RECOMMENDATION: Approve resolution. BACKGROUND: The City contracts with the Tampa Downtown Partnership on an annual basis to oversee and administer the activities within the legal boundaries of the Downtown District (Exhibit A) for the purpose of providing certain enhanced services in said area including, but not limited to, marketing and business development, safety, maintenance, transportation and planning, beautification and urban design. On August 25, 2016, a public hearing is scheduled to consider the adoption of the 2016 (FY2017) non- ad valorem assessment within the Downtown District of the City of Tampa. Services provided under this agreement are to be funded through the annual levy of a non-ad valorem assessment in accordance with the Downtown Budget (Exhibit C). Exhibit "B" of the FY2017 Downtown Special Assessment Services Agreement provides a complete description of the services and activities to be performed in Downtown and overseen by the Tampa Downtown Partnership. FISCAL IMPACT: Yes FISCAL IMPACT STATEMENT: The Downtown Special Assessment Services Agreement has no financial impact to the City's General Fund. The annual service agreement budget amount is estimated to equal the annual non-ad valorem assessment revenue amount net of early payment discounts, County fees, and City of Tampa’s cost allocation. WHEREAS, pursuant to the authority granted to it under its home rule powers, the City of Tampa (the “City”) desires to provide certain improvements and services for the Downtown Area, as more particularly described in the attached agreement; and WHEREAS, through public meetings and mailings conducted by the Tampa Downtown Partnership, Inc., it has be ascertained that the property owners within the Downtown Area desire to have such improvements and services provided; and WHEREAS, the Downtown Area Non-Ad Valorem Assessment (the “Assessment”), which was approved pursuant to Resolution 2016- , adopted by the City Council on August 25, 2016, was levied to provide funding for such improvements and services; and WHEREAS, the Tampa Downtown Partnership, Inc. has presented evidence to the City that each property in the Downtown Area shall be specially benefited by the provision of such improvements and services, and the Assessment will be assessed upon each such property in reasonable proportion to the benefits to be derived therefrom; and WHEREAS, the Tampa Downtown Partnership, Inc. is willing and able to provide such improvements and services on the terms and conditions set forth in the attached agreement; and WHEREAS, the City believes the Tampa Downtown Partnership, Inc. can provide such improvements and services on the terms and conditions set forth in the attached agreement; and WHEREAS, the City believes the Tampa Downtown Partnership, Inc. can provide such improvements and services efficiently and effectively; and WHEREAS, the activities of the Tampa Downtown Partnership, Inc. will advance an important public purpose. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMPA, FLORIDA: Section 1. The Downtown Area Special Assessment Services Agreement between the City and the Tampa Downtown Partnership, Inc., in substantially the form attached hereto and by reference made part hereof, is hereby approved in its entirety. Section 2. The Mayor of the City is hereby authorized and empowered to execute, and the City Clerk of the City to attest and affix the official seal of the City to, said Agreement for and on behalf of the City. Section 3. The Downtown Area Special Assessment Services Agreement has no financial impact to the City's General Fund. The annual services agreement budget amount is estimated to equal the annual non-ad valorem assessment revenue amount net of the early payment discounts, County fees, and the City of Tampa’s cost allocation as it is spelled out further in the Agreement. Section 4. Other proper officers of the City are hereby authorized to do all things necessary and proper to carry out and make effective the provisions of this Resolution, which shall take effect immediately upon its adoption.
