2016 World Cup of Hockey ACKNOWLEDGEMENT AND RELEASE (the “Release”) For good and valuable consideration, the receipt and adequacy of which are hereby acknowledged, the undersigned _____________________________ (please print full name of player, entertainer, spectator, participant, or other as applicable) (“Releasor”) (and if Releasor is younger than 18 years old, his/her parent or legal guardian both on behalf of said minor and for himself/herself) hereby voluntarily agrees as follows in connection with each one of the events and activities held in connection with the 2016 World Cup of Hockey international ice hockey tournament to be held at the Air Canada Centre, 40 Bay Street, Toronto, ON M5J 2X2, Canada (together with its surrounding parking lots, concourse and staging, including the area known as Maple Leaf Square, and the area designated as Fan Village located in, around and adjacent to the Distillery District in Toronto, ON, collectively, the “Venue”) from on or about September 9, 2016 through on or about October 5, 2016, (collectively, the “World Cup Events”), in which Releasor plays, performs, or otherwise participates: 1. RELEASE FROM LIABILITY AND COVENANT NOT TO in part by the fault or negligence of any Releasee in connection with such INSTITUTE LEGAL PROCEEDINGS. Releasor (and if Releasor is Releasee’s involvement with any World Cup Event. Without limiting the younger than 18 years old, his/her parent or legal guardian both on behalf of foregoing, Releasor (and if Releasor is younger than 18 years old, his/her said minor and for himself/herself) hereby irrevocably undertakes and agrees, parent or legal guardian both on behalf of said minor and for himself/herself), for himself/herself and his/her personal representatives, executors, on behalf of himself/herself and the Releasor Parties, covenants and agrees to liquidators, administrators, heirs, next of kin, successors, agents and assigns, waive any claim and not to institute legal proceedings against any Releasees and anyone else who might sue on Releasor’s behalf (collectively, “Releasor for any of the Liabilities that have been released and discharged herein. If Parties”), to release, waive, indemnify, hold harmless and discharge NHL Releasor’s participation requires hockey equipment or any other kind of WCH 16, L.P. (the “NHL”), NHLPA World Cup Limited Partnership (the equipment, Releasor agrees that he/she will bring with him/her, a complete “NHLPA” and collectively with the NHL, the “WCH Entities”), NHL WCH set of hockey equipment or such other equipment (as applicable), all meeting 16, Inc., NHLPA World Cup G.P. Inc., NHL WCH 16 US, LP, NHL WCH CSA or HECC standards (as applicable). RELEASOR ASSUMES RISK. Releasor (and if Releasor is younger and Dundee Realty Management Corp., each owner and operator of any than 18 years old, his/her parent or legal guardian both on behalf of said World Cup Event, arena or venue in which World Cup Events are held, each minor and for himself/herself) hereby acknowledges and declares that he/she sponsor, promoter and advertiser of any World Cup Event or any part of has been made aware of and understands the inherent risks and dangers them, each person or entity engaged by the WCH Entities, the National (direct or indirect) associated with the World Cup Events, including those Hockey League or any member team thereof, or any venue operator as an related to the sport of hockey, on-ice activities and attendance at sporting independent contractor or otherwise in connection with any World Cup events, and the potential for injury that exists when participating in such Event, the National Hockey League Players’ Association and each former World Cup Events (whether as a player, entertainer, spectator, participant or and current National Hockey League player, and each of their respective otherwise). Releasor (and if Releasor is younger than 18 years old, his/her parents, subsidiaries, stockholders, partners and other affiliates and related parent or legal guardian both on behalf of said minor and for himself/herself) persons or entities, and each officer, director, governor, regent, trustee, hereby agrees to assume all risk of and responsibility for personal injury or employee, volunteer, licensor, licensee, insurer, sponsor, partner, principal, death to, or damage to or loss of property of Releasor arising from, based representative and agent of each of the foregoing, and all of the foregoing’s upon or relating to Releasor’s participation (as a player, entertainer, spectator, respective successors and assigns (collectively, “Releasees”), from and participant or otherwise) in connection with any World Cup Event or caused, against any and all liabilities, losses (economic and non-economic), damages, in whole or in part, by Releasor’s fault or negligence.
