North Road Ormond Level Crossing Removal Project Incorporated Document July 2015 Incorporated document pursuant to section 6(2)(j) of the Planning and Environment Act 1987 1. INTRODUCTION This document is an incorporated document in the Glen Eira Planning Scheme pursuant to section 6(2)(j) of the Planning and Environment Act 1987. The land identified in this document may be developed and used in accordance with the control in this document. The control in this document prevails over any contrary or inconsistent provision in the Glen Eira Planning Scheme. 2. PURPOSE The purpose of this Incorporated Document is to facilitate the use and development of land for the purposes of North Road Ormond Level Crossing Removal Project (the “Project”). The Project includes construction of a new railway station, road works, new pedestrian crossings and cycling connections, relocation of the car parking, drainage infrastructure and associated ancillary construction and development. 3. LAND This incorporated document applies to the land required for the Project. The land is shown as “Project Area” in Figure 1 of this document. 4. CONTROL Subject to the conditions under Clause 5 of this document, despite any provision to the contrary or any inconsistent provision in the Glen Eira Planning Scheme, no planning permit is required for, and nothing in the Planning Scheme operates to prohibit or restrict: • Removal of the rail level crossing at North Road. • The demolition of the existing Ormond Railway Station and construction of a new host station, access ways and facilities. • North Road retained as a 6 lane divided road. • Realignment and lowering of the Frankston railway line between Dorothy Avenue to Murray Road including; Earthworks and associated structures; Cuttings and fill; and Kerbs and channels. • Allowance made for future fourth rail track along the corridor. • New pedestrian crossing across North Road located at station entrance. • New bus stops created on North Road at station entrance with provision for a bus stop on Katandra Road retained. • Provision for Kiss and Ride facility on Katandra Road. • Landscaping, including the relocation of the existing palm trees on Katandra Road. • Construction of footpaths and shared access paths. • Existing local road underpass of the rail line at Dorothy Avenue removed. • New local pedestrian and cyclist connection constructed from Walsh Street to Newham Grove. • New shared use underpass constructed north of Dorothy Avenue. • Station car park on east side removed and relocated to the west side (no net loss of parking spaces). • Drainage infrastructure. • Removing, destroying and lopping trees and removing native vegetation. • Ancillary development and uses including, but not limited to: Constructing and using temporary site workshops, storage, administration and amenities buildings and associated vehicle parking; Displaying direction, tourist, construction and business signs; Demolishing buildings, structures and works; Constructing fences required for construction purposes; Constructing or carrying out works to create bunds, mounds and landscaping, excavation of land; Constructing temporary access roads, diversion roads and vehicle parking areas; Creating or altering access to a road in a Road Zone, Category 1; Constructing or carrying out works to alter or relocate drainage, utilities and services; and Subdividing and consolidating land. 5. CONDITIONS The use and development permitted by this document must be undertaken in accordance with the following conditions. 5.1 Plans for any removal, destruction, pruning or lopping of native vegetation necessary for the construction of the Project must be prepared to the satisfaction of the Secretary to the Department of Environment, Land, Water and Planning (or delegate). 5.2 Native vegetation offsets must be provided to the satisfaction of the Secretary to the Department of Environment, Land, Water and Planning (or delegate) within 12 months of construction commencing. 5.3 Prior to the commencement of works, an Environmental Management Plan (EMP) must be prepared to the satisfaction of the Minister for Planning. The EMP must have regard to the recommendations contained in the North Road, Ormond – Level Crossing Removal Project: Flora and Fauna Assessment, and include: Measures to minimise impacts on remnant vegetation, fauna habitats and adjacent areas of ecological and environmental significance; Measures to treat and control environmental weeds; Measures to control sedimentation and pollution within the Project Area and adjacent areas during development; and The ongoing environmental management for the Project Area. 5.4 Prior to the commencement of the development of the Project, a Construction Management Plan (CMP) must be prepared in consultation with Public Transport Victoria and the Glen Eira City Council to the satisfaction of the Minister for Planning. The CMP must detail how the proponent will manage impacts associated with construction of the project (eg the environmental and transport impacts). If the development is staged, development of each stage of the Project must not commence until a CMP has been prepared for that stage. 5.5 Prior to commencement of buildings or works on land in the Project Area that falls within a Land Subject to Inundation Overlay, Floodway Overlay, Special Building Overlay or the physical conveyances required for the functioning of drainage, then development plans must be prepared to the satisfaction of the relevant floodplain management authority. 5.6 The requirements to prepare plans or other documents listed above do not apply to preparatory works to facilitate the commencement of the Project, including, but not limited to: Investigating, testing and preparatory works to determine the suitability of land; Creation of construction access points; Site establishment works including temporary site fencing, site offices and laydown areas; Construction, protection, modification, removal or relocation of other existing utility services; The removal of vegetation (including native vegetation) to the minimum extent necessary; and Establishment of environment and traffic controls. All plans and other documents referred to in conditions 5.3, 5.4 and 5.5 must be approved prior to commencement of construction, and may be amended from time to time to the satisfaction of the Minister for Planning or relevant approving authority. The plans may be prepared and approved for separate components or stages of the Project and each plan must be approved before commencement of construction of that component or stage. Once approved the plans will form part of this document. The use and development of land in the Project Area must be undertaken generally in accordance with all approved plans. In deciding whether a plan is satisfactory or whether to consent to an amendment to the plan, the Minister for Planning, or delegate, may seek the views of Council or any other relevant authority. 6. EXPIRY The control in this document expires if any of the following circumstances applies: The development allowed by the control is not started by 1 July 2016. The development allowed by the control is not completed by 31 December 2020. The Minister for Planning may extend these periods if a request is made in writing before the Figure1: ProjectArea expiry date or within three months afterwards..
