Election to the Chancellorship: Notice 25 July 2011 InordertovoteintheelectiontotheChancellorship,membersoftheUniversity(otherthancurrentmembersof theRegentHouse)mustholdoneofthefollowingdegrees,whichqualifythemformembershipoftheSenate:any Master’sdegreeoftheUniversity,anydoctoraldegreeoftheUniversity,orthedegreeofBachelorofDivinityof theUniversity. ToenableeligiblemembersoftheUniversitywhohavenotyetproceededtoanappropriatedegreetodosoin timeforthevote,theVice-Chancellor,withtheapprovaloftheCouncilandtheProctors,givesnoticethatthe Congregation to be held on Saturday, 1 October 2011 – that is, the annual Congregation for the election and admissionoftheProctors–willexceptionallyalsobeavailabletothosemembersoftheUniversitytotakedegrees, in absentia only. The University’s linked charities: Notice 18 July 2011 The Charities Act 2006 provides that all charities should be subject to regulation. Although all charities have alwaysbeensubjecttogeneralcharitylaw,theUniversity,asanexemptcharity,waspreviouslyoutsidethescopeof theCharityCommission’sregulatorypowersortherequirementtoregisterasacharity. HEFCEbecametheprincipalregulatorofthosehighereducationinstitutions(HEIs)inEnglandthatareexempt charitieswitheffectfrom1June2010.HEIsarealsonowsubjecttotheCharityCommission’sinvestigationand enforcementpowers,althoughtheCommissionmustconsultwithHEFCEbeforetheyareexercised.Asprincipal regulator,HEFCEmust,inthisrespect,doallitreasonablycantomeetthe‘complianceobjective’inrelationto exemptcharityHEIs.The‘complianceobjective’is:‘topromotecompliancebycharitytrusteeswiththeirlegal obligationsinexercisingcontrolandmanagementoftheadministrationofthecharity’. Certaincharitieslinkedwithanexemptcharitymaythemselvesbeexemptfromtherequirementtoregisterif they come within the terms of the Charities Act 1993, Schedule 2, paragraph (w): ‘any institution which is administeredbyoronbehalfofaninstitutionincludedaboveandisestablishedforthegeneralpurposesof,orfor anyspecialpurposeoforinconnectionwith,thatinstitution’.Theaffairsofsuchlinkedcharitiesmustbeof‘direct concern’totheexemptcharity’sowntrustees. AsprincipalregulatorofexemptcharityHEIs,HEFCEwillregulatesuchlinkedcharitiesthroughitsengagement withtheHEI.HEFCErequiresthatinformationaboutindividuallinkedcharitiesisdisclosedintheHEI’sfinancial statementsfrom2010–11onwards. TheCouncilhasconsideredthecharitieswhichitregardsaslinkedwiththeUniversityforthispurpose.Firstly, therearecertainseparatelyconstitutedcharitieswhichareconsolidatedintheUniversity’sfinancialstatementsas subsidiaryundertakingsbyvirtueofhavingthemajorityofthecharity’strusteesappointedbytheUniversity. Thereareothercharitieswhicharenotconsideredsubsidiaryundertakingsbutarestillregardedasqualifying under‘paragraph(w)’. AttachedasaScheduleisthelistofcharitiesregardedaslinked,andthereforesubject,toHEFCEastheir principalregulator.TrusteesofcharitiesnotincludedintheSchedule,butwhoconsiderthattheircharityfallsinto thecategoryoflinkedcharitiesunder‘paragraph(w)’(thatis,administeredbyoronbehalfoftheUniversity,and establishedforitsgeneralorspecialpurposes)shouldadvisetheRegistraryinwritingby30September2011.
