Syed Mushabbir Hussain, Nizambad District has filed a complaint dated 20-10-2017 which was received by this Commission on 23-10-2017 for not getting the information sought by him from the PIO / O/o the Municipal Commissioner, Kamareddy Municipal Council, Kamareddy District. The brief facts of the case as per the complaint and other records received along with it are that the complainant herein filed an application dated 15-06-2017 u/s 6(1) of the RTI Act, 2005 before the PIO requesting to furnish the below information: Stating that the complainant did not get any information from the PIO even after 30 days of filing his 6(1) appeal, he preferred this complaint before this Commission requesting to direct the PIO to furnish the information sought by him u/s 18(1) of the RTI Act, 2005. The complaint was taken on file and notices were issued to both the parties for hearing to held on 16-08-2018. The case is called on 16-08-2018. The appellant is absent. The PIO / Sri B. Anjaneyulu, T.P.S., O/o the Municipal Commissioner, Nizamabad Municipality, Nizamabad is present. The PIO through Lr. No. PIO-II/120832/2018 dated 13-08-2018 informed to the appellant that the matter is pending in Hon’ble High Court Hyderabad vide W.P.No. 20383/2014. The appellant through application dated 15-6-2017 requested the PIO, Nizamabad Municipal Corporation on two items. One is action taken on the application dated 25-03-2016 and another one is action taken on Govt. letter No. 4082/M1/2017 dated 06-04-2017. The reply of the PIO is not specifying whether it is related to the petition dated 14-03-2017. Further, the PIO was silent in respect of item no. 2 of the application. Hence the PIO is directed to give a specific reply to the appellant within 7 days of receipt of this order under intimation to this Commission. With the above direction, the appeal is closed.
