(No Work Session): Present: Commissioners Barrera, Cirillo, Guzman, Yanez and Mayor Rodriguez Absent: None Also Present: Deputy Clerk Adelinny Plaza, Town Administrator Jonathan Castaneda, and Corporation Counsel Michael Jimenez Meeting commenced at 6:31 P.M. Deputy Clerk Plaza made the following announcement: As presiding officer of this Regular Meeting of the Board of Commissioners of the Town of West New York, held on September 2, 2020 6:30 P.M (No Work Session), I do hereby publicly announce, and I direct that this announcement shall be placed in the minutes of this meeting, and that the Notice requirements provided for in the “Open Public Meetings Act” have been satisfied. Notice of this meeting was properly given by the Board of Commissioners in the Resolution dated and adopted on December 18, 2019. Said Resolution was transmitted by the Town Clerk to the Jersey Journal and the Bergen Record and publicly posted on the Municipal Bulletin Board, Town Hall, and filed with the Town Clerk. Notice of this meeting by the August 27, 2020 Sunshine Notice has been sent to each of the newspapers circulating in the Town of West New York (The Jersey Journal and the Bergen Record), and has been posted on the municipal bulletin board in Town Hall and Town Website. Copies are available to the public in accordance with the law. Note: Minutes were taken and transcribed by Deputy Adelinny Plaza. Minutes of Previous Meeting: It was regularly moved by Commissioner Guzman, seconded by Commissioner Cirillo that the Minutes of Regular Meeting: 7/22/2020 (Regular Session) and 8/12/2020 (Regular Session) be approved as recorded, was carried by the following vote: AYES - Commissioners Barrera, Cirillo, Guzman, Yanez, and Mayor Rodriguez NAYS - None ABSENT - None Claims: Dated 9/2/2020 Claims are available for public inspection in the Town Clerk’s Office): It was regularly moved by Commissioner Guzman, seconded by Mayor Rodriguez that the claims be approved, was carried by the following vote: AYES - Commissioners Barrera, Cirillo, Guzman, Yanez, and Mayor Rodriguez NAYS - None ABSENT - None Note: Mayor Rodriguez and Commissioner Yanez abstained on purchase order number 25733 and Commissioner Cirillo abstained on purchase order number 25596. September 2, 2020 Regular Meeting Consent Agenda: It was regularly moved by Commissioner Guzman, seconded by Commissioner Barrera that the following Consent Agenda Items Nos. R20-275 through R20-294 be adopted, was carried by the following vote: AYES - Commissioners Barrera, Cirillo, Guzman, Yanez, and Mayor Rodriguez NAYS - None ABSENT - None Note: Deputy Clerk Plaza announced that the consent agenda would include items #R20-275 through #R20-294. All agreed. RESOLUTION #R20-275 RE: REPEALING RESOLUTION ADOPTED ON 3/16/2016 RESTRICTED PARKING FOR HANDICAPPED RESIDENT AT 5206 BERGENLINE AVE, WEST NEW YORK (SARA FERREIRO) WHEREAS, the governing body of the Town of West New York adopted a Resolution on October 19, 2011 establishing restricted parking for use by a handicapped resident; and WHEREAS, the handicapped person involved has either died or moved since the implementation of the above-mentioned resolution; NOW, THEREFORE BE IT RESOLVED by the Mayor and Board of Commissioners of the Town of West New York that the above resolution is hereby repealed: 5206 Bergenline Ave, West New York (Sara Ferreiro) BE IT FURTHER RESOLVED that the Department of Public Safety is directed to remove all signage for the spaces as directed by this resolution. BE IT FURTHER RESOLVED that this resolution shall take effect immediately upon passage. September 2, 2020 Regular Meeting Consent Agenda (Cont.): Resolution (Cont.): RESOLUTION #R20-276 RE: REPEALING RESOLUTION ADOPTED ON 3/23/2017 RESTRICTED PARKING FOR HANDICAPPED RESIDENT AT 9-62ND ST, WEST NEW YORK (DOROTHY STAHL) WHEREAS, the governing body of the Town of West New York adopted a Resolution on October 19, 2011 establishing restricted parking for use by a handicapped resident; and WHEREAS, the handicapped person involved has either died or moved since the implementation of the above-mentioned resolution; NOW, THEREFORE BE IT RESOLVED by the Mayor and Board of Commissioners of the Town of West New York that the above resolution is hereby repealed: 9-62nd Street, West New York (Dorothy Stahl) BE IT FURTHER RESOLVED that the Department of Public Safety is directed to remove all signage for the spaces as directed by this resolution. BE IT FURTHER RESOLVED that this resolution shall take effect immediately upon passage. RESOLUTION #R20-277 RE: APPROVING OF AND ENDORSING HUDSON COUNTY’S APPLICATION TO THE NEW JERSEY DEPARTMENT OF TRANSPORTATION’S FY 2021 NJDOT BIKEWAYS GRANT TO FUND WHEREAS; Hudson County has applied to the New Jersey Department of Transportation’s FY 2021 NJDOT Bikeways Grant to fund a bicycle infrastructure upgrade on River Road (County Road - 505) between Anthony Defino Way/Port Imperial Blvd and Bulls Ferry Road in the Town of West New York (“the Town”), Guttenberg and North Bergen (“Hudson County NJDOT Bikeway’s Grant Application”); and WHEREAS, if fulfilled, this project would separate the existing bike lanes (bikeway) from motor vehicle traffic through a barrier or a buffer; and WHEREAS, the intent is to upgrade the existing narrow bike lanes and sharrow markings to a protected or buffered bike lane using endurablend pavement surface coating, with little impact to existing travel lanes; and WHEREAS, if awarded, the Hudson County Freeholder’s Board requires a support letter from each municipality to accept said funds. WHEREAS, it is in the best interests of the Town that the Hudson County NJDOT Bikeway’s Grant Application be approved; and WHEREAS, if approved, the Town would accept such portions of the grant funds as may pertain to it; September 2, 2020 Regular Meeting Consent Agenda (Cont.): Resolution (Cont.): NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Commissioners of the Town of West New York, County of Hudson, State of New Jersey as follows: 1. The aforesaid recitals are incorporated herein as fully set forth at length. 2. The Board of Commissioners does hereby approve of and endorse the Hudson County NJDOT Bikeway’s Grant Application. 3. The Mayor, the Municipal Administrator, and any other necessary official, officer or employee of the Town of West New York, be and they are hereby authorized to execute any and all documents and to take any and all actions necessary to complete and realize the intent and purpose of this Resolution including but not limited to issuing a support/endorsement letter and accepting any funds granted that may pertain to the Town as a result of the approval of the Hudson County NJDOT Bikeway’s Grant Application. RESOLUTION #R20-278 RE: TO AUTHORIZE AWARD OF CONTRACT TO VANORE ELECTRIC, INC. FOR PURCHASE OF ELECTRICIAN SERVICES RELATED TO INSTALLATION OF ODOROX UNITS WHEREAS, there exists in the Town of West New York (“Town”) a need for the services of a company that provides electrician services related to the installation of new outlets for the Odorox units to better meet and respond to the circumstances created by the COVID-19 Pandemic; and WHEREAS, Vanore Electric, Inc., with offices located at 375 North St # Q, Teterboro, NJ 07608, has been awarded a contract for electrician services by the Bergen County Cooperative Pricing System #11BECCP, Registered Bergen County Cooperative Contract Purchasing System, #CK04 (“Bergen County Coop System) by way of resolution # #553-19(Contract Bid # 19-21) for a term May 15, 2020 through May 14, 2021; and WHEREAS, pursuant to N.J.S.A. 40A:11-11, the Town may, without bidding, purchase goods and services through authorized cooperative pricing systems (“Co-Op”); and WHEREAS, the procurement of goods and services through a cooperative purchasing program is considered to be an open and fair process under the New Jersey Pay-to-Play Law N.J.S.A. 19:44A-20.4 et. seq.; and WHEREAS, the Bergen County Coop System has established a State Approved Co-Op; and WHEREAS, the Town is a member of the Bergen County Coop System Co-Op; and WHEREAS, the Division of Local Government Services has issued LFN 2020-06, confirming that pursuant to N.J.S.A. 19:44A-20.12, emergency contracts awarded for purposes of COVID-19 response are excepted from Pay-to-Play regulations also exempt from public bidding requirements due to public exigency, and that such contract may be awarded as emergency contracts under N.J.S.A. 40A:11-6; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Commissioners of the Town of West New York, County of Hudson, State of New Jersey, does hereby authorize the Mayor, the Municipal Administrator and Temporary Purchasing Agent to purchase electrician services from Vanore Electric, Inc. located at 375 North St # Q, Teterboro, NJ 07608, pursuant to Bergen County Coop System Contract Bid # 19-21, as may be needed by the Town, in an amount not to exceed $30,000.00, for the installation of Odorox units, through May 14, 2021. September 2, 2020 Regular Meeting Consent Agenda (Cont.): Resolution (Cont.): BE IT FURTHER RESOLVED, that the Mayor, Municipal Administrator, and Temporary Purchasing Agent are hereby authorized to execute a contract or purchase orders with Vanore Electric, Inc., of 375 North St # Q, Teterboro, NJ 07608, for the purchase of Electrician services and services in an amount not to exceed $30,000.00, in accord with Bergen County Coop System Contract Bid # 19-21, as may be needed by the Town.
