1.0 CURRICULUM VITAE 1.1 I am the Managing Director of The Hampden Consultancy (which is the trading name of THC Consulting Engineers Limited) since 1993. 1.2 I am a corporate member of the Institute of Healthcare Engineering and Estate Management (IHEEM) and am permitted to use the title ‘Engineering Technician’ under the registration with the Engineering Council. 1.3 I am also an Associate Member of the CIBSE and am registered on the UK Register of Expert Witnesses. 1.4 Before becoming the Managing Director of The Hampden Consultancy in 1993, I had been employed by several engineering services consultancies and main contractors over a period of twenty-five years, principally working on major construction projects located both in the Middle East and within the United Kingdom. 1.5 Throughout my professional career, I have had extensive involvement in the design and specification of mechanical engineering services on a wide range of major commercial and healthcare projects. 1.6 During this period my duties have included the preparation of contract documentation to be appended to the specifications & drawings prepared for specific projects, so as to provide a complete set of documentation for use by contractors in the preparation of their tenders. 1.7 My core discipline is mechanical engineering services, i.e. heating, mechanical ventilation (including specialised ventilation for healthcare premises), air-conditioning & chilled water services, domestic hot & cold water services, building management systems & automatic controls, as well as the specification & application of thermal insulation to pipework systems and the fire stopping of mechanical & electrical engineering services where they pass through the building structure. In addition, I have a working knowledge of electrical services and how the various engineering services interact and need to be co-ordinated with each other and with the building structure. 1.8 In addition, as part of my duties I was also responsible for overseeing the installation and commissioning of mechanical engineering services on many projects, including a number of major PFI healthcare projects, often acting in the capacity of Resident Site Engineer. 1.9 This involved undertaking interim and final ‘snagging’ inspections, witnessing testing and commissioning activities, as well as certifying the successful completion of mechanical engineering services installations prior to the issue of a Practical Completion Certificate and the subsequent rectification of any outstanding defects recorded at the time of Practical Completion. 1.10 Since starting The Hampden Consultancy, I have frequently been involved in the dispute resolution process, providing technical opinions and preparing expert reports on matters relating to mechanical & electrical engineering services in claims valued between £10,000 and £21 million. 1.11 As part of my duties I have provided advice to clients and/or their legal representatives in respect to the technical and/or contractual aspects related to mechanical & electrical engineering services including issues concerning the maintenance of such installations, looking objectively at a dispute from all perspectives and outlining the technical merits or otherwise of the particular claim, as well as dealing with issues relating to professional negligence by members of design and/or project management teams. 1.12 Indeed, in 90-95% of claims on which I have been appointed, these have settled in my clients’ favour following the issue of an expert report without the need for the parties to have further recourse to the legal process, be it litigation, arbitration or adjudication. 1.13 I have acted as a party-appointed expert in accordance with either the Civil Procedure Rules or the Criminal Procedure Rules and as such I have given oral evidence in court, both in the Technology & Construction Court and at arbitration and adjudication hearings across the UK, as well as attending mediation meetings on behalf of clients. 1.14 Where required, either as a result of an agreement between the parties in a dispute, or at the direction of a Court in accordance with the Civil Procedure Rules, I am also able to act as a Single Joint Expert. 1.15 Finally, I am a Council Member of BSRIA (Building Services Research & Information Association) and as such have been active on a number of technical committees, including currently: Heat Interface Unit Steering Group Heat Networks Design Guide Steering Group Differential Pressure Control Valve Steering Group Press-fit Carbon Steel Consultation Group Residential Ventilation Steering Group 1.16 In addition, being a member of BSRIA’s own Publications Panel, I am involved in the review, comment and approval for publication of all of BSRIA’s current standards relating to M&E engineering services and their design, application, installation, commissioning and maintenance. 1.17 Further Education: Southampton Technical College Southampton College of Technology Polytechnic of the South Bank, London 1.18 Professional Qualifications & memberships: City & Guilds H&V Technicians’ Certificate, Parts 1 & 2 Registered with the Engineering Council (Registration No.424690) Corporate member of the Institute of Healthcare Engineering & Estate Management (AMIHEEM) Affiliated member of the Chartered Institute of Building Services Engineers (CIBSE) Affiliated member of the Institute of Refrigeration (IOR) Affiliated member of the Commissioning Services Association (CSA) Council Member of the Building Services Research & Information Association (BSRIA) Member of the Association of Consultancy & Engineering (ACE) Member of the UK Register of Expert Witnesses (UKREW) 1.19 Courses Attended: ‘Working as a Single Joint Expert’ – Professional Solutions Learning & Development (2009) ‘Update to Part 35 of the Civil Procedures Rules’ – Bond Solon Training (2009) Writing Expert Reports (Introduction) Workshop – Professional Solutions Learning & Development (2010) Writing Expert Reports (Advanced) Workshop – Professional Solutions Learning & Development (2011) ‘Successful Communication at Experts Meetings’ – Professional Solutions Learning & Development (2014) ‘Preparing for Giving Oral Evidence in Court’ – Professional Solutions Learning & Development (2014) 1.20 Membership of Technical Committees: BSRIA Publications Panel BSRIA Heat Interface Unit Steering Group BSRIA Residential Ventilation Steering Group BSRIA / UKDEA Heat Networks Design Guide Steering Group BSRIA Press-fit Carbon Steel Consultation Group BSRIA Differential Pressure Control Valve Consultation Group 1.21 Publications: BG71/2017 – Building Services Reports (co-authored this publication) 1.22 Career History January 1993 - Current Date The Hampden Consultancy Following the completion of the Westminster & Chelsea Hospital project I left Laing Management Limited and formed a building engineering services consultancy specialising in dealing with ‘trouble-shooting’ and ‘problem- solving’ issues pertaining to mechanical & electrical engineering services on a wide range of commissions as indicated on the attached list. In addition, I have been heavily involved in the dispute resolution process, including preparing expert witness reports relating to claims involving mechanical & electrical engineering services, as well as professional negligence claims relating to M&E consulting engineers. Details of recent cases on which I have been involved between January 1993 and the current date have also been attached. March 1990 - December 1992 Laing Management Limited Appointed as the Building Services Manager & Design Co-ordinator for the Westminster and Chelsea Hospital Construction Project, being responsible for managing the co-ordination and installation of specialised engineering services, including medical and pathology gases, sprinkler installation, ultra-clean theatre suites, operating theatre pendants and service rails, cold rooms, hydrotherapy pool, maxillo-facial clinic, catering equipment installation and decorative water features. I also carried out a design co-ordination role, which involved liaising with the other members of the professional team, reviewing the designs and specifications for many of the engineering services works packages prior to tender and co-ordinating the flow of design information between the Design Team and the various engineering services works package contractors. March 1986 - February 1990 J. E. Greatorex & Partners Employed as a senior engineer in charge of a multi-discipline design section working primarily on healthcare projects, being involved in most cases from the initial conceptual design to the final account including the overall supervision of the M&E services installation. In addition, I carried out a number of feasibility studies, energy surveys and similar commissions that ultimately necessitated the preparation of detailed cost reports and/or technical studies. March 1974 - February 1986 Upton Associates Originally employed as an intermediate design engineer, I progressed to senior design engineer and eventually headed a design section involved with major projects, located both in the Middle East and the UK. During this time, I was responsible for the design and specification of the full range of mechanical pipework services on all projects. In addition, I was also involved in the design and specification of kitchen and laundry installations on many of the hospital projects.
