ORDER: WHEREAS,in the Notificationissued with the S.O. first read above, by invokingsub-rule (3) of the rule 120 of the TamilNadu Panchayats (Elections) Rules,1995, the Commissiondirected that all the contestingcandidates in the electionslisted therein shall lodge a true copy of their electionexpenses kept by them or by their respectiveelection agent under sub-rule (1) of rule 120 of the saidRules in the formatprescribed therefor under sub-rule (2) of the rule 120of the said Ruleswith the officersmentioned therein, within thirty days from the dateof declarationof the resultof the elections; 2.WHEREAS,in the Notificationissued with the S.O.second read above, this Commissionprescribed a formatfor the saidpurpose by invokingsub-rule (2) of the rule 120of the saidRules; 3. WHEREAS,this Commissionconducted Ordinary Elections to the Rural LocalBodies during October 20Il; 4. WHEREAS,the District ElectionOfficer/District Collector, Dharmapuri, in the letterthird readabove reported that 770 candidatescontested in the said OrdinaryElections for variousoffices failedto lodgecopies of their accountof electionexpenses as directedby this Commission; 5. WHEREAS,based on the report of the said District Election Officer/DistrictCollector, a show cause notice was issued in the reference fourth read aboveto eachof the contestedcandidate who failedto lodgea true copy of the accountof electionexpenses in the OrdinaryElections held during the month of October, 20LL, through the District Election Officer/District Collector,calling for explanationwithin 20 days of the receiptof the said Notice, as to why actionshould not be taken againsthim/her as per sub-section(4) of section37 of the Tamil Nadu PanchayatsAct, L994(Tamil NaduAct 21 of 1994); 6. WHEREAS,on receiptof show causenotices 14 numberof candidates have submittedtheir accountdirectly to the Commissionand the same have been forwarded to District Election Officer in the reference sixth cited and requestedto sendhis remarksalong with the reportsof other candidates' 7. WHEREAS,the said District ElectionOfficer/District Collector, in his letter seventh read above, has now reportedthat out of the said 770 contested candidatestwo of them have expired,136 contestedcandidates have submitted their explanationalong with the accountswithin the time prescibedand 632 contestedcandidates, have neithersubmitted their explanationsnor lodgedthe accountof electionexpenses in spiteof the show causenotices issued to them; and 8. WHEREAS,in view of the said report of the District Election Officer/DistrictCollector, the Tamil Nadu State ElectionCommission is satisfied that 632 candidateslisted in column(3) of the Tablebelow against the contested electionmentioned in the correspondingentry in column(2) thereof,have failed to lodgean accountof electionexpenses as requiredby or under the said Act and haveno justificationfor the failure. 9. NOW,THEREFORE, in exercise of the powersconferred by sub-section ( ) of section37 of the Tamil NaduPanchayats Act, t994 (TamilNadu Act 21 of iSS+;, the Tamil Nadu State ElectionCommission hereby declaresthat the candidateslisted in column(3) of the Tablebelow against the contestedelection mentioned in the correspondingentry in column (2) thereof, shall be disqualified,for being chosenas a member or presidentfor a periodof three yearsfrom the dateof this Order.
