Statutory Document No, SOg/06 n ROAD RACES ACT 1982 THE MANX GRAND PRIX RACES ORDER 2006 Coming into Operatton: 2 August 2006 In exercise of the powers conferred on the Depaftment of Transpott by Sections 1 and 2 of the Road Races Act 19821, and of all enabling powers, the following Order is hereby made: - Introductory 1. Citation and commencement This Order may be cited as the Manx Grand Prix Races Order 2006 and shall come into operation onthe 2 August 2006. 2. Interpretation (1) In this Order - "the Act" means the Road Races Act 1982; "the Clerk of the Course" means the individual so designated as Clerk of the Course by the promoter in the Official Programme of the 2006 Manx Grand Prix Races and includes any deputy or assistant Clerk of the Course so designated; "closure period" means any period during which an authorisation under Afticle 3 or 4 is in force in relation to the Course or any paft of the Course; references to a constable shall be construed in accordance with section 3 of the Act (appointment of marshals); "the Course" means the roads specified in Schedule 1; "the Depaftment" means the Depaftment of Transpoft; "postpone", in relation to a race, includes declaring void a race which has already begun; "the promoter" means the Manx Motorcycle Club Limited; "race" includes any parade held in connection with the race and any practice preliminary to the race; "the senior police officer" means a member of the Isle of Man Constabulary of the rank of sergeant or above who is authorised by the Chief Constable to act as senior police officer under this Order. 61986 Ltgïz c.14 21985 c.20 31995 c.21 41985 c.z3 5sI zoo2l3rr3 c.17 Price: LL.70 Price Code: B 1 (2) As respects any paft of the Course, a race or practice shall be treated as completed for the purposes of this Order when (and only when) an official motor vehicle displaying in prominent positions notices with the words "Roads Open" has passed along that paft of the Course in accordance with Article 13. Authorisation to use roads for races etc. 3. Authorisation of use of Course for practices (1) The promoter is authorised to use the Course for racing practices for motor-cycles at the times specified in Table 1 in Schedule 2. (2) The promoter may for any reason cancel such a practice, (3) Where the promoter cancels a practice under paragraph (2) and notifies the senior police officer of such cancellation the relevant authorisation under paragraph (1) of this paragraph shall cease to have effect. 4. Authorisation of use of Course for races (1) The promoter is authorised to use the Course for motor-cycle races at the times specified in Table 2 in Schedule 2. (2) The promoter may for any reason - (a) cancel such a race, or any race postponed under this paragraph, or (b) postpone such a race from a time specified in Table 2 or Table 3 in Schedule 2 to a later time specified in Table 2 or 3. (3) Where the promoter cancels or postpones a race under paragraph (2) and notifies the senior police officer of such cancellation or postponement - (a) the relevant authorisation under paragraph (1) or this paragraph shall cease to have effect so far as it relates to that race, and (b) in the case of a postponement under paragraph (2Xb), the promoter is instead authorised to use the Course for that race at the relevant time specified in Table 3 in Schedule 2. Regulation of traffrc etc. 5. Suspension of right of way etc. Subject to Atticles 7 and 8, during any closure period in relation to any part of the Course - (a) the right of way over it is suspended; and (b) no traffic may pass onto or over it. 6. Regulation of traffic on side roads Subject to Atticles 7 and 8, no person shall during any closure period without the permission of a constable - (a) go or remain on, 2 (b) drive any vehicle or cause or permit any vehicle to be driven on, (c) allow any vehicle to wait on, or (d) allow any animal to go on, any part of a road leading on to the Course within 150 metres of its junction with the Course, being a part indicated by barriers or signs in accordance with Article 14 as closed to traffìc, 7. Exemptions from AÉicles 5 and 6 (1) Articles 5(a) and 6(a) do not apply to the following persons - (a) the Clerk of the Course; (b) persons appointed by the Clerk of the Course as officials for the purpose of the practice or race in question; (c) constables; (d) persons lawfully taking part in the practice or race in question and their attendants; (e) the Governor, persons in attendance on him and members of his party; (0 media representatives and photographers approved by the promoter and bearing an official badge or armlet issued by the promoter; (g) persons driving or being carried in ambulances, medical vehicles, fire brigade vehicles, police vehicles, or highway maintenance vehicles in use for emergency purposes and authorised by the Clerk of the Course, and driving or being carried in highway maintenance vehicles authorised by the Clerk of the Course to travel between locations before the staft of any race or practice; (h) any other person authorised in writing by the Depaftment or the Chief Constable. (2) Articles 5(b) and 6(b) and (c) do not apply to the following vehicles - (a) vehicles for the conveyance of persons mentioned in paragraph (1)(a) or (e); (b) vehicles approved by the Clerk of the Course or the senior police officer for the conveyance of persons mentioned in paragraph (1)(b), (c), (f) or (g); (c) motor cycles engaged in the practice or race in question' 8. Temporary opening of Course to traffic (1) This Afticle has effect notwithstanding anything in Afticles 3 to 6. (2) If any practice or race is temporarily postponed or suspended during a closure period, the senior police officer may, with the consent of the Clerk of the Course, authorise traffic, in accordance with the directions of a constable, to cross or proceed along such part of the Course, and at such times, as that officer may specifli, (3) In any interval between practice or races during a closure period, the senior police officer may, with the consent of the Clerk of the Course - J (a) authorise pedestrians, in accordance with the directions of a constable, to cross or proceed along the Course at such places, and at such times, as that officer may specify; or (b) authorise vehicular traffic, in accordance with the directions of a constable, to cross or proceed along the Course at the places specified in Schedule 3, at such times as that officer may speciñ7. (4) Afticles 5 and 6 shall not have effect in relation to traffic crossing or proceeding along any pat of the Course pursuant to an authorisation under paragraph (2) or (3) and in accordance with the directions of a constable. (5) Nothing in paragraph (2) permits traffic to proceed in the reverse direction of the Course except with the express authorisation of the Clerk of the Course, (6) No person shall during a closure period drive any vehicle, or cause or permit any vehicle to be driven, on any part of the Course which is the subject of any authorisation under paragraph (2) or (3), otherwise than pursuant to that authorisation and in accordance with the directions of a constable. (7) The Road Traffic Regulation Act 19852, the Licensing and Registration of Vehicles Act 19853 and the Road Traffic Act 19854 apply to any part of the Course which is the subject of an authorisation under paragraph (2) or (3). 9. Footbridges (1) Nothing in Afticles 3 to 6 prevents a pedestrian crossing the Course by means of a footbrídge erected for the purpose, unless he is forbidden by a constable to do so. (2) No person shall during a closure period stop or loiter on any footbridge or footway referred to in paragraph (1). 10. Prohibited areas No person shall during a closure period enter or remain on any area of land specified in Schedule 4 and indicated by notices bearing the words "Prohibited Area". 11, Parking on ambulance access routes No person shall during a closure period without the permission of a constable cause a vehicle (other than an ambulance) to wait on a road specified in Schedule 5 within 100 metres of any barrier erected on that road in accordance with Article 14. Administration L2. Publicity for cancellation etc. (1) Where the senior police officer is notified of the cancellation of a practice or race under Afticle 3(3) or 4(3), he shall take such measures as he considers appropriate to inform the public of the effect of it. (2) The senior police officer shall take such measures as he considers appropriate to inform the public of - any authorisation under Afticle 8(2) or Afticle 8(3Xa). 4 (3) The Department shall cause public notice of any authorisation under Afticle 8(3)(b) to be grven - (a) in one or more newspapers published and circulating in the Island, and (b) on local radio stations. 13. Notification of end of closure (1) At the end of the practice or race for which an authorisation under Afticle 3 or 4 is in force - (a) the Clerk of the Course, or (b) the senior police officer after consulting the Clerk of the Course, shall arrange for one or more motor vehicles, marked as mentioned in Afticle2(2), to travel the Course departing from the top of Bray Hill, Douglas, and proceeding via Ballacraine to Ramsey and thence via the Snaefell Mountain road to the top of Bray Hill, Douglas.
