Policies HG3 Retention of Residential Amenity and HG5 House Extensions apply Contrary to Development Plan: No Consultations: Representations: One Representation Letter Newspaper Advertisement: Not Required Comments : This application is in respect of two extensions to an end-terraced dwellinghouse located at the turning- circle end of Ballayne Drive, within an established residential area of Moodiesburn and facing a shared parking court. The first element of the application is a two storey side extension in matching materials, set back from the front of the building and with a stepped down roof ridge. This extension raises no amenity concerns and complies with the relevant Local Plan Policies HG3 (Retention of Residential Amenity) and HG5 (House Extensions). Two car parking spaces would remain, one in the driveway and one as an allocated space in the parking court. My Transportation Section would prefer a third car parking space in the small, attractive front garden area, but I am satisfied this is not required in this instance to serve what would effectively remain a 3-bedroom house, albeit with a playroom which could become a fourth bedroom in the future. 25 92 / / \ The second element of this application is a single storey rear extension measuring 3.6 metres deep across the rear of the house, and this is the subject of an objection by the neighbouring resident at No54 Ballayne Drive. Following concerns expressed on the original design for the rear extension, the applicant has submitted amended plans which have reduced the impact on the adjoining terraced house by lowering and ‘hipping’ the roof and pulling the extension back by 350mm from the mutual boundary. The objector is, nevertheless, still concerned at the reduction in light which would ensue to his rear kitchen / dining room and also his back garden, a situation exacerbated by his house being stepped down (by approximately 600mm) from the application property. The rear gardens are 9.5 metres deep and I do not consider the impact on the adjoining garden to be critical. There would be some loss of light into the kitchen / dining room, however I do not consider that the impact of the amended proposal would be so significant as to warrant refusal on amenity grounds. A daylight / sunlight test has been carried out in accordance with the Building Research Establishment’s guidance and this test is satisfied by the application. The applicant could, in any event, build a kitchen extension measuring up to 16 square metres as ‘permitted development’, which could affect the neighbouring property more than the current, amended scheme. Notwithstanding the concerns expressed by the neighbouring proprietor, I recommend that planning permission be granted. Recommendation: Grant Subject to the Following Conditions:- 1. That the development hereby permitted shall be started within five years of the date of this permission Reason: To accord with the provisions of the Town and Country Planning (Scotland) Act 1997. 2. That the facing materials to be used for the external walls and roof shall match in colour and texture those of the existing adjoining building.
