AGENDA ITEM 3 City of Bell Agenda Report DATE: March 28, 2018 TO: Mayor and Members of the City Council FROM: Allan Perdomo, Community Services Director APPROVED BY: ________________________________________ Howard Brown Jr., City Manager SUBJECT: Discuss the option of re-establishing the Community Services Commission RECOMMENDATION: It is recommended that the City Council discuss the option to re-establish the Community Services Commission (“Commission”). BACKGROUND It was requested by Mayor Gallardo for staff to search for ways on how the City can engage the youth to participate in the development of City events and, more importantly, to involve the youth in the policy decision making process that may affect them and their community. Since the City’s Commission is currently inactive, it is recommended that the Council consider re- establishing the Commission. Per Bell Municipal Code, the Commission requires that three out of the nine members be youth members in high school and in good academic standing. Each member of the Commission is given a term of four years. The objective of the Commission is to act as an advisory body to the City Council and perform the following duties: A. To make recommendations to the Council in all matters pertaining to parks, activities and public recreation, including playgrounds, parks, stables, bridle trails and beautification; B. Assist in the development of recreation in the City, stimulate public interest in recreational programs and cooperate with schools located in the City for summer recreation and swimming pool programs and all other agencies relating to securing and developing an adequate recreational program; C. Assist in the acquisition, development and maintenance of park and recreation facilities in the City; D. Assist and plan a program for roadside and park landscaping and beautification including the design and location of signs and fences and the dissemination of information concerning beautification including the design and location of signs and fences and the dissemination of information concerning beautification in the City; and Page 500 E. Exercise such other powers and duties as may be assigned by order of the City Council. At the City Council meeting of Wednesday, January 24, 2018, The City Council directed staff to do the following: • Compare the fiscal impact of a monthly vs quarterly meeting schedule. • Provide a copy of the ordinance related to the Community Services Commission. • Provide a snapchat of how the commission would operate and function. DISCUSSION: The chart below compares the current and the proposed Commission membership and term limits by the Community Services Department (CSD). The Administrative Specialist will be the secretary for the Community Services Commission and the Community Services Director will attend all the meetings to present to the commission and answer questions. If the Council decides to move forward and re-establish the Commission, staff will bring an ordinance before the end of the current Fiscal Year to establish the membership, meeting schedule, and duties of the Commission, as well as the Community Services Commissioners terms of office and qualifications. Ordinance No. 1127 Page 501 ORDINANCE NO. 1127 AN ORDINANCE OF THE CITY OF BELL, CALIFORNIA, REVISING, AMENDING AND REPEALING CERTAIN DESIGNATED SECTIONS OF THE BELL MUNICIPAL CODE. THE CITY COUNCIL OF THE CITY OF BELL DOES ORDAIN AS FOLLOWS: 1. Section Section 1100 of the Bell Municipal Code is hereby amended to read as follows: 1100. VIOLATIONS ARE A MISDEMEANOR. No person shall violate any provision, or fail to comply with any of the requirements, of this Code. Any person violating any of the provisions or failing to comply with any of the mandatory requirements of this Code, shall be guilty of a misdemeanor except for those provisions of this Code the violation of which is expressly declared to be an infraction. Any person convicted of a misdemeanor for a violation of any provision of this Code, shall be punishable by a fine of not more than One Thousand Dollars ($1000.00), or by imprisonment in the City or County Jail for a period not exceeding six (6) months, or by both such fine and imprisonment. Each such person shall be guilty of a separate offense for each and every day during which such violation continues. In addition to the penalties herein above provided, any condition caused or permitted to exist in violation of any of the provisions of this Code shall be deemed a public nuisance and may be summarily abated, as such,,in any manner prescribed by law, by the City Attorney, upon direction of the Chief Administrative Officer. 1. Section Section 1102(a) of the Bell Municipal Code is hereby amended to read as follows: Ordinance No. 1127 First Reading October 20, 1997 Second Reading November 17 Page I Page 502 1102. CITATION PROCEDURE. (a) Any officer arresting any person for a violation of any provision of this Code, who does not immediately take such arrested person before a magistrate, as prescribed in the Penal Code of the State of California, shall prepare a written Notice to Appear in Court. The Notice shall contain: (I) the name and address of the person arrested; (2) the offense charged, the time and place of such alleged violation; and (3) where and when such arrested person shall appear in Court. The time specified in the Notice to Appear must be at least ten (10) days after such arrest. The place specified in the Notice to Appear, and said Notice, shall be in conformity with all applicable provisions of the Penal Code of the State of California. (b) The arresting officer shall deliver one ( 1) copy of the Notice to Appear to the alleged violator; the alleged violator, in order to secure his immediate release, must give his written promise to so appear in Court at the time and place indicated thereon, by signing the duplicate Notice which shall be retained by the officer. Thereafter, the arresting officer shall forth­ with release from custody the person so arrested. The duplicate copy of the Notice to Appear shall be filed in the manner prescribed in said Penal Code of the State of California. (c) The word "officer" and phrase "arresting officer" as used in subsections (a) and (b) of this Section 1102, shall mean any sworn peace officer of the City of Bell and any employee of the City of Bell who is designated by resolution of the City Council as being authorized to issue citations pursuant to the provisions of this code. 1. Section Section 2001 of the Bell Municipal Code is hereby amended to read as follows: Ordinance No. 1127 First Reading October 20, 1997 Second Reading November 17 Page2 Page 503 2001. COUNCIL REORGANIZATION. The· Council shall reorganize and select one of its number as Mayor, and one as Mayor Pro Tempore, on the following occasions: (a) In odd numbered years, when designated by applicable provisions of the Government Code at the time the City Council certifies the results of the Municipal election and (b) In even numbered years at the second regular meeting held during the month of March; or (c) At such other times as a majority of the Council shall so order. 1. Section Sections 2430 through 2433 of the Bell Municipal Code are hereby amended to read as follows: 2430. COMMUNITY SERVICES COMMISSION ESTABLISHED. The Community Services Commission of the City is hereby created. 2431. MEMBERSHIP. The Community Services Commission shall consist of nine (9) members, three (3) of whom shall be youth members. The Community Services Commission shall hold monthly meetings at a time and address set by the Community services Commission. The youth members shall be high school students in good standing. 2432. TERM. Each member of the Community Services Commis­ sion, except as provided in Part A hereof, shall serve terms of four (4) years each. 2433. DUTIES. The Community Services Commission shall perform the following duties: (a) act in an advisory capacity to the City Council in all matters pertaining to parks, activities and public recreation, including playgrounds, parks, stables, bridle trails and beautification; (b) assist in the development of recreation in the City, stimulate public interest in recreational programs and cooperate with Ordinance No. 1127 First Reading October 20, 1997 Second Reading November 17 Page 3 Page 504 schools located in the City for summer recreation and swimming pool programs and all other agencies relating to securing and developing an adequate recreational program; ( c) assist in the acquisition, development and maintenance of park and recreation facilities in the City; (d) assist and plan a program for roadside and park landscaping and beautification including the design and location of signs and fences and the dissemination of information concerning beautification in the City; (e) exercise such other powers and duties as may be assigned by order of the City Council. 1. Section Sections 2445.8 and 2445.9 of the Bell Municipal Code are hereby amended to read as follows: 2445.8 APPEAL PROCEDURE. Decisions of the Board on applications shall be final and conclusive as of the date the Board adopts the same unless, within a period of not to exceed ten (I 0) consecutive calendar days thereafter, a written appeal is filed, by an interested person, with the City Clerk appealing the decision of the Board to the.
