgonda. The Public Information Officer/ZP, Nalgonda has transferred the application to the concerned PIOs with a direction to furnish the information to the applicant directly. Sec. 6(1) of the RTI Act, 2005 requires an Applicant who desires to obtain information to make an application to the concerned Public Authority indicating specifically the information required. According to Sec.7(9) information shall ordinarily be provided in the form in which it is sought unless it would disproportionately divert the resources of the public authority. Though undoubtedly, the reason for seeking the information is not required to be disclosed but when it is found that the process of the law is being abused, the same become relevant. Neither the authorities created under the RTI Act nor the courts are helpless if witness the provision of law being abused and owe a duty to immediately put a stop thereto. In this case it was observed that indiscriminate, impractical demand and umpteen number of applications under the RTI Act of disclosure of all and sundry information would be counterproductive as it will adversely affect the efficiency of the administration and result in the executive getting bogged down with non-productive work of collecting and furnishing information. Keeping in view the provisions of Sec.6 and Sec.7(9) of RTI Act, 2005. The Commission advised the Appellant to file RTI Application before the concerned Public Information Officer seeking specific information. This would facilitate furnishing of sought information within the stipulated time and avoid repeated correspondence. The Commission directed the Public Information Officers i.e., All MPDOs of Nalgonda, Suryapet and Yadadri DistrictTSIC to maintain the 4(1)(b) information and furnish the information to the appellant duly following the provisions of the RTI Act, 2005. The Public Information Officer/ZP, Nalgonda cannot pass on the burden to the all MPDOs and causing the administrative delays. Hence, the Commission directs the Public Information Officer/ZP Office, Nalgonda to obtain the information from all the MPDOs of Nalgonda and Yadadri District and furnish the available and held information to the appellant within two weeks from the date of receipt of this Common Order. With the above direction, the appeals are closed.
