
MINISTRY OF INFRASTRUCTURE OF UKRAINE ORDER 04.09.2013 Kyiv N 662 Registered with the Ministry of Justice of Ukraine 12 September 2013, N 1575/24107 On Approval of the List of Compulsory Pilotage Areas and Categories of Vessels exempted from Compulsory Pilotage As amended by the Orders of the Ministry of Infrastructure of Ukraine of 27 February 2015, N 80, of 29 July2015, N 291 Pursuant to Article 94 of the Merchant Shipping Code of Ukraine, sub-paragraphs 4.9.17, 4.9.74 of sub-paragraph 4.9 of paragraph 4 of the Regulation on the Ministry of Infrastructure of Ukraine approved by Decree of the President of Ukraine N 581 of 12 May 2011, in order to improve the safety of navigation IT IS ORDERED: 1. To approve the List of Compulsory Pilotage Areas and Categories of Vessels exempted from Compulsory Pilotage as attached. 2. The Department of State Policy for Maritime and Inland Water Transport to ensure the submission of this Order to the Ministry of Justice of Ukraine for state registration in accordance with the established procedure. 3. This Order shall come into force after its official publication. 4. Deputy Minister D.V. Demydovych to be charged with monitoring the execution of this Order. Minister V. Kozak APPROVED BY 1 Order of the Ministry of Infrastructure of Ukraine 04.09.2013, N 662 Registered with the Ministry of Justice of Ukraine List 12 September 2013, N 1575/24107 of Compulsory Pilotage Areas and Categories of Vessels exempted from Compulsory Pilotage 1. This List was determined in accordance with Article 94 of the Merchant Shipping Code of Ukraine and shall be binding on the companies that provide pilot services, sea port masters, within the waters of which the pilotage is performed, and shipowners whose vessels navigate in the areas of compulsory pilotage. 2. The terms used in this List shall have the following meanings: vessel length - maximum length of the vessel specified in vessel documents; vessel - any self-propelled watercraft in the surface condition, warships (boats) and support vessels; local-based vessel - a vessel performing regular navigation in the waters of the relevant sea port (dredging fleet vessel operating in the waters and/or in channel, tugs, fishing vessels entering the ports without cargo operations, etc.), including cases where the specified vessel goes beyond its water area and returns to the same sea port, unless the duration of vessel's one-time stay outside the waters of relevant sea port exceeds 72 hours. 3. Areas of internal waters and territorial sea of Ukraine, within which vessel pilotage is compulsory: 1) area of the Danube River from reception buoy of sea approach channel of Bystre estuary to Reni sea port; The receipt and dropping of a pilot shall be performed in the following locations: near receiving buoy of sea approach channel of Bystre estuary (latitude 45°18,6' N; longitude 029°49,3' E); in the sea ports of Izmail, Reni , Ust-Dunaisk and at their roadsteads; in port stations of Vylkovo, Kiliia and at their roadsteads; near 116th km (Izmail Chatal Cape). 2 Changing the pilot in the waters of the sea port of Izmail (receipt and dropping of pilot) shall be made at 96th km when navigating up the Danube river and at 87th km when navigating down the Danube river; 2) area of the sea port of Bilhorod-Dnistrovskyi with Dniester Estuary - within the waters of Bilhorod-Dnistrovskyi sea port. The receipt and dropping of pilots is performed at the reception buoy N 1 (latitude 46°04,6' N; longitude 030°30,4' E); 3) area of Yuzhnyi sea port (for vessels going to/from Yuzhnyi sea port) - from pilot receipt point or from port anchorages to port gate and internal port waters within Adzhalyk Estuary, and in the opposite direction to the pilot dropping point or to port anchorages. The receipt and dropping of a pilot shall be performed at the points with the following coordinates: receipt point - latitude 46°31'48'' N; longitude 030°57'00'' E; dropping point - latitude 46°32'20'' N; longitude 030°55'52'' E; (paragraph 3 supplemented by new sub-paragraph 3 according to the Order of the Ministry of Infrastructure of Ukraine of 29.07.2015, N 291 ) 4) area of Skadovsk sea port - within its water area. The receipt and dropping of pilots shall be performed in the following locations: for vessels arriving in Skadovsk sea port and leave it, - in the area of Skadovsk approach midchannel light buoy (latitude 46°04,6' N; longitude 032°54,2' E), during ice campaign - in the area of Dzharylhach at the point with the following coordinates: latitude 46°00,0' N; longitude 033°04,3' E; for vessels arriving in Khorly port station and leaving it, - in the area of Khorly light buoy N 1 (latitude 46°01,6' N; longitude 033°13,1' E); 5) area of Yevpatoria sea port and Donuzlav lake - within the waters of Yevpatoria sea port. The receipt and dropping of a pilot shall be performed in the following locations: when approaching Yevpatoria sea port - at a distance of 5 cable length and in sector 100° - 200° from the luminous sign of berth N 2 or in the area of anchorage N 382, while the pilotage to the south from the line that passes along bearing 60° from the luminous sign of berth N 2 to the shoreline is extra-port, and to the north is intra-port; when approaching Donuzlav lake - 2 cable length southeast from Donuzlav midchannel buoy or in the areas of anchorages N 378 and N 381; 3 {The effect of subparagraph of paragraph 3 is suspended for the effect period of the Resolution of the Cabinet of Ministers of Ukraine dated 30 April 2014 No. 578-p "Some Issues concerning Functioning of Sea and River Transport" according to the Order of the Ministry of Infrastructure No. 80 of 27.02.2015} 6) area of Yalta sea port - within its water area. The receipt and dropping of a pilot shall be performed at the point with the following coordinates: latitude 44°27,69' N; longitude 034° 10,71' E; {The effect of subparagraph of paragraph 6 is suspended for the effect period of the Resolution of the Cabinet of Ministers of Ukraine dated 30 April 2014 No. 578-p "Some Issues concerning Functioning of Sea and River Transport" according to the Order of the Ministry of Infrastructure No. 80 of 27.02.2015} 7) area of Berdiansk sea port - within its water area. The receipt and dropping of a pilot shall be performed in the following locations: for vessels arriving in Berdiansk sea port and leaving it: with a draught of 6.0 m and more - in the area of buoy N 2 (latitude 46°36,7' N; longitude 036°36,0' E) on the left side of port approach channel; with a draught of up to 6.0 m - in the area of buoy N 10 (latitude 46°40,0' N; longitude 036°40,1' E) on the left side of port approach channel; for vessels arriving in Henichesk port station and leaving it - at the point with the following coordinates: latitude 46°09,8' N; longitude 034°52,5' E, or at anchorage at the point with the following coordinates: latitude 46°09,6' N; longitude 034°53,6' E; 8) other areas of compulsory pilotage determined by the relevant Rules of navigation duly approved by the Ministry of Infrastructure of Ukraine. 4. In areas of compulsory pilotage, the vessels that do not belong to the categories of vessels exempted from compulsory pilotage, shall not be allowed to navigate without a pilot. 5. The following categories of vessels shall be exempted from compulsory pilotage in the areas specified in sub-paragraphs 1-8 of paragraph 3 of the List: (the first sub-paragraph of paragraph 5 was amended in accordance with the Order of the Ministry of Infrastructure of Ukraine dated 29.07.2015 N 291) hydrographic (pilot) vessels of the State Institution "State Hydrographic Service of Ukraine"; 4 vessels of the Armed Forces of Ukraine, Maritime Guard of the State Border Guard Service of Ukraine, Security Service of Ukraine, Ministry of Internal Affairs of Ukraine, State Emergency Service of Ukraine; local-based vessels, yachts and vessels with a gross tonnage of 500 units and less; vehicles identified in the relevant Rules of navigation duly approved by the Ministry of Infrastructure of Ukraine, as being exempted from compulsory pilotage and (or) not subject to compulsory pilotage. In the area referred to in sub-paragraph 1 of paragraph 3 of this List, except the section from receiving buoy of the sea approach channel of Bystre estuary to 20th km of the Danube River the mixed river-sea-going vessels and other vessels with a length of 100 m and less and with actual maximum draught of 3.0 m and less shall be exempted from compulsory pilotage. (paragraph 5 supplemented by new sub-paragraph 6 according to the Order of the Ministry of Infrastructure of Ukraine of 29.07.2015, N 291 ) For navigation in areas of compulsory pilotage referred to in sub-paragraphs 1- 8 of paragraph 3 of this List, the vessels shall have manuals for navigation, compulsory resolutions of the relevant ports, maps and plans for the particular area and appropriate navigation equipment on board. Masters of vessels determined by this paragraph shall have the right to use the services of a pilot by filing a request in the prescribed manner to the company providing pilotage services.
