Sir, This has with reference to communication on above mentioned subject. The proposal was considered as per screening category of 1(a) 82 of EIA notification 2006 by District Expert Appraisal Committee- Yavatmal in its 5ft meeting and decided to recommend the proposals of extraction of Sand for prior environmental clearance to DEIAA- Yavatmal subject to conditions. Information submitted by you has been considered by District Level Environment Impact Assessment Authority-Yavatmal in its 4ff meeting. 2. It is noted that the DEAC appraised the 66 proposals under screening category 1(a) 82 and recommended 63 proposals subject to conditions specified in the minutes of meeting of the DEAC. DEIAA-Yavatmal in its 4th meeting considering only 63 proposals which the recommendations of DEAC-Yavatmal has decided to accord the prior environmental clearance to above mentioned Sand Ghat under the provisions of Environmental Impact Assessment Notification 2006 subject to implementation of the following terms and conditions. Specific conditions: 1. Additional District Collector & District Mining Officer, Tahsildar (Revenue), to ens directions given by Hon'ble National Green Tribunal, Pune in Appeal No. 10/2013 (WZ) d October 2013 as below. - " ...........However, we direct that when further auctioning process is required to be conducted, ordinarily, the sand beds falling between the sand beds which are now already auctioned shall be avoided unless there is special certification issued by the competent authority which would indicate absence of any environmental damage, having .lJ regard to precautionary principle which is required to be adopted. We mean to say, it should not happen that presently the sand beds are auctioned by keeping distance of 1 km from each other and gap is filled up subsequently less than one or another pretext." 2. Distance between lease area to be marked as per actual shape and size, on Village Map or authenticated map available with Revenue Authority and ensure provisions regarding distance between two lease area and total lease area and total lease area in the Office Memorandum (O.M.) dated24/12l2013 issued by MoEF. 3. Proposals are recommended for environmental clearance for period 2017-18 only. 4. Provisions stipulated in Maharashtra Minor Minerals Extraction (development and regulation) Rules 2013 and Government Resolution of Revenue and Forest Department dated 121 03 120 13 and dated 26.12.20 I 4. 5. The validity of EC to the above mentioned sand blocks satisfring stipulated conditions is up to 30th September,2018 only. 6. Additional District Collector & District Mining Officer to ensure the directions given by Hon'ble National Green Tribunal, Pune in application no 4412014 (Paramjeet Singh Kalsi Vs MoEF& CC& others) dated 19.10.2015 as below. i) After the grant of 'Environment Clearance' to Tahsildar (Revenue), and once the Lessee or transferee or actual person who is going to execute the mining activity or sand exploration, is decided, 'Environment Clearance' shall be transferred in the latter's name as per procedure in Clause No.11 of the EC Notification. ii) Tahsildar (Revenue), will forward the proposal to DEIAA for transfer of 'Environment Clearance' to Lessee or Transferee. iii) The concerned tahsildar of that area will be the authority for conducting periodic inspection, site visits and attending to complaints of violation etc.
