The 1884 Land Act divided NSW into three regions, each with its own administrative districts, and each supervised by a local Land Board. Mary Turner Shaw in Yancannia Creek (Melbourne University Press 1987), explains how the system affected the Western Region. The current leases of the vast Pastoral Holdings of the squatters had to be surrendered and divided into two equal portions. 1) One portion reverted to the squatter as a Pastoral Leasehold guaranteed against selection during the currency of his lease, which in the Western Division was 15 years. The rents, appraised for the first 5 years by the local Land Boards, were to increase automatically at 5 year intervals (first by a quarter, then by a half), after which the leasehold could be auctioned by the government without compensation. 2) The other half, the Resumed Area, in the Western Region, where the country was now recognized as unsuitable for small selections for agriculture, was offered as Homestead Leases to a maximum of 10,240 acres (16 square miles). The Homestead Lessees had to pay for a survey of the land applied for as a Homestead Lease, pay an annual fee as set down by the Board, enclose the property with the strictly prescribed standard of fencing, and live on their land for at least six months of the year. These conditions were strictly monitored by inspection and any failure to confirm to these conditions could result in forfeiture of the lease. RUSHEEN CRAIG July 2012.
