MASSACHUSETTS TURNPIKE AUTHORITY Order of Taking No. B59 City of Boston County of Suffolk For the purpose of constructing , maintaining, repairing and operating as an express toll highway in accordance with the location approved by the state department of public works on April 12 , 1960, a road in the City of Boston, County of Suffolk, known as the 11 Boston Extension" of the Massachusetts Turnpike, and for the purpose of relo- eating public utilities, including rail lines in connec tion therewith, for the purpose of discontinuing a portion of a local public way (Hudson Street) and a portion of another local public way, (Oak Street), for the purpose of widening a portion of an existing local public way (Hudson Street) in connection therewith, and for the purpose of perform- ing such other work as may be deemed necessary in connection therewith, the Massachusetts Turnpike Authority, a body politic and corporate and a public instrumentality established by Chapter 354 of the Acts of 1952, does here~y take, under the provisions of Chapter 79 of the General Laws, Chapter 354 of the Acts of 1952, as amended, and Chapter 384 of the Acts of 1958, in its behalf and in behalf of the City of Boston .where feasible, all of the land within the limits of the taking hereby described, including all trees and structures (not, however, including poles, towers, lines, wires, cables and other appurtenances for the con­ veyance of electricity and for telephone communication) located thereon, situated in the City of Boston, County of Suffolk, a l~ of said land being taken in fee simple (with the exception of Parcel B59-TEl, herein­ after described, in which a temporary easement is taken), the supposed Boston Extension- Order of 'l'alcin [~ No . B59- City of Boston Page 2. owners thereof, shovm on a plan hereinafter referred to, being set forth in a schedule of awards hereinafter contained, excepting and re­ serving from the rights herein taken all easements, licenses and per­ mits for wires, pipes, conduits and other appurtenances for the convey­ ance of water, sewage , gas , electricity and other utilities and for telephone communication now lawfully in or upon said premises herepy taken, but with the provision that all said facilities shall be located under and/or in or attached to a bridge over the aforesaid express toll highway, or otherwise relocated as deemed necessary by the Massachusetts Turnpike Authority. The express toll highway taking is for a portion of the 11 Boston Extension" about 540 feet in length, extending between Curve Street to a point on Hudson Street northeasterly of Oak Street. The aforesaid express toll highway taking is more fully described as follows: The northerly location line of the express toll highway begins at a point on the westerly street line of Hudson Street, said point being southwesterly of and 121.36 feet distant from the junction of said westerly street line with the southerly street line of Oak Street, as shown on the plan hereinafter referred to; thence extends northeasterly across Hudson Street by a curve to the left of 1015.00 feet radius, 269.40 feet to a point in Hudson Street, as shown on said plan. The northwesterly taking line of said express toll highway begins at a point at the junction of the northerly street line of Curve Street with the westerly street line of Hudson Street, as shown on the plan hereinafter referred to; thence extends along said westerly street line in a northeasterly direction, 271 feet more or less to a point, said point may be further identified as the point of beginning of the northerly location line hereinbefore described, and all as shown on said plan. The southerly taking line for said express toll highway be~ips at a point at· the junction of the northerly street line of Curve Street with the i·Jesterly street line of Hudson Street, said point may be fur-' ther identified as the point of beginning of the northwesterly taking line hereinbefore described; thence extends generally easterly along said northerly street line by two courses and distances of 46 feet more or less, and 79 feet more or less, to a point, and all as shown on the plan hereinafter referred to. The easterly taking line for said express toll highway begins at a point on the northerly street line of Curve Street, said point being northeasterly of and 79 feet more or less distant from the junction of said northerly street line with the easterly street line of Hudson Street, as shown on the plan herelnafter referred to, said point may be further identified as the point at the end of the southerly taking line hereinbefore described; thence extends northwesterly 12 feet more or less to a point; thence extends northeasterly, 268 feet more or less to a point at the northeasterly extremity of Parcel B59-l4, Owners Unknown, a 3 foot wide passageway, designated on said plan; thence extends south­ easterly 5 feet more or less to a point; thence extends northeasterly 48 feet more or less to a point on the southerly street line of Oak Street; thence extends in the same general dlrection but more northerly, 41 feet more or less to a point on the northerly street line of Oak Street; thencE extends northwesterly along said northerly street line 62 feet more or less to a point at the junction of said northerly street line with the easterly street line of Hudson Street; thence extends north 16°-17'-01'' east, 104.15 feet to a point on said easterly street line; thence extends northwesterly across Hudson Street 4.56 feet to a point; said point may be further identified as the point at the end of the northerly location line hereinbefore described, and all as shown on said plan. Access to and egress from the aforesaid express toll highway is restricted, being allowed across the northwesterly, southerly, and easterly taking lines hereinbefore described, subject to payment of tolls and/or rules and regulations of the Massachusetts Tu~npike Authority Those portions of Hudson Street and Oak Street, local public ways, within the limits of the taking hereinbefore described shall be discontinued when, in the opinion of the Massachusetts Turnpike Authority, said portions of said streets are no longer needed or will be a hindrance to the construction, maintenance, repair and operation of said "Boston Extension". In connection with constructing, maintaining, repairing and operating the aforesaid express toll highway, it has been deemed neces~ sary by the Massachusetts Turnpike Authority that a portion of Hudson Street be relocated and widened as shown on the plan hereinafter referred to, said relocation being designated on said plan in an area marked "City Layout". For the purpose of widening and relocating said portion.of Hudson Street, for the purpose of furthering the accomplishment of the aforesaid, and for the purpose of performing such other work as may be deemed necessary in connection therewith, it is deemed necessary that a triangular strip of land on the westerly side of Hudson Street and the northerly side of Oak Street in the City·of Boston, County of Suffolk, be taken in fee simple and laid out in behalf of the City of Boston by the Massachusetts Turnpike Authority, consisting of ~arcels B59-Cl through B59-C3 inclusive. Said "City Layout"is more fully described as follows: "City Layout 11 begins at a point at the junction of the westerly street line of Hudson Street with the northerly street line of Oak Street, as shown on the plan hereinafter referred to; thence extends northwesterly along said northerly street line 34.30 feet to a point; thence turns and . extends northeasterly by a reverse curve to the left of 32.00 feet radius, 47 .;78 feet to a point; thence extends northeasterly by a curve to the left of 980.00 feet radius, 45.76 feet to a point on the westerly street line of Hudson Street; thence extends southwesterly along said westerly street . line 75.20 feet to the point of beginning, and all as shown on said plan. All lawful rights of the public and public utilities to use that portion of relocated and widened Hudson Street as hereinbefore de­ scribed are hereby established. '· ro / (Hudson Street' an-d ~ Oak Street) and for the purpose of performing other necessary work in ·connection therewith, and to resurface said ways, it has been deemed necessary to take a temporary easement 'in said local public way~. Said temporary easement is designated on the plan herein- after referred to as Parcel B59-TEl and is more fully described as follows: Temporary easement Parcel B59-TEl taking line begins at a point at the junction of the southerly atreet line of Oak Street with the west­ erly street line of Hudson Street, as shown on the plan hereinafter re­ ferred to; thence extends southwesterly along said westerly street line 121.36 feet to a point; thence turns and extends northeasterly by a curve to the left of 1015.00 feet radius, 165 feet more or less to a point in Hudson Street; thence extends northwesterly 100 feet more or less to a point on the northerly street line of Oak Street; thence extends south­ westerly across Oak Street 40 feet more or less to a point on the souther street line of Oak Street; thence extends southwesterly along said south­ erly street line 70 feet more or less to the point of beginning, and all as shown on said plan.
