REPUBLIC OF THE PHILIPPINES SANGGUNIANG PANLUNGSOD GENERAL SANTOS CITY SPPR NO. ___________ Series of 2017 RESOLUTION INTENSIFYING THE IMPLEMENTATION OF MARTIAL LAW IN MINDANAO ------------------------------------------------------------------------------------------------ ------------------ Hon. Jose Edmar J. Yumang – Author/Sponsor -------------------------------------------------------------------------------------------------- ----------------- WHEREAS, Proclamation 55, Series of 2016 was issued on September 4, 2016 declaring a state of national emergency on account of lawless violence in Mindanao; WHEREAS, Section 18, Article VII of the Constitution provides that “In case of invasion or rebellion, when the public safety requires it, he (the President) may, for a period not exceeding sixty days, suspend the privilege of the writ of habeas corpus or place the Philippines or any part thereof under martial law.”; WHEREAS, last May 23, 2017, President Rodrigo Duterte issued Proclamation No. 216, “Declaring a State of Martial Law and Suspending the Privilege of the Writ of Habeas Corpus in the Whole of Mindanao,” shortly after Marawi City was under siege by the Maute Group; WHEREAS, on July 4, 2017, the 43rd day of the imposition of martial law in Mindanao, the Supreme Court upheld the constitutionality of President Rodrigo Duterte’s martial law declaration in Mindanao voting 11-3-1 with 11 justices voting to dismiss the petition questioning the legality of the proclamation, 3 partially granting the petition, and 1 granted the petition; WHEREAS, Voting 240-27, the 17th Congress on December 13, 2017, approved the request of President Rodrigo Duterte to extend the imposition of martial law in Mindanao by a year, or until the end of 2018 in order to combat and defeat terrorism and to prevent its spread in other parts of the country, to protect the people and pursue the task of rehabilitation in the affected areas; WHEREAS, the Sanggunian is in support in the intensification of the implementation of Martial Law in Mindanao in order to maintain peace and order and prevent any lawless violence in any part thereof; NOW, THEREFORE, on motion of City Councilor Jose Edmar J. Yumang, duly seconded by City Councilor _________________, be it – RESOLVED, as it is hereby resolved, a resolution intensifying the implementation of Martial Law in Mindanao.
