MILL VILLAGE / LEBOEUF AREA COMPREHENSIVE PLAN December 1992 \ MILL VILLAGE BOROUGH ERIE COUNTY, PA ORDINANCE NO. 22 I An Ordinance to adopt the Comprehensive Plan of the Mill Village/LeBoeuf Area in accordance with PA Act 247 of 1968 as I amended. WHEREAS, the Borough of Mill Village applied for and received grant funds from the Pennsylvania Department of Community Affairs (PA DCA) I through the Small Communities Planning Assistance Program portion of the Community Development Block Grant Program; and WHEREAS, the Borough of Mill Village entered into an agreement with I the PA DCA and the Erie County Department of Planning (ECDP) to develop an area-wide Comprehensive Plan; and I WHEREAS, the Borough Planning Commission and the ECDP, which have developed documents as set forth in Section 1 of this Ordinance, have I recommended that the Comprehensive Plan be adopted; and WHEREAS, after due and timely notice by publication, as required by law, a public hearing upon the proposed adoption has been held by the I Borough Council and the Borough Planning Commission. NOW THEREFORE, be it enacted by .the Council of Mill Village Borough, 1 Erie County, PA that the Comprehensive Plan is adopted as follows: SECTION 1 That the accompanying Exhibit A document, known as the I Mill Village/LeBoeuf Area Comprehensive Plan be adopted. SECTION 2 If any section, subsection, or clause, phrase or portion of its application to any person or circumstances if for any reason be held invalid or unconstitutional by any court, such holding shall I not be construed to affect the validity of any of the remaining provisions or application thereof by this plan for such portion shall be deemed a separate, distinct and independent provision from the I remaining provisions, it is hereby declared that the legislative intent and this Plan would have been adopted had such invalid or unconstitutional provisions of its application not been included I herein. I SECTION 3 Enacted and effective this day of A% , 1993. I I President of Council ATTEST : II BoroughlSecretary I ~I On January 26, 1994, the LeBoeuf Township Comprehen8ivo Plan I was adopted, with the following changes: Page 8: Eliminate the words "Little Conneauttee Creek" Page 28: Corrections to the list of names. Besonson Bultdlng 'I Systems, eliminate Dewdrop Inn Tavern and Convenience Store, McLaughlin from the Peat and Garden Center, add Rupp's Ice Cream Stand. I Page 29: O'Connell Hardware changed to O'Connell Hardwoods. Page 30: Same change as above. Page 52: Eliminate Route 10. Page 62: Eliminate? list of present names. I Page 66: Eliminate number 7, and 4. Remove "and those portions that are unique and aesthetic natural areas", from number 2, change number 6 to read, "Provide for a variety of housing types I in the area in a manner that is controlled and reasonable." Change number 7 to read "Provide for a commercial area of the business district type and maintain other commercial nreaa whlch will adequately serve the residential areas.'' I Page 67: Eliminate number 10. Page 73: Eliminate first two paragraphs under Floodplalns and Wetlands I Page 74: The first paragraph should read, "A range of possible permitted uses in the floodplain are open land uses such .as agriculture, parks, campgrounds, forestry and residential yards. Along the fringes, commercial and industrial use8 could be I permitted in the form of parking areas and storage." Eliminate tho remainder of the page. Page 75: Do not include information directed at the Borough I of Mill Village. Page 80: Change the word "promote" to "provide". Page 91: Under item #A, eliminate the first three it€jmS. Under item t2, eliminate "this will facilitate paving these road@ I in future .years.", and the first four items. Page 94: Delete. Page 95: Delete. I Page 97: Delete numbers 1, 2, and 5. Page 98: Eliminate the Transoortation Plan, and the Public Utilities and Community Facilities Plan. The second paragraph of the Concentrated Growth Policy, and the Recreation Policy.
