The Land Description contained in Section 1 defines the extent of reserve land that will be subject to the land code of the ‘Namgis First Nation and is not intended to prejudice any of this First Nation’s claim(s) to lands. This Land Description is based on a review of documents recorded in the Indian Lands Registry in concert with other documents from various sources relating to the extent of title to the reserve land; it does not represent a legal interpretation of those documents. Should there be differing interpretations; legal assistance might be required to determine the definitive nature of the interests in land. The content of this Land Description is based on the documents reviewed; however, no guarantee should be implied that would preclude the existence of other documents not discovered during the course of this research that might also affect the extent of title to the reserve land. Reserve Lands within the Province of British Columbia, Canada in Rupert District, more particularly described as: All of Alert Bay Indian Reserve No. 1A bounded by the rectilinear and natural boundaries as shown on Plan BC134 recorded in the Canada Lands Surveys Records (CLSR) with the east rectilinear boundary shown updated on Plan 52523 CLSR. Save and except all of Lot 2 Plan 59964 CLSR (except for that portion of said Lot 2 as shown on Plan 72103 CLSR). Total Lands by admeasurement containing 168 hectares (415 acres), more or less. The above described Reserve Lands are subject to: The rights and reservations contained in Provincial Order in Council 1938-1036, registered in the Indian Lands Registry as No 8042, transferring the land from the Province of British Columbia to Canada, as amended by Provincial Order in Council 1969-1555, registered in the Indian Lands Registry as No 4111-118. Notes 1. Third party interests are not addressed in this Land Description. 2. The Administrative Sketch in Section 2 illustrates this Land Description. 3. Refer to the official survey plans and legal documents for the definitive boundary definition and the nature of the interests in the reserve land. 4. This Land Description does not deal with the extent of Oil and Gas Rights. 5. Mines and minerals are managed according to the British Columbia Indian Reserves Mineral Resources Act 1943-44 c.19. 6. The natural boundary of Cormorant Channel and Alert Bay (Pacific Ocean) forms the natural boundary of the Reserve.
