41 THE CONSTITUTION OF KENYA ACT 1969 No. 5 of 1969 Date of Assent: 10th April 1969 Date of Commencement: 18th April 1969 An Act of Parliament to amend the Constitution of the Republic of Kenya and to reproduce the said Constitu- tion in a revised form, and for purposes incidental thereto ENACTED by the Parliament of Kenya, as follows : — 1. This Act may be cited as the Constitution of Kenya Short title. Act 1969. 2. In this Act, except where the context otherwise Interpretation. requires— "the Constitution" means the Constitution of the Republic of Kenya contained in Schedule 2 of the Kenya Independence L.N. 718/1963. 28 of 1964. (Amendment) Act 1965, the Constitution of Kenya (Amend- 18 of 1966. 40 of 1966. ment) Act 1966, the Constitution of Kenya (Amendment) (No. 4 of 1967. 2) Act 1966, the Constitution of Kenya (Amendment) (No. 3) 16 of 1968. 45 of 1968. Act 1966, the Constitution of Kenya (Amendment) (No. 4) f Act 1966, the Constitution of Kenya (Amendment) Act 1967, the Constitution of Kenya (Amendment) Act 1968 and the Constitution of Kenya (Amendment) (No. 2) Act 1968; "the revised Constitution" means the Constitution of the Republic of Kenya as set out in the Second Schedule to this Act. (1) The provisions of the Constitution specified in the Amendment of 3. Constitution. first column of the First Schedule to this Act are amended in such manner as to make them read according to the wording of the provision of the revised Constitution specified in rela- tion thereto in the second column of that Schedule. (2) For the avoidance of doubt, it is hereby declared that the amendments effected by subsection (1) of this section do not affect the continued existence or validity of any thing or matter having existence or validity under the Constitution immediately before the commencement of this Act. 42 No. 5 Constitution of Kenya 1969 Insertion of new 4. (1) Sections 10, 66, 85, 157, 162, 166, 177, 212 and 223 and Schedules 9 and 10 of the Constitution are repealed. N 718/1963. (2) Sections 13, 14 and 19 of the Kenya Independence Order in Council 1963 are repealed : Provided that any regulations made under the said section 19 and in force immediately before the commencement of this Act shall continue in force after such commencement and shall be deemed to have been made under section 127 of the revised Constitution. Revised 6. The revised Constitution set out in the Second Constitution. Schedule to this Act (which is a revised version of the Consti- tution as amended by this Act incorporating revisions as to form only and effecting no changes of substance) is hereby declared to be the Constitution of the Republic of Kenya and to be the authentic version thereof.
